M. Pressler Homestead Survey, Hale County, Texas, save and except the following described two (2) tracts of land: Tract No. One (1): The South 300 feet of Lot No. 14 of the Subdivision of Reese Property located on J. M. Pressler Homestead Survey, Hale County, Texas, as shown by plat recorded with dedication deed in Book 314, Page 533, Deed Records, Hale County, Texas, and all of that portion of the J. M. Pressler Homestead Survey situated East of and adjoining said 300 foot strip, and which land is described by metes and bounds as follows: BEGINNING at a point in the East line of Section 41, Block JK-2, Hale County, Texas, which is 1410.7 feet South, 1°39'40" West of its Northeast corner, which point is in the West line of the J. M. Pressler:Homestead Survey; THENCE South-1°39"40" West along the common line of said Section 41 and the West line of the J. M. Pressler HomesteadSurvey a distance of 300 feet; THENCE. South 89°1'20" East 540.3 feet to a point in the East line of the J. M. Pressler Homestead Survey; THENCE in a Northerly direction along the ]East line of the J. M. Pressler Homestead Survey a distance of 300 feet; THENCE Westerly parallel with the South line of this tract approximately 540.8 feet to the PLACE OF BEGINNING. WHEREAS, the proposed change in Zoning pistrict as hereinafter made has been duly presented to the Planning and Zoning Commission for..its recommendation which was received by the City Council, and after due consideration, the-City Council of the City of Plainview finds that for the orderly growth of the City making the proposed change as hereina:~tex set'out will be in the public interest which creates an emergency; and, WHEREAS, all conditions precedent requixed by Iaw for a valid amendment to the Zoning Ordinance and Map, have been fully complied with, as .well as giving notices provided by Arti~l.e 1011E Vernon's ~nnotated'Civil Statutes- Amended, 1953, and notice was duly published in the Plainview Daily Herald more than fifteen (15) days prior to the date. of the Public_Hearirzg accord- ing to said notice was duly held in the Cii:y Council Room of the-City Hall, Plainview, Texas., at which tame persons. appeared iii support of the proposal; and after said hearing, it was by the City Council determined that it would be in the .public interest due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance, NOW, THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY QF PLAINVIEW: SECTION 1. That Ordinance No. 82-2478 and the Official Zonng,Map be and the same are hereby amended as follows, to-wit: ZONE CASE NOo 469: Rezone a tract of land described as follows: Lot No. Fourteen (14), Block No. One, (1), Subdivision of Reese Property located on J. From the date of this Ordinance, said lot, tract and parcel of land described shall be, and hereby be changed to the Zoning District indicated and the official Map is, amended in accordance herewith. SECTION 2. Upon passage of this Ordinance on first reading, the City Secretary be and is hereby authorized. and directed to cause to have published in the Plainview .Daily I~erald, a daily newspaper of general circulation in the City. of Plainview, .Texas, a notice that a public hearing shall-he held in the Council Chamber of the City Hall `in Plainview, `texas, at 7:30 o'clock TA. M., on the 8`th 'day of F~bir, 1983, to permit the. public to be heard prior to c®nsideration of this Ordinance for second and final reading, said publication to be made more than fifteen (15) days prior to the time designated for such public hearing., PASSED on first reading this, the 11th day of Januaiy 198, A notice of time and place where and when said Ordinance iaould be given a public hearing and .considered for final passage was published in the Plainview Daily Herald, a daily newspaper of general, circulation in the City of Plainview, Texas, said publication being on the day of , 1983, the same being more than fifteen (15) days prior to the time designated for said hearing.
