FIRE CODE
Ordinance No. 84-2555
AN ORDINANCE OF THE CITY OF PLAINVIEW AMENDING CHAPTER 12 OF THE CODE
OF ORDINANCES OF THE CITY OF PLAINVIEW, TEXAS, ENTITLED "FIRE PROTECTION
AND PREVEPJTION," ADDING THERETO ANEW SECTION 12-7 PROVIDING FOR THE
REQUIREMENT,OF FIRE LANES REGULATING THf: MARKING OF CONTROLLED FIRE
LANES ANC) PROHIBITING PARKING THEREON; PROVIDING PENALTLES FOR THE
VIOLATION THEREOF; PROVIDING A SEVERABII_ITY CLAUSE; DIRECTING PUBLICATION
OF THE DESCRIPTIVE CAPTION OF-THIS ORDIP~ANCE, TOGETHER WITH THE PENALTY
PROVISIONS AND PROVIDING AN EFFECTIVE DA7E OF THIS ORDINANCE.
WHEREAS the City Council of the City of Plainview has found .that the follow-
ing changes irD the "Fire Protection and Prevention" Ordinance of the City of
Plainview would be in the best interest, safety, and fire ,protection of the
citizens of the City of Plainview;
NOW, THEREFORE BE IT ORDAINED by the Mayror and City Council of the City of
Plainview, Texas:
Section 1. That Chapter 12, Article 1 of the Code of Ordinances of the City of
Plainview, be and is hereby amended by adding thereto a new Section 12-7, which
shall read as follows:
Section. 12-7. Requiring fire lanes for buildings, marking of controlled
fire lanes and. pro hi biting parking thereon.
A. No building of any type construction for any occupancy except
buildings of Type I, II, III, and IV construction when equipped
~-ith an approved automatic sprinkler system and buildings
housing one family and two family dwelling units situated on a
single lot and Group M occupancies,, as defined in the Building
Code of the City of Plainview, shall be constructed unless every
pari; of the structure can be reached from a public street, public
way or highway with 150 feet of fire hose; provided that. said
..structure may be erected at a greater distance if the owner,
manager or person in charge constructs and maintains afire lane
as designated 6y the Fire Marshal, having a minimum width of 20
feel; and a minimum height clearance of 14 feet, to a point from
which every portion of the structure can be reached with 150 feet
of fire hose; or, where dimensions of-any structure are such that
any portion of the structure is more than 150 feet from an
exterior wall, then standpipes shall be installed in an approved
manner within the building and approved fire lanes or streets
shall be provided adjacent to the building. Standpipe installations
shall be in accordance with the standards set forth in the building
code of the City of Plainview.
B. Any designated fire lane, more than. 100 feet long, shall either
connect at both ends to a dedicated street or be provided with a
turn-around having a minimum radius of 50 feet.
C. A11 fire lanes shall be maintained and kept in a state of good
.repair at all times. by the owner, manager or person in charge
of the premises, and the City of I?lainview shall never be
responsible for the maintenance thereof.
D. The Fire Marshal or his designated representative is hereby
authorized to designate adequate fire lanes and/or turn-arounds
t® any building when deemed neces~~ary for fire department access
in the event of fire in such building. Such fire lanes shall be
designated only upon the agreementt between the Fire P~larshal and
the property owner, manager or developer, that such location of a
fire lane is mutually acceptable. In the event an agreement
canNOt be reached as to the locatiion of any fire lane, the matter
sha11 be presented to .the Buil-ding Code and.-Fire Code Board of
Appeals who shall make such designation.
E. The owner, manager ar person in charge of any building to which
fire lanes or turn-arounds have been designated by the Fire Marshal
or his designated representative shall .post and maintain appropriate
signs in conspicuous places along such fire Lanes or turn-arounds
stating "NO PARKING - FIRE LANE - TOW AWAY ZONE." This may be
. accomplished at the owner's preference by the use of a single sign
or by the use of two signs mounted) together on a single past, one
designating "N0 PARKIPJG - FIRE LAME" and one designating "TOW AWAY
BONE." The fire marshal or his dully authorized representative or
the Chief of Police or his authorized representative is hereby.
authorized to cause such streets, fire lanes and turn-arounds to be
maintenance free and unobstructed at all times for fire department
uses. "Appropriate signs," as req~;uired in these sections, shall
consist of red letters painted on a white background located at not
more than twenty (20) feet intervals along one side of the fire lane
easement. Those letters shall be not less than three (3) inches in
height as to "NO PARKING," not less than two (2) inches in height as
to "FIRE LRNE," and not less than one (1} inch in height as to
"TOW AWAY ZONE." The curbing shall be painted solid red along the
side of the fire lane easement and the perimeter of the fire lane
easement shall be outlined with broken red striping, which striping
shall be at least six (6) inches wide and no more than ten (lO)
feet in length, with no more than ten (10} foot intervals between
such stripes.
F. Parking in Fire Lanes Prohibited.
1. No person shall park or place nor allow, permit or suffer
to be parked or placed or to remain unattended any motor
vehicle, trailer, boat, machinery or similar obstruction
within or .upon an area designated or dedicated as afire
lane and marked by an appropriate sign placed in a
conspicuous place.
2. If a motor vehicle, trailer, boat, machinery or similar
obstruction is found parked or unoccupied within an
area designated or dedicated as a fire lane as required
by this section, the same is hereby declared a nuisance
per se, and the fact that such motor vehicle, trailer,
boat, machinery or similar obstruction is parked or is
unattended or unoccupied in such a manner as to obstruct
in whore or in part any such fire lane shall be prima

facie evidence that 'the registered owner unlawfully
parked,. placed or permitted to' be parked or placed such
obstruction within afire lane.
3. The records of the State Department of Highways and. Motor
Vehicle Division,. Texas Crime Information Center and/or
PJational Crime Information Center showing the name of the
person to whom the Texas. Highway License or out-of-state
Highway License or boat are prima facie evidence of awner-
ship by the named person.
0. Issuance of Citations and Impoundment of Obstructions.
1. If any motor vehicle, trailer, boat, machinery or similar
obstruction is found parked or unattended in or upon a
properly marked fire lane which .has either been designated
or dedicated as afire lane, the Fire Marshal or his
designated representative, the Police Chief or his
designated representative, is hereby authorized to issue
a citation for such violation, charging the. owner, as
defined in subsection F above. Such obstruction may be
removed by towing it to such. place as designated by the
Police Department. Such vehicle or obstruction may be
redeemed by payment of the towing and impounding fee and
storage charges in the same manner and at the same rate
as any vehicle impounded for illegal parking as .set forth
in Article XIU, Division I, 'Section 32-349(b) of this
Code.
2. too citation as provided for 'in Paragraph 1 above shall be
voided by the redemption of 'the abstraction from the place
of impoundment,. nor shall the violator be relieved of any
penaity assessed by a judge of the. Municipal Court for a
violation of any provision of this section.
H. Abandonment or Closure of Fire Lanes.
No owner, manager or person in charge of any premises served by
a required fire lane shall abandon or close any such fire lane
without written permission of the Fire Marshal.
Section 2. Penalties. That violation of any provision of this Ordinance shall
be deemed a misdemeanor punishable by a fine not to exceed TW0 HUNDRED DOLLARS
($200.00) as provided. in Section l-5, of the C=ity of Plainview's Code or
Ordinances.
Section 3. Severability Clause. That should any section, paragraph, sentence,
clause, phrase or work of this Ordinance be declared unconstitutional or invalid
for any reason, the remainder of this Ordinance. shall not be affected thereby.
Section 4. The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption of this Ordinance together with the
penalty provisions herein. This Ordinance shalll become effective after its
passage and publication as required. by law.
