That the Uniform Buildin9 Code, 1~79 Edition (bein90rdi- nanc~ l~o. 80-2426 off the City of Piainvie~). be, and the sam~ is hereby SECTION 2: That the 1982 Edition of the "Uniform Building Code", Volume 1, as copyrighted in 1982, by the Lnternational Conference of Building Officials, Whittier, California, as hereinafter amended is specifically adopted as the Building Code of the City of Plainview, Texas, and a co]?l is attached hereto and incorporated herein by reference as though set'out complete- ly in detail. A copy of said Uniform Building Code shall be filed with the City Secretary and a copy maintained in the office of the Building Official of the City of PlaY,view, Texas, all such copies to be open to public inspection during business hours of the offices where they are main- tained, with the follow~ng amendments thereto; SECTION 3: That Chapter 2, Section 205, of the "Uniform BuildJ~ng Code" 1982 Edition, shall be and the same is hereby au~nded by the addition thereto of a new paragraph which .Shall read as follows: "Any person, firm, or corporation violating any of the pro- visions of this Code shall be deemed guilty of a misdeaean- or, and each such person sl~ll be deemed guilty of a separate offense for each and every day or portion thereof during which and violation of any of the provisions of f~his Code is committed, continued, or permitted, and upon conviction of an~v such violation such person shall be p%Lnishable by a fine of not more than ~o Hundred Dollars, ($200.00). SECTION 4: That Section 302 (B), Chapter 3 of the "Uniform Building Code", 1982 Edition, shall be and the same is hereby amend- ed to read: "Plans and Specifications. With each application for a building permit, and when requir~l by the Building Official for enforceraent of any provisions of this Code, two sets of plans and specifications shall be submitted. The Building Official shall require plans and ~ifications to be prepared and designed by_ an engineer or architect licensed by the State to pzactice as such. EXCE~fZON: The Build~ Official my waive the submission of plans', calculations, etc., if he finds the nature of the work applied fo~ is such that reviewing of~ plans is not necessary to obf~/n, c~mpliance with f~his, code. 2 SECTION 5: SECTION 6: That Section 304, Chapter 3, Table 3-A, of the "Uniform Building Code", 1982 Edition, shall read as follows: "(A) Any person desiring a building permit shall at the time of filing an application therefore, as provided ~n Section 301 of this Code, pay to the Building Official a fee as required in this Section: Building Permit fees shall be as set out by separate ordir~nce. There shall be no charge for first re-inspection of new buildings and additions or alterations of old buildings, and when more than one re-inspection per permit is re- quired, a re-inspection fee of $5.00 for each additional re-inspection shall be charged. The re-inspection fee mst be paid at the City Hall before a further inspection will be made. (B) Plan Checking fees. ~enever a plan is required to be submitted by sub-section (c), of Section 301, of the "Uniform Building Code" adopted in Section 2 of this ordinance, a Plan Checking fee shall be paid to the Build- ing Official at the time of submitting the plans and speci- fications for checking. Said Plan Checking fee shall be equal to one-half of t~he Building Permit fee as set out by special ordinance. That Chapter 3 of the "Uniform Building Code", 1982 Edition is hereby an~nded by deleting Section 307 and adding there- to a section to be known as Section 307 to read as follows: S~/CION 307: (A) No person or persons shall hereafter move any building, house or structure within the limits of the City of Plainview, Te~s, where the same shall be moved in, through or upon the streets, alleys, avenues, or public grounds unless said person shall, before moving said build- ing, house or structure, secure a permit to do so frcm t~he Building Official of the City of Plainview, Te~xas. (B) No person or persons shall hereafter move any build- ing or structure from within or from outside the city limits of the City of Plainview, Tewms, to any place within the city limits of the City of Plainview, Texas, or cause the same to be done, without first obtaining-a separate build- ing permit for each building or structure from the Building Official of the City of Plainview, Texas. SECTION 7: SECTION 8: (C) Whenever any person or persons shall make an application for a Building Permit fox: a building or structure which is to be moved from outside the city limits of the City of Plainview to a place inside the city limits, the said person shall deposit with the Building Official a sum of money equal to TWenty Cents (20¢) per mile for each mile necessa]./f to travel from the city limits of Plainview to the building and return to the city limits of the City of Plainview, plus a sum of money equal to the sum of Eight and No/100 dollars ($8.00) per hour based upon the Building Official's estimated ~ required to make the inspection and in traveling to said building and returning to the city limits of the City of Plainview. Said deposit shall becc~ the properhy of the City of Plainview and is to pay for the extra expense in inspecting said building and shall not be returned to the person making application regardless of whether or not the Building Permit is issued. Such payment shall be in addition to the regular fees required for issuing a building permit as set out, and prescribed in Table No. 3-A of Section 3 of the "Uniform Building Code", 1982 Edition as amended. (D) The Building Official may designate a competent deputy to make such inspection for him, who shall, in such event, be paid the sum of Twenty Cents (20¢) per mile for travel outside the city limits of the City of Plainview in making the ~-~spection, plus the amount of Eight Dollars ($8.00) per hour for each hour of time necessary to make the inspection and travel from the city limits of the City of Plainview to said place where the building or structure to be inspected is located and return to the city limits of the City of Plainview. That Chapter 5, Section 503(D) of tb~ "Uniform Building Code'w, 1982 Edition, shall be and the same is hereby amended by the addition thereto of a new paragraph which shall read as follows: "Exception 4: Occupancy Group R buildings with an attached garage and in Fire Zone No. 3 shall not be required to have one hour fire resistive separation k~tween the garage and living ~_arters." That Chapter 16, Section 1601(A) shall be added to the 1982 Edition of the "Uniform Building Code" to include the following paragraph to read as follows: "That the entire incorporated area of the City of Plainview is hereby declared to be and is herel~y established as a fire district, and said fire district shall be known and 4 designated as Fire Zone 1, 2, and 3, and each such zone shall include_ such territory and ~rtions of the City of Plainview as follows: ZC~NE 1 shall include the territory as set out and described by mates and bounds as Zone 1 under Chapter 9, Article t, Section 9.1 (a) of the Mmmicipal ~e of the City of Plain- view, as adopted 1978. ZONE 2 shall include the terriho~.z as set out and described by mates and bounds as Zone 2 under Chapter 9, Article i, Section 9.1(a) of ~unicipat Code, City of Plainview, as adopted 1978. It shall also ~nclude all con~ercial property and buildings now existing~ and all property that may be zoned for comm~ial use. ZONE 3 shall include all of the territory Within the city lin~{-~ of the City of Plainview, not included in Zone 1 and2. Said Zones 1~ 2, and 3 of th~ City of Plainview are hereby adopted as the fire zones of the City of Plainview, for the publication of the regulations included in the said "Uniform Building Code", 1982 Edi~hion. The classification of the soil under all portions of every building shall be based upon %he examination of adequate test borings or excavating made at the site when required by the Building Official. The location of the test borings or excavations and the nature of the sub-surface materials shall be indicated on the plans. ' SLA i~ CO;~S T 'SECTION 12: SECTIC~ 13: SECTION 14: That section 2907 (A) of Chapter 29 of the "Uniform Building Code", 1982 Edition shall be amended to read hereafter as follows: (A) General. Footings and Foundations, unless otherwise specifically provided, shall be constructed of solid masonry or concrete and shall be in all cases extended below the front, line. Foundation walls supporting ~ shall extend at least eight inches (8") above-the finish grade adjacent .to the wall. at all points. Mortar used in foundation walls ~-~d footings shall be as specified in Section 2403 (T). Severability Clause. If any pr~Tisions of this' Ordinance or of the Code hereby adopted or the application thereof to any. person .or.circumstance is held invalid, t~..remain- der of the Code, and the application .of such protrusions to ot/~er persons or circumstances, shall not be affected thereby o The City Secretary is hereby au~norized and directed to cause the publication of the descriptive Caption of this Ordinance together with the penalty provisions as provided herein. This Ordinance shall become effective after its passage and publication as required by law.
