ORDINANCE N0. 83~-2519
AN ORDINANCE OF THE CITY OF PLAINVI]EW, TEXAS PROVIDING FOR A
PENALTY TO DEFRAY THE COST OF COLLE(~I'ION OF DELINQUENT TAXES,
PROVIDING FOR AN EFFECTIVE DATE AND DECLARING IT TO BE AN
II~4ERGE[~TCY WITH PASSAGE ON ONE READItUG.
.WHEREAS, the City Council of the City of Plainview, Texas deems it
'necessary to have a declared policy regasd.ing the expense of collecting
delinquent taxes due to the City of Plainview; and
' Tn1I~REAS, the City Council of the City of Plainview is of the
opinion that said expense of collecting said delinquent taxes should be
'borne by the delinquent properties and their owners who are responsible
'for causing such expenses;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
', Plainview, Texas thats
SECTION lm Whenever any accounts for delinquent taxes owned the
City of Plainview are given to its tax attorney for collection, on or
', after July 1 of the year they become delinquent, the City of Plainview
,shall be entitled to, and shall collect, ari additional penalty of
,fifteen (15%) percent of the delinquent taxes and penalty (including an
'interest owned) due on each delinquent property at the time of
collection, either before or after suit and or foreclosure sale as
,provided by Section 33.07 of the Texas Property Tax Code.
SECTION 2m In addition to the collection expenses provided for in
Section 1 above, the City of Plainview sha]_1 be entitled to collect the
'act:ual expenses incurred by the City of Plainview in providing all data
'and information as to the name, identity, and location of necessary
parties and the legal description of property necessary to the filing of
'any suit for delinquent taxes.
SECTION 3: This ordinance shall be declared as an emergency and
.passed on one reading as shall become effective immediately after its
publication as required by law.
PASSED, APPROVES AND ADOPTED this the 24th day of May, 1983.
