THE MANNER`'OF ;NOTICE AND OF SALE; P'ROVIDING'FOR THE BUTTES QF CZTY PERSONNEL REGARDING THE DISPOSITION OF FUNDS AND THE DTSPOSITTON OF WORTHLESS PROPERTY. ', WHEREAS, the City Council of the City of Plainview has de- ter~ined that stolen, abandoned, or recovered property' is being accumulated by the Police Department. of the City which is of no further evidencary:'value in the. prosecution 'of cases; and WHEREAS-, the City Council deems it in. the best interest of the -.City of Plainview that such property`be sold er otherHrise disposed of: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RLAINVIEW, TEXAS, that: Section `l: All abandoned, stolen, ar recovered property of every kind, including motor vehicles,'~rhich shall remain with the Police bepartment cf the City for a period of ,sixty (60) days, without. .being claimed or reclaimed by the' owner, whether known or not, and which is of .no further evidentiary 'value in the prosecution of 'criminal: or civil'tases, mad be sold or disposed of as provided.. herein. Section ,~: The Chief of Police, or his designee, shall furnish to theiCity G1Prk a List of all property subject to sale hereunder before the date Qf sale. Possession of such property. shall remain with' the Chief of Police, Sect,!ion 3: Thirty (30) days notice of the time and place of sale, 'and la description list of the property a.nd motor vehicles, or both,. to k~e offered for sale `shah. be;` postedl by the City Clerk at any reg~llar entrance to the City Hall and a~t one other .public place in Half' County, Texas, and if the name `of the Qwner of such property -be mown, a copy thereof shall be sent to such owner by registered mai ~' . Sectionl4: When the requirements of the preceding sections have • .bee met, the .property.. shall be offered for sale at a public. auction to the highest bidder far each piece of property separately or assexttbied in lots,`whchever in the discretion pf the City Clerk shall offer the highest price obtainable for the property, provided that motor vehicles that`are operative under their own power shall be s~ld separately. i~~ -'Sectian~ 5: The pub:Iic auction provided for herein shall be con- ducted at the place.. and'haur designated in the notice and all sales shall be for cash. Section 6: The City Clerk, or his designee, shall conduct the public 'auction provided 'for in`this ordinance and shall keep. an accurate statement of each 'article or'motor vehicle sold and the price kid and paid therefor, and shall make a complete report in writing to the City Manager of the tame, place.,.. and manner of conducting t:he sale and all funds received on account of such auction sha~:l be delivered to the City- Director of Finance.. who shall give his receipt therefor. The Director of Financc is hereby required to place all funds received 'by .him under and by virtue of this ordinance to the credit, of the general fund, to be thereafter disbursed as the City Council sha11 deem appropriate. Section 7: Any property'whch has been listed and. offered for sale `under the provisions of this chapter and for which no price or sum -has !been offered,, if deemed. -by the Cit,f Clerk to be worthless and witi}out value, shall.. be disposed of in such manner as the City Cle.~k shall prescribe.
