ORDINANCE N0. 84-2578
AN ORDINANCE AMENDING ORDINANCE NO. 82-2498, PROVIDING A
PENALTY FOR THE VIOLATION OF THE BUILDING CODE AND
PROVIDING FOR THE PASSAGE OF SUCH ORDINANCE AS AN EMER-
GENCY.
WHEREAS, VERNON'S TEX. CIV. STAT. ANN, art. 1011 and art. 1195
have been amended by the Texas Legislature authorizing
municipalities to assess a fine of up to Une Thousand Dollars
($1,000.00) upon conviction of violating certain designated city
ordinances; and
WHEREAS, the City Council has determined that it would be in
the best interest and to the benefit of the citizens of Plainview,
Texas that the penalty for violating said building code should be
increased in. accordance with said statute,
NOW, THEREFORE, 8E IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS THAT SECTION 3 OF ORDINANCE N0. 82-2498 BE
A1`~ENDED AS FOLLOWS :
SECTION 3: That Chapter 2, Section 205, of the "Uniform
Building Code", 1982 Edition, shall be and the same is
hereby amended by the addition thereto of a new paragraph
which shall read as follows:
"Any person, firm, or corporation violating any of the
provisions of this Code shall be deemed guilty of a
.misdemeanor, and each such person shall be deemed guilty
of a separate offense for each and every day or portion
thereof during which any violation of any of the
provisions of this Code is committed, cctinued, or
permitted, and pon conviction of any such violation such
person shall be punishable by a fine of not more than One
Thousand Dollars ($1,000.00).
The necessity to amend Section 3 of Ordinance No. 82-2498
creates an emergency and it is an imperative public necessity that
more than one reading thereof be, and the same is hereby suspended;
this ordinance shall be passed and take effect as an emergency
measure and shall be in full force and effect from and after its
passage as provided by law, and it is so ordained.
PASSED this the ~ day of December, 1984, by unanimous vote
of the City Council, City of Plainview.
