AN ORDINANCE APPROVING RATE SCHEDULES TO BE CHARGED BY SOUTH-
WESTERN PUBLIC SERVICE COMPANY IN THE CITY OF PLAINVIEW, TEXAS,
PROVIDING FOR AN EFFECTIVE DATE FOR SUCH RATE SCHEDULES; ~D
PROVIDING FOR CONDITIONS UNDER WHICH SUCH RATE SCHEDULES MAY
BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN~ANDDECL~RINGAN~V~RGEN.CY~..
WHEREAS on February 28, 1980, Southwestern Public Service
Company filed with the City of Plainview, a request for an
increase in rates to be charged within the City in the amount
of approximately $42,647,065per annum on a system-wide basis;
and
WHEREAS the City, having suspended the effective date of
such proposed rate increases by adoption of Resolution #R80-221,
adopted March 11, 1980, is of the opinion and finds that an
increase in rate should be approved; and
~EREAS the present members of the City Council are famil-
iar with the rate increases proposed by Southwestern Public
Service; and
WHEREAS the City Council has determined that it would be
in the best interest of the public that the present members of
the City Council who are familiar with the proposed rate increase
by Southwestern Public Service pass upon said rate schedule.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PLA. INVIEW, TEXAS:
SECTION 1. That an increase in the rates, tariffs and
charges of Southwestern Public Service Company for electric
power and energy sold within the City be approved in an amount
suclh that the adjusted total systemwide operating revenues for
the company in Texas be increased $31,923,000 per annum, based
on 'the adjusted test year ending Aug'ust 31r 1979, and such that
the overall return on the rate base 'will be 10.762% and the re-
turn on common equity will be~.lS.~0]~. Such Schedule of Rates,
as are approved in accordance herewith~ are those which said
company shall be authorized to render electric service and to
collect charges from its customers for the sale of electric
power and energy within the corporate limits of the City until
such time as said rate schedules may be changed, modified,
amended or withdrawn.
SECTION 2. That Southwestern Public Service Company shall,
wit]bin ten (10) days from the final passage of this ordinance,
file with the City a revised Schedule of Rates and Tariffs
setting forth those rates, tariffs and changes based upon an
increase in the total operating revenues as prescribed herein.
Such Schedule of Rates and Tariffs may be modified or amended
by 'the governing body of the City within twenty (20) days
from the final passage of this ordinance, otherwise, the same
shall be considered approved as filed. Such Schedule of Rates
and Tariffs as may be modified or amended, shall apply to all
power and energy used by each customer after the effective
date of this ordinance.
SECTION 3. That the action of the governing body of the
City enacting this ordinance constitutes, on its effective
date, a final determination of rates for Southwestern Public
Service Company within such City in accordance with Section 43
of 'the Public Utility Regulatory Act.
SECTION 4. Nothing in this ordinance shall be construed
now or hereafter as limiting or modifying, in any manner, the
riglht and power of the City under the law to regulate the rates
and charges of Southwestern Public Service Company.
SECTION 5. The present members of the City Council are
familiar with the proposed rate increases made by Southwestern
Public Service. The fact that said schedule rates should be
passed upon by members of the Council who are familiar with
the proposals made by Southwestern Public Service Company creates
an emergency and a public necessity that all rules requiring more
than one reading or prohibiting the taking of effect of said
ordinance on the day of passage be and the same are hereby sus-
pended, ar~ this ordinance shall be passed and take effect as an
emergency measure and be in full force from and after its passage
as provided by law, and it is so ordained.
