', AN ORDINANCE PRESCRIBING THE SPEED LIMIT ON PORTIONS
', OF F.M. 400 (NORTH DATE STREET) WITHIN THE CITY LIMITS
OF THE .CITY OF PLAINVIEW, HALE COUNTY; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PRESCRIBING A PENALTY
FOR THE .VIOLATION OF THIS .ORDINANCE.
~IWHEREAS, after an engineering and traffic. investigation, the City
Councl,il of the City of Plainview finds that circumstances are such that
the m!,aximum reasonable and safe speed for the operation of ve'nicles under
condil,tions found to exist on North Date Street in the City of Plainview,
is as'I prescribed by the Ordinance hereinafter enacted;
',NOW, THEREFORE, BE IT ORDAINED BY TH:E CITY COUNGIL OF THE CITY OF
PLAIN,VIEW :
'SECTION ]L: The speed limit on North Date Street in the City of
Plain',view, Texas, at locations hereinafter designated shall be as
follows:
'(a) The maximum legal .speed limit on North Date Street (F.M. 400)
for northbound traffic only shall be 35 M]?H from the point of intersec-
tion with the centerline of U.S. 70 (East Fifth Street) for a distance of
0.2ti0'', mile to the point of intersection with the centerline of East
Eighth Street; thence 40 MPH for a distance of 1.186 mile to the point of
intersection with .the North City Limit of the City of Plainview, a point
0.010'',mi1e north of the centerline of East: Twenty Fourth Street.
(b) The maximum legal speed on North Date Street (F.M. 400) for
southbound traffic only shall be 40 MPH fx-om a point 0.010 mile north
of th~± centerline of East Twenty Fourth Street southerly a distance of
0.620mi1e to the point of intersection with the centerline of East
Fourt~ent:h Street from the West; thence 35 MPH for a distance of 0.823
mile to the point of intersection with the centerline of U.S. 70 (East
Fifth'Street)

,'SECTION 2. It shall be unlawful for any person to operate a motor
vehicle which is self-propelled, or automobile or motorcycle on the
above) designated portion of North Date Street in the City of Plainview,
at a Ii~speed greater than that which is hereinabove designated in Section 1
of th',is ordinance as the maximum legal speed limit.
',SECTION 3. All Ordinances and parts of Ordinances in conflict with
the provisions of this Ordinance shall be hereby repealed.
SECTION 4. Any person who shall vioaate or fail to comply with the
provisions of-this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine of not less than
$1.OOland not more than $200.00.
