COUNCIL OF THE CITY OF PLAINVIEW, TEXAS CLOSING THE ALLEY RUNNING NORTH AND SOUTH THROUGH THE CENTER OF BLOCK 26, A SUBDIVISION OF BLOCK 26 AND 27, LAKESIDE ADDITION, PLAINVIEW, TEXAS BEGINNING AT THE NORTH BOUNDARY LINE OF WEST EIGHTEENTH (18TH) STREET AND EXTENDING NORTH TO THE SOUTH BOUNDARY OF WEST TWENTIETH (20TH) STREET. WHEREAS, the City of Plainview, with the permission and consent of the Plainview Independent School District, has develop plans and initiated construction contracts for the development of a public park on Block 26, a Subdivision of Blocks 26 & 27, Lakeside Addition, Plainview, Texas; and WHEREAS, when the plat of said property was filed for record on the Sth day of July, ~929, the plat contained a dedicated alley that ran through the center of said Block 26, beginning at the north boundary line of west eighteenth (18th) street and extending north to the south boundary of west twentieth (20th) street; and WHEREAS, for the past several years said property has serviced the Plainview Independent School District as a playground and for the foreseeable future will continue to service the community of Plainview as a recreational area; and WHEREAS, the City Council finds that the alley is not now being used for any purpose, and that it is not being .used for any utility purpose, and has not been -opened as an alley for many years, and that it would be in the best interest for the citizens of Plainview to close said alley: NOW, THEREFORE BE IT ORDAINED by the Mayom and City Council: SECTION 1: That the alley running north and south through the center of Block 26, a subdivision of Blocks 26 & 27, Lakeside Addition, Plainview, Texas, beginning at the north boundary line of west eighteenth (18th) street and extending north to the south boundary of west twentieth (20th) street, be and the same is hereby closed. SECTION 2: The City Council finds that it is in the best interest of the public to close and abandoned said alley. SECTION 3: That the said alley above described in Section 1 shall no longer be used as public thoroughfare or as an open alley, and shall no longer be designated as an alley, and the owners of the property contiguous to said alley described in Section 1 may take possession and make use thereof in accordance with the laws in the State of Texas.
