WE[EREAS, VERNON'S TEX. CIV. STAT. ANN. art. 1011 and art. 1135 have been amended by the Texas Legislature authorizing municipalities t:o assess a fine of ug to One Thousand Dollars ($1,0001.00) upon conviction of violating certain designated city ordinances ; and Wl[EREAS, th.e City Council has determined that it would be in the best interest and to the benefit of the citizens of Plainview, Texas that flee penalty for violating said plumbing code should be incread>ed in. accordance with said statist:e, NOW, THEREFORE, BE IT ORDAINED BY 7CHE CITY COUNCIL OF THE CITY OF PLA:CNVIEW, TEXAS THAT SECTION 26.3 OF ORDINANCE N0. 8I-2447 BE AMENDED AS FOLLOWS: 2Ei . 3 PENALTIES Any person, either by himself or agent, and any firm, corporation or other entity who violates any of the p~:ovisions of this Code shall be deemed guilty of a misdemeanor and, upon conviction of any such violation, shall be fined in any sum not to exceed ONE THOUSAND DOLLARS ($1,000.00); and each day during whichsuch violation continues shall constitute a separate a d~i.stinct offense. In any case of a violation of any of the terms or provisions of this ordinance by any corporation. sha11 be subject to the penalty herein provided. Any offense defined herein which has been defined by laws of the State of Texas as an offense and for which. penalty has been rpescribed .shall be punished as provided in said State Law, and nothing herein shall be held as fixing any penalty contrary to a penalty provided by the laws of the State of Texas. The necessity to amend Section 26.3 of Ordinance No. 81-2447 creates an emergency and it is an impez°a.tive public necessity that more tl:~an one reading thereof be, and the same is hereby suspended; this ordinance sha11 be passed. and take effect as an erriergency measure and sha11 be in full force ar~<i effect from and after its passage as provided by law, and it is so ordained, it ~~t P,45SED thisa the day of December, 1384, by unanimous vote of the City Council, City of Plainview. \~ AP'P~.OV~D this the ~ day of D cenib 98 a
