AN ORDINANCE AMENDING ZONING ORDINANCE NO. 77-2090 AND THE OFFICIAL ZONING MAP
OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES:
ZONE CASE NO. 433: Request of Industrial Foundation and Harry Bryant
for rezonlng of the following described tracts of land:
Two tracts of land out of the North and East portion of the North one-half (N/2)
of the iNorthwest Quarter (NW/4) of Section No. 38', Block JK-2, located in Hale
County, Texas, described as follows:
TRACT NO. 1:
BEGINNING at 5/8 inch rod set in ground in. middle of lane, in line with
fence to East for the Northwest corner of Section No. 38, Block JK-2;
THENCE East with fence, 2639.736 feet to 1 inch pipe at corner of
fences in middle of the North line of' said Section No. 38;
THENCE South 1319.868 feet to 5/8 inch rod at intersection of fences
North-South-East-West, and being in middle of the East line of North-
West Quarter of said Section No. 38;
THENCE West 923.7965 feet to point under fence in South line of North
Half of Northwest Quarter of said Section No. 38, and being the South-
east corner of 26-acre tract out of the Southwest part of same;
THENCE North 659.934 feet to Northeast corner of said 26-acre tract;
THENCE 1715.9395 feet to point in West line of said Section No. 38 and
the Northwest corner of said 26-acre tract;
THENCE North 659.934 feet to PLACE OF BEGINNING: and containing 54
acres of land;

TRACT NO. 2:
BEGINNING at 5/8 inch steel rod in the middle of lane in line with fence
East, beginning the middle of the West line of the Northwest one-fourth
of Section 38, Block JK-2;
THENCE East along fence, 1715.9395 feet to a point under fence, in the
South line of said North One-half of 'the Northwest One-Fourth of said
Section 38, and the South, Southwest corner of 54 acre tract lying
Northeast of this tract;
THENCE North 659..934 feet to reentrant corner of said 54 acre tract;
THENCE West 1715,9395 feet to the West, Southwest corner of same;
THENCE South 659,934 feet to the Place of Beginning;
SAVE & EXCEPT a 0.303 acre tract described in Warranty Deed dated
June 27, 1977, executed by Harry Ray Bryant to the State of Texas,
recorded in Vol. 620, Page 249, Deed Records, Hale County, Texas,
and containing some 25.697 acres of land, CITY OF PLAINVIEW, HALE COUNTY, TEXAS,
FROM R-2 TO A L-I ZONING DISTRICT and being located in the 3600 to
3800 Block of North Quincy Street.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has been duly
presented to the Planning and Zoning Commission for its recommendation which was
received by the City Council, and after due consideration, the City Council of the
City of Plainview finds that for the orderly growth of the City making the proposed
change as hereinafter set out will be in the public interest which creates an emer-
gency;
WHEREAS,~ all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map, have been fully complied with, as well as giving
notices provided'by Article lOllF Yernon's Annotated Civil Statutes-Amended, 1953,
and notice was duly published in ~the Plainview Daily Herald more than fifteen (15)
days prior to the date of the Public Hearing according to said notice was duly
held in the City Council Room of the City Hall, Plainview, Texas, at which time
persons appeared in support of the proposal; and after said hearing, it was by
the Ci~, Council determined that it would be in the PUblic interest due to changed
conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1.. That Ordinance No. 77-2090 and the Official Zoning Map be and the
same are hereby amended as follows, to-wit:
ZONE CASE NO. 433:
CHANGE two tracts of land,(as described in Page 1 of this
Ordinance) out of the No'rth and East portion of the North
one-half (N/2) of the Northwest Quarter (NW/4) of Section
No. 38, Block JK-2, located in Hale County, Texas, contain-
ing sOme 54 acres in Tract l, and some 25.697 acres in Tract
2;
CITY OF PLAINVIEW, HALE COUNTY, TEXAS, TRACT NO. l, FROM R-2 and M-1 TO A L-I
ZONING DISTRICT;
CITY OF PLAINVIEW, HALE COUNTY, TEXAS, TRACT NO, 2, FROM R-2 TO A L-I
ZONING DISTRICT. From the date of this Ordinance, said lot, tract, and parcel of
land described shall be and hereby be changed to the Zoning District indicated and
the Official Map is amended in accordance herewith.
SECTION 2, Upon passage of this Ordinance on first reading, the City Secretary be
and is hereby authorized and directed to cause tO have published in the Plainview
Daily Herald, a daily newspaper of general circulation in the City of Plainview,
Texas, a notice that a Public Hearing will be held in the'Council Chamber of the
City Hall in Plainview, Texas, at 7:.30 o'clock p., m~, on the 26th
day of AUGUST , 19 80 , to permit the public to be heard prior to con-
sideration of this Ordihance.~-~r second and final reading, said publication to be
made more than fifteen (]5) days prior to the ti~e designated for such Public Hearing.

A notice of time and place where and when said Ordinance would .be given a Public
Hearing and considered for final passage was published in the Plainview Daily Herald
a daily newspaper of general circulation in the ~ity of Plainview, Texas, said publi-
cation being on the 5th day of Auqust I , 19 80 , the same
being more than fifteen (15) days prior to the time designated for said hearing..
After such opportunity for the public to be hear~, said ordinance was passed on
second and final reading.
