HomeMy WebLinkAbout84-2563 ord ORDINANCE NO. 84-2563 AN ORDIlQANfCE'~ OF THE CITY OF PLAINVIEGoT, TEXAS ADOPTING THE 1984 EDITION OF THE NATIONAL ~~~'T'RTCAL CODE (NFPA 70-1984) AND REPEALING A]'sI, ?REVIOUS EDITIONS OF THE NATIONAL ELECTRICAL CODE E~RETOFORE ADOPTED; F?ROVII)ING PENALTIES FOR VIOLATION OF THIS ORDINANCE; PROVIDING A SF'~TERABILT.TY' CLAUSE; DIRECTING PUBLICATION OF THE DESCRIPTIVE CAPTION 7COGE~.'HER WIT~i PELQALTY PROVISIONS OF THIS ORDINANCE; AND PROVIDING AN f~'F'F~TIVE DA'L'E. WHEREAS, the Board of Electrical Examiners of the City of Plainview Yia.s heretofore approved and recommended :revisions to the local Electrical. Code and the City Council has heretofore adopted such revisions in. Ordinance No. 84-2550, and WHERF~AS, the Board of_Electrical Examiners of the City of Plainview Yeas approved the recommended adoption of the 1984 Edition of the r3ationa.l Electrical Code (NFPA 70-1984) to the City Council, as revision and updating of Electrical Codes is necessary and essential for the protection of the public health, safety .and property and in the best interest of the citizens of Plainview,_Texas; NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Y?lainview: SECTION 1. That Section 6.1 of the Electrical Code of the City of ~?lainview (Crrdinance No. 84-2550) be amended to read as follows to-wit: '°National Electrical Code shall mean the 1984 Edition of the National Electrical. Code (NFPA 70-1984). as adopted by the National Fire F?rotection Association." SECTION 2. PENALTIES: Any person, either by himself or by agent, and. any firni, corporation or other entity who. violates any other provisions of this Ordinance shall be deen~d. guilty of a misdemeanor, and upon. conviction of any such violation, shall be fined in any sum not i~ exceed 'ISri10 HUNDRED DOLLARS ($200.00); and each day during which such ~riolaton continues shall constitute a separate and distinct offense. In any case of a violation of any of the terms or provisions of this Ordinance by any corporation, the officers and agents ,actively in charge of the business of such corporation shall be subject to the penalty herein provided. Any offense defined herein which has been defined by law. of the State of Texas as an offense and for which a penalty has been prescribed .shall be punished as provided. in said State law and nothing herein shall be held as fixing any penalty contrary to a penalty provided by the laws of the State of Texas. SECTION 3. SEVE}.2ABILITY CLAUSE: If any. provisions of this (hdinance hereby adopted or the application thereof to any. person or circumstance is held invalid, the remainder of the Code, and the <~.pplication of such provisions to other persons or circ~nstances, shall not be affected thereby. SECTI(~] 4. REPEALER CLAUSE; All other Ordinances or parts of Ordinances inconsistent with or conflicting with the terms hereof are hereby repP..aled. SECTIOIoT 5. PUBLICATION: The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty prova_sions for the violation thereof. This Ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. 1984.
