AN ORDINANCE AMENDING ZONING ORDINANCE N0. 82-2478 AND THE. OFFICIAL ZONING
MAP OF.THE CITY OF PLAINVIEW, SO AS TO MAKE THE FOLLOtiYING CHANGES:
ZONE CASE NO. 525:
Request of Rex Ramsower for rezoning two (2) tracts of land totaling
4.848 acres from MF-2 (Multiple-Family Residential) and R-1 (Single-
Family Residential) Zoning District to C.R.D. (Commercial Retail .District)
Zoning District for commercial uses and described as follows:
Tract 3: From R-1 to C.R.D. Zone:
Being a 0.22'acre tract (9,562 square feet) out of the southeast
part of Survey No 27, Block JK-2, Hale County, Texas:
COMMENCIT~G at the southeast corner of Survey. No. 27, Block JK-2,
Hale County, Texas;
Thence. 5.89°16'40"~~V. I,970.03 feet along the south line of said
survey to the southwest corner of Brock Addition, Unit. No. 10 as recorded
in Volume 553, page 237 of the Hale County Deed Records.;
Thence North, ,188.21 feet along the west line of said addition to
thE: northeast corder of a tract previously zoned fi2F-2 for the POINT OF
BEGINNING of the herein described tract;
Thence 5.45°yl. 28.28 feet along the north line of said MF-2 tract
to a point;
Thence West 285.6 feet continuing along the north line of said P~-2
tract to a point in the. east right of way Iine of .Interstate Highway No.
27;
Thence N.0°09'E. 31.95 feet along tie east right of way line of
said highway to a',l/2 inch steel rod'set for the southwest corner of the
Smith 0.596 acre tract as recorded in Volwne 709, Page 367 of the Hale
County Deed Records;
Thence East. X05.51 feet to a 1/2 inch steel rod set for the southeast
corner of said Smith tract;
Thence South'~,11.95 feet along the west line of said addition to the
POINT OF BEGINNING and containing 0.22 acres.
Tract 4: From MF=2 to C.iR.D. Zone:
Being a 4.628 acre. tract (201,622 square feet) out of the southeast
part of Survey No 27, Black JK-2, Hale County, Texas:
COMMENCING at the southeast corner of Survey No. 27, Block JK-2,
Hale County, Texas;
Thence 5.89°~6'40'°W. 1,970.03 feet along the south line of said
survey to the southwest corner of Brock Addition, Unit No. 1'0 as recorded
in Volume 553, page 237 of Hale County Deed Records;
Thence NorthI510.95 feet. along the west line. of said addition to a
1/2 inch steel rod set for the northeast corner of the Ragland 0..706
acre tract as recorded in Volinne 670, page 347 of the Hale County Deed
Records for the POINT QF BEGINNING of the herein described tract;
Thence North 677.26 feet continuing along the west line of said
addition to the northeast corner of a tract previously zoned MF-2;
Thence 5.45°W. 28.28 feet along the north line of said MF-2 tract
to a point;
Thence West 285.6 feet continuing .along the north line of said MF-2
tract to a point in the east right of way line of Interstate Highway No.
27;
Thence S.0°09~W. 657.26 feet along the. east right of way line of
said highway to a 1/2 inch steel rod set for the northwest corner of
said Ragland tract;
Thence. East 307.32 feet along the north line of said Ragland tract
to the POINT OF BEGINNING and containing 4.628 acres.

CITY OF PLAINVIEW, HALE COUNTX, TEXAS, FROM R-1 and a MF-2 to a C.R.D.
ZONING DISTRICT.
WHEREAS, the proposed change in Zoning Districts as hereinafter made has
been duly presented to the Planning and Zoning Commission for its recommenda-
tion which was received. by the City Council, and after due consideration, the
City Council of the City of Plainview finds that for the orderly growth of
the City making the proposed change as hereinafter set out will be in the
public interest which creates an emergency; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map, have been fully complied with,. as well as
.giving notices provided. by Article 1D11F Vernon's Annotated Civil Statutes-
Amended, 1953, and notice was duly published in the Plainview Daily Herald
more than fifteen (15) days prior to the date of the Public Hearing according
to said notice was duly held in the City Council Room. of the. City Hall,
Plainview, Texas, at which time persons appeared in support of the proposal;
and after said hearing, it was by the City Council-determined that it would
be in the public interest due to changed conditions, that the Zoning
Ordinance. and the Zoning Map be amended in the manner hereinafter set .forth
in the body of this Ordinance; NOW THEREFORE;
BE IT ORDAINEA BY THE CITY. COUNCIL OF THE CITY OF PLAINVIEW:
SECTION 1 That, Ordinance No. 82-2478 and .the Official Zoning Dap be and the
same are hereby amended as .follows,. to-wit:
Tract 3: From R-1 to C.R.D. Zone:
Being a 0.22 acre tract (9,562 square feet) out of the southeast
part of Survey No. 27, Block JK-Z, Hale County, Texas:
CONNIENCING at the southeast corner of Survey No. 27, Block JK-2,
Hale County, Texas;
Thence S.89°16'40"W. 1,970.03 feet along the south line of said
survey to the southwest corner of Brock Addition, Unit No. 10 as recorded
in Volume 553, page 237 of the Hale County Deed Records;
Thence North 1,188,21 feet along the west line of said addition to
the northeast corner of a tract previously zoned MF-2 for the POINT OF
BEGINNING of the herein described tract;
Thence S.45°W. 28.28 feet along the north line of said MF-2 tract
to a point;
Thence West 285.6 feet continuing along the north line of said MF-2
tract to a point in the east right of way line of Interstate Highway No.
27;
Thence N.0°09'E. 31,95 feet along the east right of way line. of

Being a 4.628 acre tract (201,622 square feet) out of the southeast
part of Survey No. 27, Block JK-2, Hale County, Texas:
COMMENCING at the southeast corner of Survey No. 27, Block JK-2,
Hale County, Texas.;
Thence S.89°16'40"W. 1,970.03 feet along the south line of said
survey to the southwest corner of Brock Addition, Unit No. l0 as recorded
in Volume 553, page 237 of Hale County. Deed Records;
Thence North 510.95 feet along. the west line of said addition to a
1/2 inch steel rod set for the northeast corner of the Ragland 0.706.
acre tract as recorded in Volume 670, page 34 T of the Hale County Deed
Records for the POINT C1F BEGINNING of the herein described tract;
Thence North 677.26 feet continuing along the west line of said
addition to the northeast corner of a tract previously zoned MF-2;
Thence S.45°W, 28.28 feet along the north line of said MF-2 tract
to apoint;
Thence West 285.6 feet continuing along the north line of said MF-2
tract to a point in the east right of way Line of Interstate Highway No.
27;

City of Plainview, Hale County, Texas, from an R-1 and P~IF-Z to an C.R.D.
.Zoning District. From the date of this Ordinance, said lot, tract and parcel
of land described shall be and hereby be changed to the Zoning District
indicated and the official Map is amended in accordance herewith.
SECTION 2. Upon passage of this Ordinance on first reading, the City Secretary
be and is hereby authorized and directed to cuase to have published in the
Plainview Daily Herald, a daily newspaper of general circulation in the City
of Plainview, Texas, 'a notice that a public hearing shall be held in the Council
Chamber of the City Hall in Plainview, Texas, at 7:30 o'clock P.M., on the
10th day of November, ;1985, to permit the public to be heard prior to consideration
of .this Ordinance for second and final reading,. said publication to be made more
than fifteen (15) days prior to the time designated for such public hearing.
PASSED on first reading .this, the 12th da.y of November 1985.
A notice of time and place where and when said Ordinance would be given a public
hearing and considered for final passage was published in the Plainview Daily
Herald, a daily newspaper of general circulation in ..the City of Plainview, Texas,
said.publcaton being on..the.a Oth day of November,n.1985 the same
being more than fifteen (15) days prior to the time designated for said hearing.
After such opportunity for .the public to be heard, said Drdiriance was passed
bn second and final reading.
PASSED on second and final reading this, the 10th day of Decembex,
1985.
