HomeMy WebLinkAbout82-2499 ordORDINANCE'NO. 82-2499 SIGN CODE WHEREAS, the City Council of the City of Plainview did on September 28, 1982, at a regular session of said City Council, pass and adopt Ordinance No '82-2499. The Distributive Caption and Penalties of said Ordinance as follows: DISTRIBUTIVE CAPTION "An Ordinance of the City of Plainview regulating and controlling the design, quality of materials, construction, location, electrification and maintenance of all signs and sign structures not l-ocated within a building; providing for the repealing of Ordinance No. 71-1158; providing for the adoption of the 1982' Edition, Uniform Sign Code, as copyrighted in 1982 by the ~nternationa! Conference of Building Officials of Whittier, California, with certain amendments thereto; providing for the violation thereof; providing a severablilty clause; directing publication of the Descriptive Caption of this Ordinance together with the Penalty provision of the 1982 Edition, Uniform Sign Code, as amended and providing an effective date. PENALTIES The Penalties for the violation of this Ordinance are as follows: Any person, firm or corporation violating any of the provisions of this Code shall De deemed guilty of a m%sdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of such violation, such person shall De punishable Dy a fine of not more than Two Hundred Dollars [$200.00). WHEREAS; the City Council of the Cit7 of Plainview appointed the Fire Code/Building. Code' Board of Appeals to prepare reconn~dations for tt~e City Council in regard to a new sign Code: and WHEREAS; the Fire Code/BuildingCodeBoard of Appeals reconn~nds the 1982 Up~formSignCode, with certa~n~nents ~hereto; be adopted as the Sign Code of the City of Plainview, NOWTHEREFORE: BE IT O?~DAINED BY THE CITY' COUNCIL OF THE CITY OF PIA/N~. SECTION 1. Tb~nt the Uniform Building Code 1970 Edition Volun~ V, Signs~ 0~ing Ordinance ~]o. 71-1158 of td%e City of Plainview) be, and the sachs is hereby repealed. SECTION 2. That the 1982 Edition, Unifom Sign. Code, as Copyrighted in 1982 by the International Conference of Building Officials, ~ittier~ California, as hereinafter amended, is specifically adopted as the Sign Code of the City of Plainview, Texas, and a copy is attached hereto and incorporated herein by reference as though set out completely in d~tait. A copy of said Uniform Sign Code shall be. filed with the City Secretary and a copy maintained in the office of the ~ailclin~ Official of the. City of P/mJnview, Te¥~ns. All such copies to be open to public inspecti~on during business .hours of the offices where they are maintained with the following ~.~endments.thereto: (1) That Section 103 (d) of the 1982 Edition, Uniform Sign Code shall hereafter read as follows: (d) Violation and Penalties. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use or n~intain any sign or structure in the city, or cause or permit the sa~e to be_ done, contrary to or in violation of any of the provisions of this Code. Any person, firm or corporation violating any of the provi- sions of %his Code shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of ~his Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than Two Hundred Dollars ($200.00). (2) That Section 304 of the 1982 Edition Uniform Sign Code shall hereafter read as follows: SECTION 304. A sign permit fee shall be paid at the time application is made for erection of. a sign. Such fee shall be as get out by separate ordinance. S~CTION 3. That Chapter 3 of the 1982 Edition, Unifor~ Sign Code, is hereby amended be the addition thereto of a new paragraph to be know as SECTION 307 to read as follows: SECTION 307. All signs erected within the Ci~3 of Plainview shall conform %o all requirements establislhed by the Zoning Ordinances. SECTION 4. All former Ordinances or p~ts thereof, conflicting or inconsistant with the provisions of %his OrdJ~nance or of the Code hereby adopted are hereby repealed. 2 SECTION 5. Should any section, paragraph, sentence, clause, or word of this Ordinance or of the Code adopted hereby, be declared unconstitutional or invalid for any reason, the remainder of t_his Ordinance, and of the Code adophed hereby shall not be affected thereby. SECTION 6.
