ORDIANANCE NO. 81-2454
AN ORDINANCE OF THE CITY OF PLAINVIEW REGULATING AND CONTROLLING THE
MAINTENANCE OF BUILDINGS AND PREMISES; TO SAFEGUARD LIFE, HEALTH, PROPERTY
AND PUBLIC WELFARE BY REGULATING THE STORAGE, USE AND HANDLING OF DANGEROUS
AND HAZARDOUS MATERIALS, SUBSTANCES AND PROCESSES, AND BY REGULATING THE
MAINTENANCES OF ADEQUATE EGRESS FACILITIES, PROVIDING FOR THE REPEALING OF
ORDINANCE NO. 75-1833 OF THE CITY OF PLAINVIEW, PROVIDING FOR ADOPTION OF
THE UNIFORM FIRE CODE, 1979 EDITION, AS COPYRIGHTED IN 1979; THE INTER-
NATIONAL CONFERENCE OF BUILDING OFFICIALS OF WHITTIER, CALIFORNIA, PROVIDING
FOR CERTAIN AMENDMENTS THERETO; PROVIDING PENALTIES FOR THE VIOLATION THERE-
OF; PROVIDI~NG A SEVERABILITY CLAUSE; DIRECTING PUBLICATION OF THE DESCRIP-
TIVE CAPTION OF THIS ORDINANCE, TOGETHER WITH THE PENALTY PROVISIONS, AND
PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City Council of the City of Plainview finds that the present
Fire Code of the City of Plainview is inadequate to properly protect the public
health, safety, and welfare of the citizens of the City of Plainview and their
property, from loss due to fire, and
WHEREAS, the City Council appointed the Fire Code Board of Appeals to
prepare recommendations for the City Council in regard to a new Fire Code; and
WHEREAS, the Fire Code Board of Appeals recon~ends the Uniform Fire Code,
1979 Edition, with certain amendments thereto, be adopted as the Fire Code of
the City of Plainview; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS:
SECTION 1.
That the 1973 Edition of the Uniform Fire Code, as copyrighted in
1973 by the International Conference of Building Officials of
Whittier, California (being Ordinance No. 75-1833 of the City of
Plainview) be and the same is hereby repealed.
SECTION 2.
That the 1979 Edition of the Uniform Fire Code, as copyrighted in
1979 by the International Conference of Building Officials of
Whittier, California, as hereinafter amended is specifically adopted

as the Fire Code o.f the City of Plainview, Texas, and a copy is
attached hereto and incorporated herein by reference as thouqh
set out completely in detail. A cop~ of said Uniform Fire C~de
shall be filed with the City. Secretary..and a copy maintained in
the office of the Fire Marshal of the City of Plainview, Texas.
All such copies .to be open to public inspection during business
hours of the office where they are maintained, with the following
amendments thereto:
That Part I, Article. 2, Division III, Section 2.303 (b) of the
Uniform Fire Code, 1979 Edition, shall 'be and the same is hereby
amended by adding t° the list of recogniZed Standards as part of

as copyrighted in 1981.
That Part I, Article 4, Section 4.101 of the Uniform Fire Code,
1979 Edition, shall be and the same is hereby amended by deleting
requirements for permits. No permit shall be required when referred
to in the code.
That Part II, Articl.e'9, Section. 9.123 of the Uniform Fire Code,
1979 Edition, shall be and the same is hereby amended to read as
follows: When reference is made to theUniform Mechanical Code,
it shall be deleted.
That Part I, Article 21, Division I of the UnifOrm Fire Code, 1979
Edition, is hereby~amended by adding thereto a section to be known
as Section 2..110 which said section shall read as follows:
That the entire in¢'orporated area of the City of 'Plainview is hereby
declared to be and is hereby established as a fire district, and
said fire district shall be known and designated as Fire Zone 1,
2 and 3, and each such zone shall include such territory and
portions of the City of Plainview as follows:
ZONE 1 shall include the territory as set out and descri'bed by
me-~-{~--and bounds as Zone I under Chapter 9, Article 1,
Section 9~1(~) of the Municipal Code of~the City of Plainview
as adopted !978. '
ZONE 2 shall include the territory as set out and described by
m'etes~ and bounds"as Zone 2 under Chapter 9, Article 1,
Section 9.1(b) of the Municipal Code, City of Plainview, adopted
1978. It shall also include all commercial property and buildings
now existing, and all property that may be zoned for commercial use.
ZONE~ 3 shall, include all the ~area not set out in Zone 1 and Zone 2.
That Part VII, Article 79, Division ll, Section 79.201, of the
Uniform Fire Code, 1979 Edition, shall be and the same i.s hereby

amended to read as follows- The limits in which storage of
flammable liquids i.n outside above ground tanks is prohibited,
are hereby established as follows:

In any Residential District, as zoned by Ordinance
No. 77-2090, same being the Zoning Ordinance of the City
of Plainview, as amended.
SECTION 8.
The limits in which new bulk plants for flammable or combus-
tible liquids~are prohibited are those zones in the City
of Plai'nview where such bulk plants are not permitted by
Ordinance No. 77-2090, same being the Zoning Ordinance of
the City of Plainv~ew, as amended.
PENALTIES:
SECTION 9.
Any person, firm, or corporation violating any of the provisions of
this Code shall be deemed guilty of a misdemeanor, and each such
person shall be deemed guilty of a separate offense for each and
every day or portion thereof during which any violation of any of
the provisions of this Code is committed, combined, or permitted,
and upon the conviction of an~ such violation such person shall ~e
puni'shabie by a fine of not more than Two Hundred Dollars ($200)

SECTION 10.
If any provisions of this Ordinance or of the Code hereby adopted
or the application thereof to any person or circumstance is held
invalid, the remainder of the Code and the a lic ' .

The City Secretary is hereby authorized and directed to cause the
publication of~.the descr~iptive Caption of this Ordinance together

FIRE CODE
ORDINANCE NO. 81-2454
WHEREAS, the City Council of the City of Plainview did on September 8,
1981, at a regular session of said City Council pass and adopt Ordinance
No. 81,2454. The Distributive Caption and Penalties of said Ordinance
are as follows:
DISTRIBUTIVE CAPTION
"An Ordinance of the City of Plainview regulating and controlling the
maintenance of buildings and premises; to safeguard li~fe, health, proPerty
and: public welfare by regulating the storage, use and handling of danqerous
and hazardous materials, substances and processes, and by regulating ~he
maintenances of adequate egress facilities, providing 'for the repealing of
Ordinance No. 75-1833 of the City of Plainvieu, providing for adoption of
the Uniform Fire Code, 1979 Edition, as copyrighted in 1979; the International
Conference of Building Officials of Whittier, California, providing for
certain amendments thereto; providing penalties for the violation thereof;
providing a severability clause; directing publicatiOn of the descriptive
caption of this O'rdinance, 'together with the Penalty provisions, and
providing an effective date of this Ordinance."
PENALTIES
The Penalties for the violation of this Ordinance are as follows:
Any person, form, or corporation violating any of the provisions of
this Code shall be deemed guilty of a misdemeanor, and each such person
shall be deemed guilty of a separate offense for each and every day or
portion thereof during which any violation of any of the provisions of this
Code is committed, combined, or permitted and upon the conviction of any
such ~iolation such person shall be punishable by a fine of not more than
Two Hundred Dollars ($200).
