AN ORDINANCE AMENDING ARTICLE II, FRANCHISES, SECTION 5-28,
CHAPTER 5r INSURANCE REQUIRED, CITY CODE OF THE CITY OF PLAIN-
VIE'W, TEXAS INCREASING THE MINIMUM AMOUNTS OF LIABILITY INSUR-
ANCE REQUIRED BEFORE A FRANCHISE OR LICENSE SHALL BE ISSUED TO
OPERATE AN AMBULANCE
WHEREAS, Section 5-28, Chapter 5, City Code of the City of
Plainview, Texas, provides that before a franchise or license
to operate an ambulance shall become effective the operator of
same shall procure a liability insurance policy covering public
liability and property damage with minimum amounts of liability
thereunder as follows:
Any sinqle personal injury of one person
Personal injuries in any one single
accident
Property damage in any one single accident

WHEREAS, the City Council of the City of Plainview, Texas, has
determined that it would be in the best interest of the public
that the minimum amount of liability insurance required should
be as follows:
Any single personal injury of one person
Personal injuries in any one single
accident
Property damage in any one single accident

$300,000.00
$100,000.00
NOW' THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW:
SECTION 5--28, Insurance required, Chapter 5, City Code of the
City of Plainview, Texas,shall beand the same is hereby amended
as follows to-wit:
SEC. 5-28. Insurance required.
Before a franchise or license to operate an ambulance
shall become effective, the operator or same shall procure and
furnish to the city clerk a policy of insurance covering public
liability and property damage in the standard amounts and under
the standard provisions of such public liability and property
damage insurance, and being a public: liability and property
damage policy of insurance on each and every vehicle to be
operated by such operator as an ambulance with the minimum
amounts of liability thereunder as follows:

Such policy of insurance shall be one issued by a company
having sufficient assets, and having an agent in the city upon
whom service or process may be had and it shall be approved by
the director of public safety. If at any time any insurance
policy required under this section shall be cancelled by the
company issuing same, the director of public safety shall
immediately suspend the franchise held by the ambulance operator
who filed or caused to be filed, or for whose benefit the
insurance policy was filed, and in the event the said franchise
holder or ambulance operator does not file a good and sufficient
insurance policy as required by this section within ten (10)
days thereafter, the director of public safety shall notify the
city council of such fact, and the city council may for sUch
reason cancel the franchise of the operator who has failed to
maintain an insurance policy as required by this section. If
for any reason whatever such an insurance policy as required
herein is not on file with the city clerk the director of public
safety shall immediately suspend the operator's franchise.
It shall be unlawful for any person to operate an ambulance
on any public street in the city, unless an insurance policy as
required by this section is in full force and effect and on file
with the city clerk. (Ord. No. 685, S~ 11, 12, 4-7-58)
The necessity to increase the minimum requirements for liability
insurance without delay creates an emergency and an imperative
public necessity for the immediate preservation of the public
peace, health, safety and general welfare, requiring that any
rule necessitating more than one reading thereof, be and the
same are hereby suspended; and this Ordinance shall be passed
and take effect as an emergency measure and be in full force from
and after its passage as provided by law, and it is so ordained.
