HomeMy WebLinkAboutCouncil Minutes 06-27-2017134 The Plainview City Council met on June 27, 2017 at 7:00 p.m. in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 4:45 p.m. on June 23, 2017. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5 and John Gatica-District 6. Councilmember Oliver Aldape-District 7 was absent. Staff members present were: Jeffrey Snyder, City Manager, Leslie Schmidt -City Attorney, Tim Crosswhite-Director of Public Works, Sarianne Beversdorf-Director of Finance, Ken Coughlin -Police Chief, Rusty Powers -Fire Chief, lsauro Gutierrez -Information Technology Manager, and Belinda Hinojosa-City Secretary. News Media Present: Doug McDonough -Plainview Herald Guests Present were: Katherine Egger, Steve Schmidt, Ruddy Owen, Kelvin Tipton, M. Kindinger Councilmember Larry Williams delivered the invocation and led in the pledge of allegiance. Mayor Dunlap recognized Leslie Schmidt for her years of service to the City of Plainview. Councilmember Larry Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Items approved on the consent calendar included approval of the minutes of May 18, 2017 and May 23, 2017; approval of the Financial Reports; approval of Resolution R17-390, a Resolution of the City Council of the City of Plainview, Texas, Approving the Request of Plainview Rodeo Association to Host the Plainview Rodeo Association Parade; Authorizing the Filing of the Agreement for the Temporary Closure of State Right -Of -Way with the Texas Department of Transportation for this Event; Declaring that the Event Serves a Public Purpose; and Agreeing to Comply with Regulations; and approval of Resolution R17-392, a Resolution of the City Council of the City of Plainview, Texas, Approving the Request From the Hale on Wheels Director to Host the Hale on Wheels Cycling Event; Authorizing the Filing of the Agreement for the Temporary Closure of State Right -Of -Way with the Texas Department of Transportation for this Event; Declaring that the Event Serves a Public Purpose; and Agreeing to Comply with Regulations. Cris Valverde, Community Development Manager presented for consideration on first reading Ordinance No. 17-3658, an Ordinance of the City Council for the City of Plainview, Texas, Creating Chapter 3, Article 3.15, Swimming Pools and Spas to Adopt the International Swimming Pool and Spa Code (2015 Edition); Amending Chapter 6, Article 6.04 to the City of Plainview Code of Ordinances; Repealer; Cumulativeness Clause; Severability Clause; Conflicts Clause; and Effective Date. This Ordinance would adopt the 2015 Edition of the International Swimming Pool and Spa Code. Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro Tem Starnes moved to adopt Ordinance 17-3658 on first reading. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. City Council Minutes June 27, 2017 Page 1 of 3 Leslie Schmidt, City Attorney presented for consideration Resolution R17-391, a Resolution of the City Council of the City of Plainview, Texas Assigning and Modifying a Lease for the Real Property at AB 500 Blk JK -2, N40 100x140 Corner Lot, Same Being 501 Denver, Plainview, Texas; Authorizing the Mayor to Sign Said Lease; and Declaring that the Policy Serves A Public Purpose. This assigns the McGavock Lease to JKT, LLC - Series One, a limited liability company. It is similar to the McGavock Lease with one basic change that he will mow everything but not maintain everything west of the culvert. Mayor Dunlap asked for public comment. There was no public comment. CouncilmemberTeressa King moved to adopt Resolution R17-391. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Cris Valverde presented for consideration to authorize Mayor to sign the Professional Services Agreement between City of Plainview and Kendig Keast Collaborative for Zoning Ordinance and Subdivision Regulation Updates. This is for revision of the City's Zoning Ordinance. Mayor Dunlap asked for public comment. Councilmember Blackerby moved to authorize Mayor to sign the Professional Services Agreement between City of Plainview and Kendig Keast Collaborative for Zoning Ordinance and Subdivision Regulation Updates. The motion was duly seconded by Councilmember Gatica and carried by unanimous vote. Jeffrey Snyder, City Manager presented for consideration to authorize the Mayor to sign Airport Management Study Agreement between the County of Hale and the City of Plainview and Parkhill Smith and Cooper. This Agreement would authorize the Airport Management Study at the Plainview -Hale County Airport. Mayor Dunlap asked for public comment. Councilmember Williams moved to authorize Mayor to sign the Airport Management Study Agreement between the County of Hale and the City of Plainview and Parkhill Smith and Cooper in an amount not to exceed of $63,800.00. Councilmember Blackerby moved to go into closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. City Attorney in accordance with Section 551.074 and to deliberate the purchase, exchange, lease or value of real property, the public discussion of which would not be in the best interest of the City's bargaining position with third parties, in accordance with Tex. Gov't Code, Section 551.072. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mayor Dunlap recessed the meeting at 7:36 p.m. Mayor Dunlap called the meeting back in open session at 8:37 p.m. Mr. Snyder presented to consider and take necessary action regarding City Attorney. Staff recommends authorizing the hiring of Underwood Law Firm for interim city attorney services for $1,800 a month retainer. Mayor Pro Tem Starnes moved to authorize the City Manager to contract with Underwood City Council Minutes June 27, 2017 Page 2 of 3 135 136 Law Firm in Amarillo to provide legal services on an interim basis in the amount of $1,800 per month as specified in their agreement. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote.
