HomeMy WebLinkAboutCouncil Minutes 09-26-2017The City Council met on September 26, 2017 at 7:00 p.m., in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 11:40 a.m. on September 22, 2017. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, John Gatica- District 6 and Oliver Aldape-District 7. Staff members present were: Jeffrey Snyder -City Manager, Marcus Norris -City Attorney, Paul Kite -Assistant Director of Public Utilities, Sarianne Beversdorf-Director of Finance, Cris Valverde -Community Development Manager, Tim Crosswhite-Director of Public Works, Ken Coughlin -Police Chief, lsauro Gutierrez -Information Technology Manager, Melinda Brown -Main Street Manager and Belinda Hinojosa-City Secretary. News Media Present: Doug McDonough -Plainview Herald Guests Present: Matt Blackburn and Mary Kindinger Mayor Wendell Dunlap led in the invocation. The Council recognized Matt Blackburn, Bryan Merrick and Al Longoria for their service during Hurricane Harvey. Councilmember Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Items approved on the consent calendar included the approval of the minutes of September 7, 2017 and September 12, 2017; approval of the financial reports; approval of Resolution R17-400, a Resolution of the City Council of the City Of Plainview, Texas, Approving the Request of Plainview Fall Festival 5k Director to Host the Plainview Fall Festival 5k Run; Authorizing the Filing of the Agreement for the Temporary Closure of State Right -Of -Way with the Texas Department of Transportation for This Event; Declaring that the Event Serves a Public Purpose; and Agreeing to Comply with Regulations; and authorize Mayor to sign Contract between the City of Plainview and Tank Pro for the Prison Water Tower Project. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3662, an Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2017 and Terminating September 30, 2018, and Making Such Appropriations for Each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember King moved to adopt Ordinance No. 17-3662 on second reading. The motion was duly seconded by Councilmember Juarez. Jeffrey Snyder, City Manager presented an action to ratify the Property Tax Revenue Increase Reflected in the FY 2017-2018 Budget. Local Government Code 102.007(c) requires the City Council to take a separate vote to ratify an increase in property tax revenue collected in a proposed budget. Councilmember King moved to ratify the property tax increase reflected in the budget for Fiscal Year 2017-2018 Budget. The motion was duly seconded by Councilmember Aldape. Mayor Dunlap, Councilmembers Williams, Juarez, King, Gatica and Aldape voted "for" the motion. Mayor Pro Tem Starnes and Councilmember Blackerby voted against the motion. The motion carried. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3663, an Ordinance for the City of Plainview, Texas Setting the Tax Rate and Levying Municipal Ad Valorem Taxes for the Year 2017; Directing the Assessment and Collection Thereof; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; and Effective Date. Since this was the second of two readings the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Williams moved that the property tax rate be adopted at the effective tax rate of sixty-three and twelve hundredths cents ($.6312) per $100 valuation for maintenance and operations. The motion was duly seconded by Councilmember King. Mayor Starnes moved to amend the original motion by establishing a tax rate of $.6288. Belinda Hinojosa, City Secretary asked for a record vote of the Council on the amended motion to change the tax rate to $.6288, with the Council voting as follows: Mayor Dunlap — No Mayor Pro Tem Starnes — Yes Councilmember Williams — No Councilmember Juarez — No Councilmember King — No Councilmember Blackerby- Yes Councilmember Gatica — No Councilmember Aldape — No The amended motion failed. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3664, an Ordinance of the City of Plainview, Texas, Amending Chapter 13, Utilities" of the Code of Ordinances of the City of Plainview, Texas; Cumulativeness Clause; Repealer; Severability Clause; and Effective Date. Since this was the second of two readings the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 17-3664 on second reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3665, an Ordinance of the City of Plainview Amending Ordinance No. 16-3638 and Ordinance No. 17-3653 to Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (a) and (d) of the Plainview City Charter Allowing for Supplemental Appropriations in the 2016-2017 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. Since this was the second of two readings the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 17-3665 on second reading. The motion was duly seconded by Councilmember King and carried by unanimous vote. Melinda Brown, Main Street Manager presented for consideration Resolution R17-398, a Resolution of the City Council of the City of Plainview Establishing a Designated Downtown Area of the City as Slum or Blighted in Accordance With the Requirements of the Texas Department of Agriculture Texas Capital Fund Main Street Improvements Program. This is one of the next steps in the process of submitting a grant application for Main Street Downtown improvements by designating public improvements as slum or blighted. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Williams moved to adopt Resolution R17-398. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Melinda Brown, Main Street Manager presented for consideration Resolution R17-399, Resolution of the City Council of the City of Plainview, Texas Authorizing the Filing of a Grant Application for Downtown Improvements with the Texas Department of Agriculture Main Street Program; Designating an Authorized Official and Authorizing Such Official to Execute all Documents Necessary; and Pledging Compliance to the Awarded Grant Program. This Resolution authorizes the submittal of a grant application. City Council Minutes September 26, 2017 Page 3 of 4 159 160 Mayor Dunlap asked for public comment. There was no public comment. Mayor Pro Tem Starnes moved to adopt Resolution R17-399. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Mr. Snyder presented for consideration Resolution R17-401, a Resolution of the City Council of the City of Plainview, Texas Supporting and Authorizing the Filing of a Grant Application for Funds with the Transportation Investment Generating Economic Recovery (TIGER) Discretionary Grants Program for the 24th Street Reconstruction Project; Designating an Authorized Official and Authorizing such Official to Execute all Documents Necessary; and Pledging Compliance to the Awarded Grants Program. This authorizes the City to submit a grant application to the U.S. Department of Transportation for reconstruction of 24th Street. Mayor Dunlap asked for public comment. There was no public comment. Councilmember King moved to adopt Resolution R17-401. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote.
