(Commercial Retail District) Zoning District for commercial uses, described as follows: BEGINNING at a 1/2 inch bolt set in the North line of Section fdo. 34, Block JK-2, and 21D feet 4dest of iron. stake at intersection of North line of said Section No. 34, with the Southwest right-of-way line of State Highway; THENCE South 246 feet to a 1 inch pipe; THENCE West 210 feet to a 3/4 inch pipe; THENCE North 246 feet. to a 1 1/4 inch pipe in north line of said Section No. 34; THENCE East 210 feet to the place of beginning, SAVE AND EXCEPT A TRACT OF LAND OUT OF THE NORTHEAST ONE-FOURTH (4JE/4) OF SECTION N0. THIRTY-FOUR (34), BJ.~OCK JK-2,HALE COUNTY, TEXAS, DESCRIBED BY METES ANQ BOUNDS AS FOLLOWS: BEGINNING at a point in the North line of Section No. 34, Block ~lK-2, Hale County, Texas, and 210 feet West of the intersection of the North line of Section No. 34 with the Southwest right-of-way line of State Highway and being the Northeast corner of a 1.186 acre tract ofland out of the Northeast Quarter of Section No. 34; THENCE South 236 feet along the East line of said 1.186 acre tract of land to a point in the North line of a dedicated alley; THENCE West 105 feet along the North line of said dedicated alley to a point; THENCE North 20° 19,4' East 86,38 feet to a point; THENCE North 155 feet to a point in the North line of Section No, 34; THENCE East 75 feet to the PLACE OF BEGINNING... ...and located at 2201 West 24th Street. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council, and after due consideration, the City Council of the City of Plainview finds that for the orderly growth of the Gaty making the proposed change as hereinafter set out will be in the'public interest which creates an emergency; and, WHEREAS, all conditions precedent required by iaw for a valid amendment to the Zoning Ordinance and ~~ap, have been fully complied with, as well as giving notices provided by Article 1011E Vernon's Annotated Civil Statutes-Amended, 1953, and notice was duly published in the Plainview Daily Herald more than fifteen (1.5) days prior to the date: of the Public Hearing according to said notice-was duly held in the City Council Room of the Caty Hall, Plainview, Texas, at which time persons appeared in support of the proposal:;-and .after said hearing, it vas by the Caty Cauncil determined that at would be in the public interest due to changed conditions,. that the Zoning Ordinance and the Zonng`Map be amended in the manner hereinafter set forth in the body of this Ordinance; NOW, THEREFORE: BE IT ORDAINED BY THE CITY-COUNCIL OF THE CITY OF PLAINVIEW: SECTION 1. That Ordinance No. 82-24.78 and the Off vial Zoning Map be and the same are hereby amended as follows, to-wit: ZONE CASE N0. 510: Change a 1.186 acre tract of land being described as follows: BEGINNING at a 1/2 inch bolt set an the North line of Section No. 34, Block JK-2, and 210 feet West of iron stake at intersection of North line of said Section No. 34, with the Southwest right-of-way lane of State Highway; THENCE South 246 feet to a 1 inch. pipe; THENCE. West 210 .feet to a 3/4 inch pipe; THENCE N®rth 246 feet to a 1 1/4 inch pipe an north-line of said Section No. 34; THENCE East 2l0 feet to the place of beginning. City of Plainview, Hale County, Texas, from an R-1 (Single-Family Residential) Zoning District to a C.R.D. (Commercial Retail District) Zoning District. From the date of this Ordinance, said lot, tract and parcel of land described shall be and hereby be changed to the :Zoning District indicated and the official ~1ap is amended in accordance herewith. SECTION 2. Upon passage of this Ordinance on first reading, the City Secretary be and is hereby authorized and directed to cause to have published in the Plainview Daily Herald, a daily newspaper of general circulation in the City of Plainview, Texas, a notice that a public hearing shall beheld in the Coancil Chamber of the .City Hall in Plainview, Texas, at 7:30 o'clock P.M., on the 9th day of July, 1985, to permit the public to be heard prior to consideration of this Ordinance for'second and final reading, said publication to be made more than fifteen (15) days prior to the time designated for such public hearing. A notice of time and. place where and when said Ordinance would be given a public hearing and considered for final passage was published in the Plainview Daily Herald,. a daily newspaper of genreal circulation in the City of Plainview, Texas, said publication being on the day of 1985 the same being more than fifteen (15) days prior to the time designated for said hearing.
