The Plainview City Council met on March 8, 2005 at 7:00 p.m. in the City Council
Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting
was posted in City Hall at 4:15 p.m. on March 4, 2005. Mayor John C. Anderson
presided. Councilmembers present were: Kelvin Tipton-District 1, Mary Jane Shanes-
District 2, Belinda Pena-District 3, John N. Bertsch, District 4, Wendell Dunlap-District 6
and Roland Nash-District 7. Councilmember Ron Trusler-District 5 was absent.
Staff members present were: Greg Ingham-City Manager, John Castro-Director of
Community Services, Brice Clements-Engineer, Dale Simpson-Director of Civil Service,
Gary Glass-Fire Chief, Will Mull-Police Chief, Dennis Harkins-Police Captain and
Belinda Hinojosa-City Secretary

Guests present were: James Wadel, Alexis Salas and AnaElyssa Quintanilla
Councilmember Wendell Dunlap delivered the invocation.
Alexis Salas and AnaElyssa Quintanilla of Girl Scout Troop 616 led in the Pledge
of Allegiance.
Councilmember Tipton moved to adopt the consent calendar. The motion was duly
seconded by Counciimember Shanes and carried by unanimous vote. Items approved
on the consent calendar included approval ~of the minutes of February 22, 2005 and
March 3, 2005; and granting an excused absence to Councilmember Ron Trusler.
The Council approved the reappointment of Belinda Pena to the Board of Health with
said term to expire on January 1, 2007. The Council approved the appointment of Rita
Robertson to the Board of Health to fill the unexpired term vacated by Sally Meeks
with said term to expire January 1, 2006.
Mayor Anderson presented for consideration Ordinance No. 05-3442, an Ordinance
Amending the Zoning Map of the City of Plainview, Texas For Rezoning From Light
Manufacturing (M-l), to Commercial General Business (C-3) Zoning District Said Parcel
Being Lot 2G, Kruse Subdivision, Same Being 2417 N Columbia Street, City Of
Plainview, Hale County, Texas; Cumulativeness Clause; Conflicts Clause; Severability
Clause; and Effective Date. Since this was the second of two readings, the Council chose
to forego the staff briefing and went straight to public comment. There was no public
comment.
Councilmember Bertsch moved to approve Ordinance No.05-3442 upon second reading.
The motion was duly seconded by Councilmember Pena and carried by unanimous vote.
Brice Clements presented for consideration the award of bids on the rock and asphalt.
One bid was received on the rock from Capital Aggregate Ltd of Midland, Texas for 3,400
tons of crushed rock. They bid a unit price of $31.70 per ton for a total of $107,780.00.
One bid was also received on the asphalt from Valero Marking & Supply Co. of San
Antonio, Texas in the amount of $.90 per gallon for a total of $72,000.00. These bids
came in a little higher than anticipated. If the City purchases the total amount, we may be
slightly over budget. However we do have the option to purchase 20% less without

penalty based on the contracts as they were bid. Therefore, staff recommends that both
bids be accepted.
Councilmember Dunlap moved to award these bids based on information received from
Mr. Clements. Mayor Anderson cladfied the motion to state that we accept the bids on
both the rock and asphalt as presented here to purchase all of the asphalt and all of the
rock with the understanding 'that we can move either up or down through change orders.
The motion was duly seconded by Councilmember Nash and carried by unanimous vote.
Police Chief Will Mull and Captain Dennis Harkins presented the 2004 Racial Profiling
Report.
Item No. 8, the closed meeting regarding the City Attorney and Item No. 9 regarding action
on City Attorney position were removed from the agenda since there was nothing further to
report.
Mayor Anderson moved to adjourn the meeting. The motion was duly seconded by
Councilmember Tipton and carried by unanimous vote.
There being no further business, Mayor Anderson adjourned the meeting at 7:22 p.m.
