RESOLUTION R17-400
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, APPROVING THE REQUEST OF PLAINVIEW FALL FESTIVAL
5K DIRECTOR TO HOST THE PLAINVIEW FALL FESTIVAL 5K RUN;
AUTHORIZING THE FILING OF THE AGREEMENT FOR THE
TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR THIS EVENT; DECLARING
THAT THE EVENT SERVES A PUBLIC PURPOSE; AND AGREEING
TO COMPLY WITH REGULATIONS.
WHEREAS, the Texas Department of Transportation owns and operates Business
27 (Columbia) and Hwy 70 in the corporate limits of the City of Plainview; and
WHEREAS, the City of Plainview received a request from the Plainview Fall
Festival 5K Run committee for police assistance in its Run; and
WHEREAS, the Plainview Fall Festival 5K run will include a Run from 7TH Street
and Broadway down 7th Street and cross Bus. 27 (Columbia) then proceed until it crosses
Hwy 70 at Joliet it will then continue crossing Bus. 27 at or about S.W. 1st continuing until
it reaches Hwy 70 at Baltimore where it will cross Hwy 70 a second time and return to 7th
and Broadway. The Run will start at 9:00A.M. on October 7th 2017 and
WHEREAS, the City Council of the City of Plainview finds that such event serves
a public purpose in that it increases the public awareness in the importance of our history;
and
WHEREAS, the City Council of the City of Plainview, Texas finds it in the best
interest for the citizens of Plainview that the Plainview Fall Festival 5K Run be held this
year on October, 7st 2017 and use the above referenced routes; and
WHEREAS, the Texas Department of Transportation requires the Local
Government to submit a completed Agreement for the Temporary Closure of State Right -
of -Way for use of Bus. 27 Columbia at 7th Street and Hwy 70 at Joliet and Hwy 70 at
Baltimore in such public events as this 5K Run; and
WHEREAS, the City Council designates Mayor Wendell Dunlap as the City's
authorized official. The authorized official is given the power to apply for or terminate such
Agreement on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Plainview that:
The request from the 2017 Plainview Fall Festival Committee for their Run is
hereby approved.

The public purpose of this event is to increase the public awareness in the
importance of our cultural heritage and fitness.
Submission of the completed AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT-OF-WAY with the Texas Department of Transportation is hereby
approved.
IV.
The Mayor is hereby authorized and directed to execute, respectively, on behalf
of the City of Plainview, all necessary documents, including the AGREEMENT FOR
THE TEMPORARY CLOSURE OF STATE RIGHT-OF-WAY to complete the preparation
process for the Plainview Fall Festival 5K run.
