PROVISION AND PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE. WHE,REA.S, Section 161 of the Plainview. City Charter states-that the City Council will provide for and shall require-the compulsory connection to the sewage system of the City of all pr~nises abutting on and. which are witTnin the drainage area of such sewage systems; and WHET2EAS, for the benefit, health, welfare, and safety of the citizenery of Plainview is .been determined to bE, in the best interest that septic tanks and cesspool systems be eliminated whenever possible; and NOW', THEREFORE BE IT ORDAlTTED BY THE CITY COUNCIL OF THE CITY OF PLATNVIE~W, TEXAS `.PRAT: SECTION l: That Ordinance 84-2559 amend aAl previous water, sewer extension ordi~zances, to wit: That any residence or business within 150 feet of the City's sanitary sewer system will be required to connect to and be served. by the sanitary sewer system and discontinue the use of a septic tank or cesspa)1 system. SECTION 2: AleL ordinances and parts of orc~.inances .that conflict with the .provisions of this ordinance will be hereby. repealed. C-- SECTION 3: Any person that violates or fails to comply with the .provisions of ibis ordinance shall be deemed guilty of a misdemeanor upon conviction thereby will bE~ punished by a fine of not less than $1.OO or more than $200.00 each day and considered separate offense. SECTION. 4: That the City Secretary be instructed to publish in the Plainview Daily Herald, a newspaper of general circulation, the caption- head_-ind of this ordinance prior to its second and final reading.
