ORDINANCE NO. 84-2552
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 82-2478 AND THE OFFICIAL ZONING
MAP OF THE CITY OF PLAINVIEW SO AS TO MAKE THE FOLLOWING CHANGES:
ZONE CASE N0. 492
Request of Graddy Tunnell representing C. E. Marse Company, and J. B. Roberts
representing Louisiana Nursing Homes, Inc. for rezoning a tract of land contain-
ing 13.004 acres and described as follows:
Being all of a 3.997 acre and a 4.313 acre tract conveyed to Marse $
Son, Inc. as recorded in .Volume 665, Page 587 of the Hale County Deed Records,
a 2.949 acre tract conveyed to-Marse $ Son:, Inc. as recorded in Volume 665,
Page 581 of the Hale County Deed Records, together with an .0.569 acre and a
1.176 acre tract conveyed to Louisiana Nursing Homes as recorded in Volume 672,
Page 111. of the Hale County Deed Records:
BEGINNING at a 1/2 inch steel rod set fo-r the northeast corner of Lot 43
of Grandview Addition, Revised Unit No. 2, Plainview, Hale County, Texas and
the northwest corner of said 3.997 acre tract, said-rod being 799.9 feet .North
and 178.8 feet'N. 70°09' W. of the Southeast.~~orner of the northeast quarter
of Survey No. 28, Block JK-2, Hale County, Texas;
Thence S. 70°09' E. 1146.25 feet along the north lines of said 3.997 acre,
2.949 acre, 4.313 acre, and 1.176 acre tracts and the south right of way line
of U. S. Highway No. 70 (Olton Road) to the northeast corner of said 1.76 acre
tract;
Thence S. 2°00' W. 312.45 feet to an interior corner of said 1.176 acre
tract;
Thence S. 88°00' E. 168.11 feet to the most easterly northeast corner of
said 1.176 acretract in the west right of way line of Grandview Drive;
Thence South 43.34 feet along said-right of way line and the east line
of said 1.176 acre tract to a point of curvature;
Thence Southwesterly continuing along said .line an arc length of 80.56
feet around a cuxve to the right having a radius point bearing West 200 feet,
a central angle of 23°04'.42", and a chord bearing S. 11°32'21" W. 80.02 feet
to the southeast corner of said 1.176 acre traces;
Thence PV. 82°53' E. 625.84 feet along the south lines of said 1.176 acre
and 0.569 acre tracts and also the north line of Revised Grandview Addition
to Plainview, Hale County, Texas, as recorded in Volume 462, Page 297 of the
Hale County Deed records to the southeast'cornE:r of said 0.569 acre tract and a
corner mf said 4.313 acre tract;..
Thence N. 70°09' W. b36.01 feet continuing along the north line of said
addition and along the south lines of said 4.313-acre, 2.949 acre, and 3.997
acre tracts to the southwest corner of said 3.997 acre tract;
Thence North along the West line of said 3.997 acre tract, at 17.5 feet
pass the southeast corner of said Lot 43, in all 535.6 feet to the POINT OF
BEGINNING and containing 13.004 acres :for commercial-use and located in
the-3400 and 3500 Block of Olton Road,
CITY OF PLAINVIEW, HALE COUNTY, TEXAS, FROM an R-I (Single-Family Residential)
and;a CRD ZONING-.DISTRICT to a CGB (Commercial General Business) ZONING
DISTRICT.

WHEREAS, the proposed change in Zoning Districts as hereinafter made has
been duly presented to the Panning and Zoning Commission for its .recommendation
which was received by the City Council, and after due consideration, the
City Council of the City of Plainview: finds that for the orderly growth of
the City making the proposed change as hereinafter set out will be in the
public interest which creates an emergency; and,
WHEREAS, all conditions precedent required by Iaw for a valid amendment to
the Zoning Ordinance and Map, have been-fully complied with, as .well as
giving notices provided by Article IOIlF Verno:n's Annotated Givil Statutes-
Amended, 1953, and. notice was duly published i:n the Plainview Daily Herald
more than fifteen (15) days prior to the date Hof the Public Hearing according
to said notice was duly held in the City Council Roam of the City Hall,
Plainview, Texas, at which time persons appeared in support of the proposal;
and a!,fter said hearing., it was by the City Council determined that it would
be in. the public interest due to changed conditions, that the Zoning
Ordinance and. the Zoning leap be amended in the manner hereinafter set forth
in the body of this Ordinance; NOW, THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1. That Ordinance No. 82-2478 and the Official Zoning Map be and the
same are hereby amended as follows, to-wit:

Change a tract of land containing 13.004 acres and described as follows:
Being all of a 3.997 acre and a 4.313 acre tract conveyed to Morse ~
Son,. Inc.. as recorded in Volume 665,. Page 587 cif the Hale County Deed Records,
a 2.949-acre tract conveyed to Morse ~ Son, Inc; as recorded in Volume 665,
Page 581 of the Hale County Deed Records, together with an-0.569 acre and a
1.176 acre tract conveyed to Louisiana Nursing Homes. as recorded in Volume 672,
Page 111 of the Hale County Deed Records:

acre tracts to the southwest corner of-said 3.'.997 acre tract;
Thence North along the West line of said 3.997 acre tract, at 17.5 feet
pass the southeast corner of said Lot 43, in a:11 535.6 feet to the POINT' OF
BEGINNING and containing 13.004 acres for commercial use and located in
the 34G0 and 3500 Block of Olton Road,
City of Plainview,. Hale County, Texas, from an R-1 (Single-Family Residential)
and a CRD Zoning District to a CGB (Commercial General Business) Zoning District.
From the date of this Ordinance, said lot, tract and parcel of land described
shall be and hereby be changed to the Zoning District indicated and the official
Map is amended in accordance herewith.
SECTION 2. Upon passage of this Ordinance on i'irst reading, the City
Secretary be and is hereby authorized and directed to cause to have published
in the Plainview Daily Herald, a daily newspaper of general circulation in
the City of Plainview, Texas, a notice that a public hearing shall be held
in the Council Chamber of the City Hall in Plainview, Texas, at 7:30 o'clock
P. M., on the 22nd day of May, 1984, to permit the public to be heard
prior to consideration of this Ordinance for second and final reading, said
.publication to be-.made more than fifteen (15) dlays prior to the time designated
for such public hearing.
PASSED on first reading this, the 8th day of May, 1984.
A notice of time and place where and when said Ordinance would be given a
public hearing and considered. for final passage; was published in the
Plainview Daily Herald, a daily newspaper of general circulation in the
City of Plainview, Texas, said publication being on the 6-~ day of ,
1984, the same being more than fifteen (15) days prior to .the time designated
for said hearing. After such. opportunity for .the public to be heard, said
Ordinance was passed on second and final reading.
PASSED on second and final reading this, the -22nd day of May,
1984.
