HomeMy WebLinkAbout08.03.2017 MINUTES PLANNING & ZONING MINUTES August 3, 2017 The Planning & Zoning Board held a public hearing on Thursday, March 30, 2017 at 6:00 p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway, Plainview, Texas, with the following members present: VOTING PRESENT NO. Cris Valverde read the staff reports, and gave the recommendations for each item. ITEM NO. 1 Approval of March 30, 2017 Planning and Zoning minutes. Chris LeFevre made a motion for approval. Mark Hardin seconded and motion carried unanimously. ITEM NO. 2 Case File No. 869N -17 -02 Vacation of a 20 ft alley adjacent to Lots 1 thru 12, Block 53, Original Town Addition, Section 2, Block ML, El Lowe Survey, Plainview, Texas, Hale County APPLICANT: Darren Sowell VICINITY: W 5 St and Columbia Cris Valverde presented this case for a request to vacate an existing 20 foot alley right - of -way adjacent to lots 1 thru 12, Block 53, Original Town Addition, Section 2, Block ML, El Lowe Survey, Hale County. The applicant owns the land adjacent to the alley and plans to develop the entire block with a covenant store and gas station. The applicant is requesting abandonment. City departments and local utility companies have reviewed this vacation request. Relation of the existing utility equipment will be required and any costs associated with the relocation of the utilities are to be the responsibility of the applicant. Staff advised the applicant of this requirement and the applicant understands the costs associated with the relocation and will be the responsibility of the applicant. The relocation of existing water and sewer mains in the alley is not necessary. The current configuration of the water and sewer mains adjacent to the block allowing the existing mains to be abandoned in place. Abandoning the existing water and sewer mains will not affect existing service in the area. The applicant is required to either pay the fair market value to acquire the alleyway, dedicate an area of equal or greater value, pay only the higher cost of the fair market value of the relocation cost. The relocation costs of $45,000 will exceed the estimated Fair Market Value of $12,539 of the alley right -of- way. As a result, no fair market value payment will be required. Notices were sent to property owners within 200 feet of the proposed vacation. Staff received one comment regarding the request. The area property owner stated they had no issue with the proposed vacation. Given the fact that the unimproved alley will no longer be needed for public purpose, Staff is of the opinion that the request is appropriate. Staff recommends approval as presented. Mark Hardin made a motion to open the public hearing. Rick Burke seconded and motion carried unanimously. No response was made. Paul Drager asked if anyone would like to speak in opposition or in favor. Contractor /Builder, Johnny Vickey came forward. Mr. Vickey will be the contractor who will oversee the Allsup project in Plainview. The project will take approximately 6 -8 months, depending on the relocation of the utilities and weather permitting. Chris LeFevre made a motion to close the public hearing. Seconded by Rick Burke and motion carried unanimously. Danny Murphree made a motion to approve Case No. 869N- 17 -02. Seconded by Mark Hardin. Motion carried unanimously. ITEM 3: Case File No. 870/P -17 -04 Original Town of Plainview, Unit No 3, being a replat of Lots 1 thru 12, Block 53,. Original Town Addition, Section 2, Block ML, El Lowe Survey, Plainview, Texas, Hale County DEVELOPER/S: Mark Allsup VICINITY: W 5 St and Columbia Cris Valverde presented this case for a replat associated with the previously vacated alley. This plat is not ready for consideration. It is an administrative plat where the City Manager can sign off. State law requires that we act upon the plat within a certain amount of time. Staff recommends that this case be denied with the stipulation that it be resubmitted at a later date when it is ready for approval by the City Manager. Mark Hardin made a motion to open the public hearing. Danny Murphree seconded and motion carried unanimously. Paul Drager asked if anyone would like to speak in opposition or in favor. No response was made. Danny Murphree made a motion to close the public hearing. Seconded by Mark Hardin. Chris LeFevre made a motion to deny Case File No. 870/P -17 -04 until plat can be finalized and signed off by the city manager. Mark Hardin seconded. Motion carried unanimously. ITEM 4: Case File No. 871/Z -17 -01 Rezoning of Lots 11 thru 16, Block 94, College Hill Addition, Section 40, Block JK2, CG &SFRR Survey, Plainview, Texas, Hale County, to change from Single Family Residential District 2 to Multi - family Residential District 1 and Specific Use Permit for a Bed and Breakfast with outdoor events. APPLICANT: Mike Melcher VICINITY: W 6 St and Milwaukee St Cris Valverde presented this case for a rezoning of Lots 11 thru 16, Block 94 of the College Hill Addition, Section 40, to change from a single family residential district 2 to multi - family residential district 1 and specific use permit for a bed and breakfast. Applicant is under contract to purchase the two story, four bedroom home and plans to operate a bed and breakfast in the home with occasional outdoor events. Two zoning classifications are being requested. The first being MF1 and the second being and SUP for a bed and breakfast with outdoor activities. MF1 is required to be in place so that an SUP can be considered and is the purpose for the two part zoning request. Staff believes that certain development standards can be put in place to help minimize any potential negative impacts on the area residences. Notices have been sent to property owners within 200 feet of the proposed rezoning. Staff received four comments in favor of the request. Staff has not received any calls in opposition to the request. Staff recommends approval as presented. Mark Hardin made a motion to open the public hearing. Janice Payne seconded and motion carried unanimously. Paul Drager asked if anyone would like to speak in opposition or in favor. Mike Melcher came forward. Mr. Melcher wanted to thank Mr. Valverde for the work he has done in providing the information to the board for consideration. Mark Hardin made a motion to close the public hearing. Seconded by Janice Payne. Chris LaFevre made a motion to approve case file no. 871/ZS -17 -01 as presented. Seconded by Janice Payne. Motion carried unanimously. • ITEM NO. 5 Case File No. 865/P -16 -03 Final Plat of Hitchin Post, Lot 1, a Suburban Subdivision to the City of Plainview, being an unplatted tract of land in Section 37, Block JK2, Hale County, Plainview Texas (33.175 acres) (Vicinity: Industrial Blvd and Interstate Highway 27 DEVELOPER(S): John and Page Watkins SURVEYOR: Norris Stevens No action taken. ITEM NO. 6 Case File No. 861/P -16 -02 Plainview Vision Unit No. 1, a suburban subdivision and an addition to the City of Plainview, being an unplatted tract of land in Section 37, Block JK -2, Hale County, Texas. (20.61 acres)(Vicinity: Industrial Blvd. and Interstate Highway 27 DEVELOPER(S): Teressa King SURVEYOR: Norris Stevens No action taken. ITEM NO. 7 Case File No. 866/P -17 -01 College Hill Addition Unit No. 3 an addition to the City of Plainview, being a replat of a portion of Lots C and D, Block 88, College Hill Addition, in Section 33, Block JK2, Hale County, Plainview, Texas (1.07 acres) (Vicinity: Ennis Street and 7 Street) DEVELOPER(S): Plains Land Bank, FLCA SURVEYOR: Carl Joe Williams No action taken. ITEM NO. 8 Case File No. 867/P -17 -02 Wilcox Addition Unit No. 2 an addition to the City of Plainview, being an unplatted tract of land in Section 28, Block JK2, Hale County, Plainview, Texas (6.16 acres) (Vicinity: Ennis Street and 10 Street) DEVELOPER(S): City of Plainview SURVEYOR: Robert Keys No action taken.
