Mary Ann Dominguez, Community Service Secretary. Mark Hardin opened the meeting at 6:17 pm, established a quomm and conducted the consideration of the following Items in the order presented Nick Mogt read the staff reports, and gave the recommendations for each item. FIRST ITEM ON THE AGENDA: Approval f July 272017 minutes. Danny Mortared made a motion to approve minutes of July 27, 2017 as presented. Joe Frank Rodriguez seconded the motion. Motion carded unanimously. SECOND ITEM ON THE AGENDA: ZBA-1]-21 Consider the t of a specialf f the minimum front set back immersing-f a Carport underM1 City JPlainview Zoning Ordnance Sectcn 3] 2 21H1 S Exceptions. The f n tlescr bed as Block 8 E60 x 1D 5 NMIP I of the Lakeside Addition, Plainview, Texas. Hale Counts, also known as 415 W 71T Street. The applicant is requesting a variance or special exception In order to construct a metal flat roof 12ft. by 20n. carport (non -prefabricated) in the front -yard setback. With the home being built ]ftbehind the minimum front yard setback the proposed carport would encroach approximately 511. into the required minimum front yard setback of 25k. If approved the front edge of Me carport will be 25ft. from the back of curb When analyzing the area staff observed five similar constmucted carports within the front -yard of homes within a two black radius. Two of the five are located on W 170i SL west of the applicants home. Stan also noticed that this particular neighborhood is one where the homes were not built with garages. Board of Adjustment September 11, 2017 Minutes Staff did observe a shop in the back yard area of the home, and inquired if the applicants shop could be used for proposal of Me vehicles. The applicant stated that the shop is used for his tools and storage, and did not have sufficient space to house a vehicle. The applicant also stated that it would be impractical to exit and enter from the rear on the unimproved din alley. Notices have been sent to property owners within 200 feet regarding this request. At the fime of this writing, the staff has not received any comments of the request. An update will be provided at the Zoning Froth of Adjustment meeting should there be any change. Kevin Caner made a motion to approve the variance based on the request Danny emphasis seconded and the motion was carried unanimously. THIRD ITEM ON THE AGENDA: ZBA-17-22 Consider the inguest of a special exceptionf the front set back authorizing the construction of a Camod under the ON of Plainview Zoning Ordinance Sect rm 372 2M1 Special Exceptions The ocat on described as Block 44 W/2 of Lovs 15 & 16 Except (10 x 551 out of SW Comer of Lot 15. of the Highland Addition, Plainview, Texas Hale County also known as 1611 W lath Street The applicant Is requesting a variance or special exception in order to construct a 1 EIt. by 24ft. metal frame and roof carport (nonprefabricated)in the side yam setback. The carbon as proposed would encroach approximately 1ft. Into the public right of way. This would result in the front edge of the tarpon being 21b from the back of curb. A carport cannot be built in the right of way due to liability issues. When analyzing the area, staff observed at least six similar constructed tarpons within the front yard of homes within a two -block radius. Staff also noticed that this parficular neighborhood is one where a majority of the homes in me area were not constructed with garages, the applicant's home being one. Staff also observed available spare for a carport on the side of the home that could be buih behind the set back line, when staff inquired about locating the carport In Me manside yard the applicant stated that they use the backyard area to entertain and a tarpon would take up too much room. Notices have bean sent to properly owners within 200 feet regarding this request. At the time of this corking, the staff has not received any comments. An update will be provided at the Zoning Board of Adjustment meetng should there be any change. Joe Frank Rodriguez made a motion to approve the variance based on the request. The applicant is requesting a variance or special exception in order to conshuct a loft. by 24ft. metal frame and roof carport (non -prefabricated) in the front-yaM setback. If approved this would result in the front edge of the carport being 23ft. from the back of curb.
