HomeMy WebLinkAbout79-2323 ordORDINANCE NO. 79-2323 AN ORDINANCE CLOSING THE ALLEY RUNNING NORTH AND SOUTH ON THE SOUTH SIDE OF BLOCK THIRTEEN (13), WAYLAND HEIGHTS ADDITION TO THE CITY OF PLAINVIEW, HALE COUNTY,| TEXAS AND BEGINNING AT THE NORTH BOUNDARY LINE OF SOUTH WEST EIGHTH (8th) STREET AND EXTENDING NORTH ONE HUNDRED THIRTY FOUR AND FOUR TENTHS FEET (134.4). WHEREAS, William F. Seaman and wife, Imogene Seaman, as owners of the property on both sides of the alley running North and South on the South side' of Block 113, Wayland Heights Addition, Plainview, Hale County, TeXas,! and beginning with the North boundary line of South West Eighth (8th) Street and extending North 134.4 feet (and shown and designated on the platt attached to their petition) have by petition requested the City Council to close and abandon said alley, and petitioners Ire the owners of the land lying and WHEREAS, being situated on each side they have petitioned to be WHEREAS, The City Cou being used for any purpose of that portion of said alley which abandoned and closed; and cil finds that the alley is not now and ~that it is not being used for any utility purpose and has no~ been opened as an 'alley'fOr many years. That it is of no b~nefit to the City and is an expense in that the weeds have to be clut and the propertymaintained and that it would be in the public interest to close Said alley; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW: SECTION ONE. That the alley running North and South on the South side of Block 13, Wayland Heights Addition to the City of Plainview, Hale County, Texas, beginning with the North boundary line of said South West 8th Street and extending North 134.4 feet and being located between the property known as 108 South West 8th Street and 106 South West 8th Street be and~the same is hereby closed. SECTION TWO~ The City Council finds that it is in the best interest of the public to close and abandon said alley. SECTION THREE. That the said alley above described in SECTION ONE shall no longer be used as a public thoroughfare or as an open alley, and shall no longer be designated as an alley, and .the owners of the property continguous to said alley described in SECTION ONE of this Ordinance may take possession thereof and make use of same in accordance with the laws of the State of Texans.
