AN ORDINANCE AMENDING ARTICLE III, LIABILITY INSURANCE, SECTION
31-136. MINIMUM AMOUNT OF COVERAGE, C!~APTER 3, CITY CODE OF THE
CITY OF PLAINVIEW, TEXAS, INCREASING THE MINIMUM AMOUNTS OF
LIABILITY INSURANCE REQUIRED BEFORE A FRANCHISE OR LICENSE SHALL
BE ISSUED TO OPERATE A TAXICAB.
WHEREAS, Section 31-36, Article III, Chapter 3, City Code of the
City of Plainview, Texas, provides that before a franchise or
license to operate a taxicab shall become effective the operator
of same shall procure a liability insurance policy covering
public liability and property damage with minimum amounts of
lialbility thereunder as follows:
For the injury or death of any one person in any one
accident~ $10,000.00
For total liability in any one accident or personal
injuries or death $20,000.00
For injury or destruction of property in any one
accident $ 5,000.00
WHEREAS, the City Council of the City of Plainview, Texas, has
determined that it would be in the best interest of the public
that the minimum amount of liability insurance required should
be as follows:
For the injury or death of any one person
in any one accident
For total liability in any one accident
or personal injuries or death
For injury or destruction of property
in any one accident
$100,000.00
$300,000.00
$100,000.00
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PLAINVIEW:
ARTICLE III[. LIABILITY INSURANCE, SECTION 31-36. MINIMUM
AMOUNT OF COVERAGE, City Code of the City of Plainview, Texas, shall
be and the same is hereby amended as follows to-wit:
SEC. 31-36. MINIMUM AMOUNT OF COVEB~GE.
(a)
The maximum amount of recovery in a policy of insurance
required by this article shall not be less than the follow-
ing sums, to wit:
(b)
(1) For the injury or death of any one
person in any one accident $100,000.00
(2) For total liability in any one accident
or personal injuries or death $300,000.00
(3) For injury or destruction of property
in any one accident $100,000.00
The minimum amount of insurance liability shall never be
less than the amount established by the statutes of the
state under the Texas Safety Responsibility Act or amend-
ments thereto. (Code 1957, Ch. 15, ~ 39)
The necessity to increase the minimum requirements for
liability ~nsurance without delay creates an emergency and an
imperative public necessity for the immediate preservation of
the public peace, health, safety and[ general welfare, requiring
that any rule necessitating more than one reading thereof, be
and[ the same are hereby suspended; and this Ordinance shall be
passed and take effect as an emergency measure and be in full
force from and take effect as an emergency measure and be in full
force from and after its passage as provided by law, and it is
so ordained.
PASSED this the 22nd day of January , A.D. 1980,
by unanimous vote of the City Council of the City of Plainview,
Texas.
