CIV. STAT. ANN. art. 1011 and art. 1195 have been amended by the .Texas Legislature authorizing municipalities to assess a fine of u.p to One Thousand Dollars ($1,00C-.00) upon conviction of violating certain designated city ordinances; and Tnl~[EREAS, 'the City Council has detE:rmined that i t would be in the bey>t interest and to the benefit of the citizens of Plainview, Texas ~~that the penalty for violating said zoning code should be increased in accordance with said statute, NC)W, THEREFORE, BE IT ORDAINED BY 7'HE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS THAT SECTION 36 OF ORDINANCE N0. 82-2478 BE AMENDEL) AS FOLLOF.S Section 36 VIGLATIONS ARID PENALTIES Ardy person who shall violate any of the provisions of this Ordinance or who shall failt:o comply therewith or with any of the requirements thereof, or who shall erect ox- alter any building or who shal:L commence to erect or a]_ter any building in violation of any detailed statement of: plan submitted or approved thereunder, shall for each and every violation or noncompliance be deemed guilty of a misdemeanor and shall be fined not more than One Thousand Dollars ($1,000.00) and each day such violation shall be permitted to exist shall be construed to constitute a separate offense. The owners of that building or premises or part thereof where anything in violation of this Ordinance shall be placed or shall e~;ist, and any architect, builder, contractor, agent, or cc>rpo-ration employed in connection therewith who may have a:~sisted ire the commission of any such violation shall each be guilty of a separate offense and upon conviction shall be subject to the penalties herein provided. The necessity to amend Section 36 of Ordinance No. 82-2478 creates an emergency and it is an imperative public necessity that more than one reading thereof be, and the same is hereby suspended; this ordinance shall be passed and take effect as an emergency measure and shall be in full force and effect from and after its passage as provided by law, and it is so ordained. «~ PASSED this the ~ day of December, 1984, by unanimous vote of the City Council, City of Plainview.
