ORDINANCE -NO. 83-2541
AN ORDINANCE AMENDING A PORTION OF SECTION l OF .ORDINANCE
NO.'83°2522, PRESCRIBING THE SPEED LIMI`.I'S ON A PORTION OF A
CERTAIN STREET 3N THE CITY OF PLALNVIEW, PROVIDING A PENALTY,
AND'DECLARING AN EMERGENCY.
WHE~,REAS, after an engineering and traffic investigation, the
City Counci]_ of the City of Plainview finds that circumstances
are',such that a maximum .reasonable safe speed for the operation
of vehicles .under. conditions found to e:~ist in the hereinafter
spe'~ified location of the street in the City of Plainview is
less than thirty (30} miles per hour and that the maximum safe
spe,~d at -such location is twenty (20) miles per hour;
WHEI~2EAS, the City Council deems it to be in the:. interest of
thelcitizens of Plainview that. said Ordinance be amended as follows:
NOWIi, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF 1'LAINVIEW
Section l: It shall be unlawful for any person operating a motor
vehiic e which is self.-propelled to operate said motor vehicle at
a greater speed. than twenty (20) miles per. hour on the following
poritioiz of the following street
On West 6th Street between Joliet street and Parkway Drive
Secjtion 2: Any person who shall violate or fail to comply with
any!, of the provisions of this Ordinance shall be deemed guilty of
a misdemeanor and upon conviction thereof shall be punished by a
fin~,e of not less than One Dollar ($1.00) nor more-than Two Hundred
Dolllars ($20.0.00)
Sec~'~ition 3: The fact that the. driving at more than twenty (20}
mil','es der hour upon the street designated herein. endangers the
heahth, safety, and welfare of the citizens of Plainview creates
an ~'~eme:rgency and imperative public necessity requiring that any
rule necessitating more than one reading hereof be and the same
hereby is suspended and this Ordinance shall be passed and take
effect as an emergency measure and shall be in full force and
effect from and after its passage as provided by. law, and it is
so rdained.
