MINUTES
7/27/2017
The Zoning Board of Adjustment held a special public hearing on Thursday, July 20, 2017 at
6:00 p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway,
Plainview, Texas, with the following members present:

STAFF MEMBERS PRESENT: Nick Mogg, Code Enforcement, Judy Rasher, Community
Service Secretary.
Mark Hardin opened the meeting at 6:17 pm, established a quorum and conducted the
consideration of the following items in the order presented. Nick Mogg read the staff reports,
and gave the recommendations for each item.
FIRST ITEM ON THE AGENDA: Approval of July 20, 2017 minutes.
Danny Murphree made a motion to approve minutes of July 20, 2017 as presented. Nicole
Ramirez seconded the motion. Motion carried unanimously.
SECOND ITEM ON THE AGENDA:
ZBA -17 -14 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 15 E58' -11 Unit 3 of the
Thunderbird Addition, Plainview, Texas, Hale County, also known as 1120 W 31 th Street
Applicant is requesting a variance to construct a 22 x 22 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 22 feet into the required front
yard setback of 25 feet. If approved, this would result in the front edge of the carport being 18
feet from the back of the curb. Staff observed several carports within a two block radius. This
particular neighborhood is one where half of the homes are constructed with single car garage,
the applicant being one. Notices have been sent to property owners within 200 feet or
applicant. Staff have not received any comments of the request. Staff recommends approval
as presented. Joe Frank Rodriguez made a motion to approve the variance based on the
request. Danny Murphree seconded and the motion was carried unanimously.

THIRD ITEM ON THE AGENDA:
ZBA -17 -15 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 69 Lot 14 of the College Hill
Addition, Plainview, Texas, Hale County, also known as 612 Xenia Street.
Applicant is requesting a variance to construct a 20 x 20 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 27 feet into the required front
yard setback of 30 feet. If approved, this would result in the front edge of the carport being 25
feet from the back of the curb. Staff observed four carports within a two block radius. Majority
of the carports can be found to the south on the same block. This particular neighborhood is
one where a majority of the homes were constructed with single car garages. The applicant's
home has a single car garage. Applicant owns two vehicles. Notices have been sent to
property owners within 200 feet or applicant. Staff have not received any comments. Staff
recommends approval as presented. Nicole Ramirez made a motion to approve the variance
based on the request. Mark Hardin seconded and the motion was carried unanimously.
FOURTH ITEM ON THE AGENDA:
ZBA -17 -16 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 38 Lot 4 of the Highland
Addition, Plainview, Texas, Hale County, also known as 1209 Lexington Street.
Applicant is requesting a variance to construct a 20 x 17 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 24 feet into the required
minimum front yard setback. If approved, this would result in the front edge of the carport being
23 feet from the back of the curb. Staff observed six carports within a two block radius. This
particular neighborhood is one where the homes were not built with garages. The applicant's
home has a single car garage. Applicant owns two vehicles. Notices have been sent to
property owners within 200 feet or applicant. Staff have not received any comments. Staff
recommends approval as presented. Danny Murphree made a motion to approve the variance
based on the request. Joe Frank Rodriguez seconded and the motion was carried
unanimously.
FIFTH ITEM ON THE AGENDA:
ZBA -17 -17 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 2 Lot 4 of the Titus Addition,
Plainview, Texas, Hale County, also known as 706 W 26th Street.
Applicant is requesting a variance to construct a 13 x 24 metal frame carport in the front yard
setback. Because of the 5 ft off -set in the house design, the proposed carport would encroach
approximately 19 feet into the required front yard setback of 25 feet. If approved, this would
result in the front edge of the carport being 26 feet from the back of the curb. Staff observed
five carports within a two block radius. This particular neighborhood is one where the homes
were not built with garages. This applicant does have an existing two car carport on the lot east
of the home. Applicant owns three vehicles. Notices have been sent to property owners within
200 feet or applicant. Staff have not received any comments. Danny Murphree made a motion

to approve the variance based on the request. Nicole Ramirez seconded and the motion was
carried unanimously.
SIXTH ITEM ON THE AGENDA:
ZBA -17 -18 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 1 Lot 13 of the Hilltop Addition,
Plainview, Texas, Hale County, also known as 401 Ennis Street.
Request has been withdrawn due to the fact the applicant has moved the proposed carport
location in a manner that complies with the required setback.
SEVENTH ITEM ON THE AGENDA:
ZBA -17 -19 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoninq Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 7 Lot 14 Unit 1 of the
Thunderbird Addition, Plainview, Texas, Hale County, also known as 2604 Lexington Street.
Applicant is requesting a variance to construct a 13 x 24 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 24 feet into the required front
yard setback of 25 feet. If approved, this would result in the front edge of the carport being 16
feet from the back of the curb. Staff observed six carports within a two block radius. This
particular neighborhood is one where half of the homes were building with single car garages.
The applicant's home has a single car garage. Applicant owns two vehicles. Notices have
been sent to property owners within 200 feet or applicant. Staff have not received any

EIGHTH ITEM ON THE AGENDA:
ZBA -17 -20 Consider the request of a special exception of the minimum front set back
authorizing the construction of a Carport under the City of Plainview Zoninq Ordinance Section
37.2.2(H) Special Exceptions. The location described as Block 11 S29' -3 N56' -4 Unit 2 of the
Brock Addition, Plainview, Texas, Hale County, also known as 1309 Garland Street.
Applicant is requesting a variance to construct a 20 x 20 metal frame carport in the front yard
setback. The proposed carport would encroach approximately 20 feet into the required front
yard setback of 30 feet. If approved, this would result in the front edge of the carport being 29
feet from the back of the curb. Staff observed three carports within a two block radius. Many of
the homes in the neighborhood were built with two car garages. The applicant's home has a
two car garage. Notices have been sent to property owners within 200 feet or applicant. Staff
received two letters in favor and three letters in opposition to the request. Nicole Ramirez made
a motion to approve the variance based on the request. Hardin seconded and the motion was
carried unanimously
