ORDINANCE NO. 86-2650
AN ORDINANCE OF THE CITY OF PLAINVIEW REGULATING AND CONTROLLING
THE MAINTENANCE OF BUILDINGS AND PREMISES; TO SAFEGUARD LIFE, HEALTH,
PROPERTY AND PUBLIC WELFARE BY REGULATING THE STORAGE, USE AND
HANDLING OF DANGEROUS AND HAZARDOUS MATERIALS, SUBSTANCES AND
PROCESSES, AND BY REGULATING .THE MAINTENANCE OF ADEQUATE EGRESS
FACILITIES, PROVIDING FOR THE REPEALING OF ORDINANCE NO. 82-2497 OF
~j THE CITY OF .PLAINVIEW, PROVIDING FOR ADOPTION OF THE UNIFORM FIRE
CODE, 1985' EDITIONS AS COPYRIGHTED IN 1985; THE INTERNATIONAL
CONFEI,RENCE OF BUILDING OFFICIALS OF WHITTIER, CALIFORNIA, PROVIDING
FOR CERTAIN AMENDMENTS THERETO; PROVIDING PENALTIES FOR THE VIOLATION
THEREOF; PROVIDING A SEVERABLILITY CLAUSE; DIRECTING PUBLICATION OF
THE DESCRIPTIVE CAPTION OF THIS ORDINANCE, TOGETHER. WITH THE PENALTY
PROVISIONS, AND PROVIDING AN EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS., the City Council of the City of Plainview finds that the
present Fire Code of the City of Plainview is inadequate to properly
protect the public health, safety, and welfare of the citizens of the
City of Plainview and their property, from loss due to fire, and
WHEREAS,. the City Council appointed the. Fire Code Board of;:;`~`
Appeals to .prepare recommendations for the City Council in regard to a
new Fire Code; and
WHEREAS, the Fire. Code Board of Appeals recommends the Uniform
Fire Code, 1.985 Edition, with certain amendments thereto, be adopted
as the Fire Code of the City of Plainview; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS:
SECTION 1. That the 1982 Edition of the Uniform Fire Code, as
copyrighted in 1982 by the International Conference of
Building Officials of Whittier, California (being
Ordinance No. 82-2497 of the City of Plainview) be and
the same is hereby repealed..
SECTION 2. That the 1985 Edition of the. Uniform Fire Code, as
copyrighted in 1985 by the International Conference of
Building Officials of Whittier, California, as
hereinafter amended is .specifically adopted as the Fire
Cade of the City of Plainview, Texas, and a copy is
attached hereto and incorporated herein by reference as
though set out completely in detail. A copy of said
Uniform Fire Code shall be filed with the City
Secretary and a copy maintained in the office of the
Fire Marshal of the City of Plainview, Texas. All
such copies to be ,open to public inspection during
business hours of the office where they are maintained,

with the following amendments thereto:
SECTION 3. That Part I, Article 2, Division III, Section 2.303(b)
of the Uniform Fire Code® 1985 Edition, shall be and
the same is hereby amended by addition to the list of
recognized Standards as part of the list, the 1985
Edition of the "Life Safety Code", N.F.P.A. I01 as
copyrighted in 1985.
SECTION 4. That Part I, Article 4, Section 4.101 of the Uniform
Fire Code,' 1985 Edition, shall be and the same is
hereby ameded by deleting requirements for permits. No
permit shall be requred when referred to in the code.
SECTION 5. That Part II, Article 9, Section 9.123 of the Uniform
Fire Code, 1985 Edition, shall be and the same is
hereby amended to read as follows: When reference is
made to the Uniform Mechanical Code, it shall be
deleted.
SECTION 6. That Part I, Article 2, Division I of the Uniform Fire
Code, 1985 Edition, is hereby amended by adding .thereto
a section to be known as Section 2.110 which said
section shall read as follows:
That the entire incorporated area. of the City of
Plainview is hereby declared to be and is hereby
established as a fire district, and said fire district
shall be known and designated as Fire Zone 1, 2, and 3,
and each such zone shall include such territory and
portions of the City of Plainview as follows:
Zone l shall include the territory as set out and
described by metes and bounds as Zone l under Chapter
9, Article 1, Section 9.I(a) of the Municipal Code of
the City of Plainview, as adopted 1978.
Zone 2 shall include the territory as set out and
described by .metes and bounds as Zone 2 under Chapter
9, Article 1, Section 9.1(b) of the Municipal Code,
City of Plainview, adopted 1978. It shall also include
all commercial property and buildings now existing, and
all property that may be zoned for commercial use.
Zone 3 shall include all. the area not set out in Zone 1
and Zone 2.
SECTION 7. That Part VII, Article 79, Division V, Section 79.501,
of the Uniform Fire Code, 1985 Edition, shall be and
the same is hereby amended to read as follows: The
limits in which storage of flammable liquids in outside
above ground tanks is prohibited are hereby established
as follows:

A. The. limits, in which storage of Class I and Class
II Liquids in outside above ground tanks is
prohibited in any residential district, as set out
by the. Zoning Ordinance of the City of Plainview,
as amended.
B. The limits in which new bulk plants for Class I
.and Class II Liquids are prohibited are those
Zones in the City of Plainview where such bulk
plants are not permited by the Zoning Ordinance of
the City of Plainview, as amended.
SECTION 8. PENALTIES:
Any person, firm, or corporation violating any of the
provisions of this Code shall be deemed guilty of a
misdemeanor, and each suc h person shall be deemed
guilty of a separate offense for each and every day or
portion thereof during which any violation of any of
the provisions of this Code is committed, combined, or
permitted, and upon the conviction of any such
violation such person shall be punishable by a fine of
not more than One Thousand Dollars ($1,000).
SECTION 9. SEVERABILITY CLAUSE:
If any provisions of this Ordinance or of the Code
hereby adopted or the application thereof to any person
or circumstance is held invalid, the remainder of the
Code and the application of such provisions to other.
persons or circumstances, shall not. be affected hereby.
SECTION 10. The City Secretary is hereby authorized and directed to
cause the publication of the descriptive Caption of
this Ordinance together with the penalty provisions as
provided herein. This Ordinance shall become effective
after its passage and publication as required by law.
