HomeMy WebLinkAbout80-2404 ordORDINANCE NO. 80-2404 ORDINANCE AMENDING ORDINANCE NO. 69--1065, AND REPEALING ORDINANCE NO. 72-1245, PRESCRIBING THE SPEED LIMIT ON PORTIONS OF STREETS IN THE CITY OF PLAINVIEW, TEXAS; DESIGNATING SAID PORTIONS OF STREETS AS SCHOOL ZONES; PROVIDING FOR THE HOURS OF MAXIMUM SPEED LIMITS FOR THE OPEraTION OF MOTOR VEHICLES ON ANY STREET WITHIN A DESIGNATED SCHOOL ZONE; PRESCRIBING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE: AND PROVIDING FOR THE PASSAGE OF SUCH ORDINANCE AS AN.~'EMERGENCY. WHEREAS, Ordinance No. 69-1065 of the City of Plainview, Texas, designates portions of certain streets located within the City Limits of the City of Plainview, Texas, as school zones, and provides maximum limits of speed for operation of any type of motor vehicle within said school zone; and WHEREAS, the City Council of the City of Plainview, Texas, has determined that it would be in the best interest of the public to amend said Ordinance NO. 69-1065 designating certain portions of the streets of the City of Plainview, Texas, as school zones and provide maximum limits of speed for the oper- ation of motor vehicles on said streets, and has determined that it would be in the best interest of the public to repeal Ordinance No. 72-1245; NOW~ THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS: Ordinance No. 69-1065 of the City of Plainview, Texas, shall be, and the same is hereby' amended as follows, to-wit: SECTION 1: The portion or portions of the streets of the City of Plainview, Texas, hereinafter described and designated are hereby deClared to be school zones. It shall be unlawful for any person to operate any automobile, motor cycle,, motor scooter, or any type of motor vehicle which is self-propelled at a greater speed than twenty (20) miles per hour between the hours of 7:30 A.M. to 9:00 A.M.; 11:30 A.M. to 1:30 P.M.; 2:30 P.M. to 4:00 P.M. on Mondays, Tuesdays, Wednesdays, Thursdays, and Fridays of each week on the following portions of the following streets: On 16th Street between Quincy Street and Smythe Street; On West Alpine Drive between West Crest Way Street-and the inter- section of West Alpine Drive and Columbia Street by Hillcrest School; On 18th Street between Independence Street and Joliet Street; On Independence Street between 18th Street and 20th Street; On South Broadwav street beginning at the North curbline of the intersection of ~outh Broadway and West Crest Way Street North, a distance of 192 feet, and beginning at the South curbline of the intersection of South Broadway Street and West Crestway Street South, a distance of 114 feet. On~llth Street between Oakland Street and Raleigh Street; On 10th Street between~Portland Street and Quincy Street; On Canyon Street between 5th Street and 10th Street; On 20th Street between Utica Street and~Amarillo Street; On Yonkers Street between 19th Street and 24th Street; on Joliet Street between 18th Street and 20th Street; On 32nd Street ~between Joliet Street and Lexington Street; On Lexington Street between 31st Street and 32nd Street; On Austin Street between Campbell Stree~ and Givens Street; On Ash Street between 9th Street and 10th Street; On 9th Street between Ash Street and Beech Street; On Hilton Street beginning at the 1000 block of Hilton Street to the 1300 block of E1 Camino Drive; On Portland Street between 10th Street and llth Street. On Ennis Street beginning 150 feet north of the North right-of- way l~ne of Itasca Street to 150 feet South of the South right- of-way line o.f Itasca Street. It shall be unlawful for any person to operate any automobile, motorcycle, motor scooter, or any type of motor vehicle which is self-propelled at a speed greater than 25 miles per hour when the school zone traffic signal control light is flashing on Mondays, Tuesdays, Wednesdays, Thursdays, Fridays of each week on the following portions of the following streets: On U. S. Highway 70 (also known as 5th Street) beginning at the West curbline of the intersection of U. S. Highway 70 and Canyon Street, West, a distance of 188' and beginning at the East Curb- line of the intersection of U. S. Hiqhway 70 and Canyon Street East, a distance of 155'. On Quincy Street, between 14th Street and i5th Street; SECTION 2: At all other times except during the hours on the days as hereinabove provided in Section 1 the maximum speed limit shall be the speed limit as designated and posted on each of said streets. SECTION 3: Subsection 1 of S'ection 75 of Article III, Chapter 14, of the Code of the City of Plainview, 1957, and Ordinance No. 66-952, is hereby repealed. All other parts or sections of Ordinances of the City of Plainview fixing Speed limits in the City of Plainview on the portions of streets as set out and described in Section 1 hereoft insofar as the same are in conflict herewith, are hereby repealed. SECTION 4: Ordinance No. 72-1245 of the City of Plain- view, Texas, is hereby repealed. SECTION 5: Any person who shall violate or fail to comply with the provisions of this Ordinance shall b~ deemed guilty of a misdemeanor and upon conviction thereof shall be punished by ~fine of not less than $1 00 and not more than $200.00. ' SECTION 6: The necessity to designate certain portions of streets in the City Limits of the City of Plainview, Texas, as school zones and to provide maximum limits of speed thereon prior to the beginning of the school'term for the year 1980 creates an emergency and aln imperative public nec- essity for the immediate preservation of-the public,-s peace, health, safety and general welfare, requiring that any rule necessitating more than one reading thereof be, and the same is hereby suspended; this Ordinance shall be passed and take effect as an emergency measure-and shall be in full force from and after its passage as provided by law and it is so ordained.
