A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PLAINVIEW, HALE COUNTY, TEXAS AUTHORIZING THE MAYOR
TO SIGN ON BEHALF OF THE CITY THE SUPPLEMENTAL
WATERSHED AGREEMENT NO. II.
WHEREAS, The Watershed Work Plan Agreement for the Lower Running
Water Draw Watershed, State of Texas, became effective on the 28th day of May,
1970; and
WHEREAS, the Supplemental Water Plan Agreement Number 1 became
effective on the 1St day of January, 1972; and
WHEREAS, in order to carry out the watershed work plan for said
watershed, it has become necessary to modify said Watershed Work Plan
Agreement;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLAINVIEW, TEXAS:
The Mayor is authorized to sign the attached Supplemental Water Agreement No.
II between the Hale County Social and Water Conservation District, Hale County
Commissioner's Court, City of Plainview and the Natural Resources Conservation
Service, United States Department of Agriculture "Exhibit "A".

AUTHORITY
The original watershed work plan was prepared, and works of improvement have been installed, under the authority
of the Watershed Protection and Flood Prevention Act of 1954 (Public Law 83-566) as amended. The rehabilitation
of floodwater retarding structure No. 4 is authorized under Public Law 83-566 (as amended), and as further amended
by Section 313 of Public Law 106-472

(Referred to herein as NRCS)
Whereas, The Watershed Work Plan Agreement for the Lower Running Water Draw Watershed,
State of Texas, executed by the Sponsoring Local Organization (SLO) named therein and the
NRCS (formerly the Soil Conservation Service), became effective on the 28th day of May, 1970;
and
Whereas, the Supplemental Watershed Plan Agreement Number l executed by the SLO named
therein and the NRCS, became effective on the 1st day of January 1972; and
Whereas, in order to carry out the watershed work plan for said watershed, it has become
necessary to modify said Watershed Work Plan Agreement; and
Whereas, in order to extend the watershed plan for said Floodwater Retarding Structure (FRS)
No. 4 beyond its current evaluated life, it has become necessary to modify said watershed
agreement: and
Whereas, the rehabilitation of said FRS No. 4 has been authorized under the authority of the
Watershed Protection and Flood Prevention Act (PL 83-566) as amended by Section 313 of
Public Law 106-472, provides the authority for rehabilitation; and
Whereas, it has become necessary to modify said watershed work plan by modifying FRS No. 4
to bring it up to current performance and safety standards and to extend the service life of the
dam for 100 years; and

Whereas, the responsibility for administration of the Watershed Protection and Flood Prevention
Act, as amended, has been assigned by the Secretary of Agriculture to the NRCS; and
Whereas, there has been developed through the cooperative efforts of the sponsors and NRCS a
Supplemental Watershed Plan/Environmental Evaluation which modifies the Watershed Work
Plan for said watershed, hereinafter referred to as the watershed project plan or plan, which plan
is annexed to and made a part of this agreement; and
Now, therefore, in view of the foregoing considerations, the Secretary of Agriculture through the
NRCS and the sponsors hereby agree upon this watershed project plan and that the works of
improvement for this project will be installed, operated, and maintained in accordance with the
terms, conditions, and stipulations provided for in this plan including the following;
(1) Paragraph No. 2 regarding Real Property is modified to include current language to read
as follows:
The sponsors will acquire such real property as will be needed in connection with the works of
improvement to rehabilitate Lower Running Water Draw FRS No. 4. The amounts and
percentages of the real property acquisition costs to be borne by the sponsors and NRCS are as
shown in the Cost Share table in paragraph No. 18 hereof. The sponsors agree that all land
acquired for measures with financial or credit assistance under this agreement will not be sold or
otherwise disposed of for the evaluated life of the project except to a public agency that will
continue to maintain and operate the development in accordance with the operation and
maintenance agreements. The sponsors have current easements to elevation 3421.8 feet
NAVD88 which exceeds the elevation of a 1,000 -year 24-hour storm event. The probable
maximum flood is contained below the top -of -dam elevation 3424.0 feet NAVD88. The
potential of future inhabitable dwellings in the area between the current easement elevation and
the top -of -dam elevation is considered to be very low. Although future development below top -
of -dam is not expected during the evaluated life of the project, the sponsors acknowledge the
remote possibility of future development. The sponsors accept the risk and liability associated
with storm events that could inundate the area corresponding to the 2.2 -foot difference between
the current easement elevation and the top -of -dam elevation.
(2) Paragraph No. 3 regarding Water and Mineral Rights is added to include current
language to read as follows:
The sponsors will acquire or provide assurance that landowners or resource users have acquired
such water, mineral, or other natural resources rights pursuant to State law as may be needed in
the installation and operation of the works of improvement. Any costs incurred must be borne
by the sponsors and these costs are not eligible as part of the sponsors' cost share.
(3) Paragraph No. 13 regarding Costs is added to include current language and reads as
follows:
The costs shown in this plan are preliminary estimates. Final costs to be borne by the parties
hereto will be the actual costs incurred in the installation of works of improvement.

(4) Paragraph No. 15 regarding the Uniform Relocation Assistance and Real Property
Acquisition Policies Act is added to include current language to read as follows:
The sponsors hereby agree to comply with all of the policies and procedures of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act (42 U.S.C. Section 4601 et
seq. as further implemented through regulations in 49 CFR Part 24 and 7 C.F.R. Part 21) when
acquiring real property interests for this federally assisted project. If the sponsors are legally
unable to comply with the real property acquisition requirements, it agrees that, before any
Federal financial assistance is furnished, it will provide a statement to the effect, supported by an
opinion of the chief legal officer of the state containing a full discussion of the facts and law
involved. This statement may be accepted as constituting compliance.
(5) Paragraph No. 14 regarding Nondiscrimination provisions is modified to include current
language to read as follows:
In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil
rights regulations and policies, the USDA, its Agencies, offices, and employees, and institutions
participating in or administering USDA programs are prohibited from discriminating based on

(6) Paragraph No. 11 regarding Obligation of Federal Funds and Services is renamed NRCS
Assistance and modified to include current language to read as follows:
This agreement is not a fund -obligating document. Financial and other assistance to be furnished
by NRCS in carrying out the plan is contingent upon the fulfillment of applicable laws and
regulations and the availability of appropriations for this purpose.
Paragraph No. 16 regarding Additional Agreements is hereby added as follows:

A separate agreement will be entered into between NRCS and the sponsors before either party
initiates work involving funds of the other party. Such agreements will set forth in detail the
financial and working arrangements and other conditions that are applicable to the specific works
of improvement.
(7) Paragraph No. 17 regarding the Term of Supplemental Watershed Agreement No. II is
added as follows:
The term of this agreement is for the installation period and evaluated life of the project (102
years - two years installation period and 100 years evaluated life) and does not commit NRCS to
assistance of any kind beyond the end of the evaluated life. The 102 -year term of this
supplemental watershed agreement applies only to the specific portions of the agreement directly
related to the rehabilitation of FRS No. 4.
(8) Paragraph No. 18 regarding the Cost Share Table for Rehabilitation of FRS No. 4 is
added to show cost -share percentages and estimated amounts for Watershed Project Plan
implementation:

(9) Paragraph No. 19 regarding Floodplain Management is added as follows:
Before construction of any project for flood prevention, the sponsors must agree to participate in
and comply with applicable Federal floodplain management and flood insurance programs.
(10) Paragraph No. 20 regarding Permits is added as follows:

The sponsors will obtain and bear the cost for all necessary Federal, State, and local permits
required by law, ordinance, or regulation for installation of the works of improvement. These
costs are not eligible as part of the sponsors' cost share.
(11) Paragraph No. 21 regarding Amendments is added as follows:
This plan may be amended or revised only by mutual agreement of the parties hereto, except that
NRCS may deauthorize or terminate funding at any time it determines that the sponsors have
failed to comply with the conditions of this agreement or when the program funding or authority
expires. In this case, NRCS must promptly notify the sponsors in writing of the determination
and the reasons for the deauthorization of project funding, together with the effective date.
Payments made to the sponsors or recoveries by NRCS must be in accordance with the legal
rights and liabilities of the parties when project funding has been deauthorized. An amendment
to incorporate changes affecting a specific measure may be made by mutual agreement between
NRCS and the sponsors having specific responsibilities for the measure involved.
(12) Paragraph No. 22 regarding Operation and Maintenance (O&M) of rehabilitated FRS
No. 4 is added as follows:
The sponsors will be responsible for the operation, maintenance, and any needed replacement of
the works of improvement by actually performing the work or arranging for such work, in
accordance with an O&M Agreement. Specifically, Hale County Commissioner Court will be
responsible for the O&M of rehabilitated FRS No. 4 with assistance from Hale County Soil and
Water Conservation District (SWCD). An O&M agreement will be entered into before Federal
funds are obligated and continue for the project life (100 years). Although the sponsors'
responsibility to the Federal Government for O&M ends when the O&M agreement expires upon
completion of the evaluated life of measures covered by the agreement, the sponsors
acknowledge that continued liabilities and responsibilities associated with works of improvement
may exist beyond the evaluated life.
(13) Paragraph No. 23 regarding an Emergency Action Plan is added as follows:
Prior to construction, the sponsors must prepare an Emergency Action Plan (EAP) for FRS No.
4. The EAP must meet the minimum content specified in NRCS Title 180, National Operation
and Maintenance Manual (NOMM), Part 500, Subpart F, Section 500.52, and meet applicable
State agency dam safety requirements. The NRCS will determine that an EAP is prepared prior
to the execution of fund obligating documents for construction of the structure. EAP must be
reviewed and updated by the sponsors annually.
(14) Paragraph No. 24 concerning Certification Regarding Drug -Free Workplace
Requirements (7 CFR Part 3021) is added as follows:
By signing this Watershed Agreement, the sponsors are providing the certification set out below.
If it is later determined that the sponsors knowingly rendered a false certification. or otherwise
violated the requirements of the Drug -Free Workplace Act, the NRCS, in addition to any other
remedies available to the Federal Government, may take action authorized under the Drug -Free
Workplace Act.

Controlled substance means a controlled substance in Schedules I through V of the Controlled
Substances Act (21 U.S.C. Section 812) and as further defined by regulation (21 CFR Sections
1308.11 through 1308.15);
Conviction means a finding of guilt (including a plea of nolo contendere) or imposition of
sentence, or both, by any judicial body charged with the responsibility to determine violations of
the Federal or State criminal drug statutes;
Criminal drug statute means a Federal or non -Federal criminal statute involving the
manufacturing, distribution, dispensing, use, or possession of any controlled substance;
Employee means the employee of a grantee directly engaged in the performance of work under a
grant, including: (i) all direct charge employees; (ii) all indirect charge employees unless their
impact or involvement is insignificant to the performance of the grant; and, (iii) temporary
personnel and consultants who are directly engaged in the performance of work under the grant
and who are on the grantee's payroll. This definition does not include workers not on the payroll
of the grantee (e.g., volunteers, even if used to meet a matching requirement; consultants or
independent contractors not on the grantees' payroll; or employees of sub -recipients or
subcontractors in covered workplaces).
Certification:
A. The sponsors certify that they will or will continue to provide a drug-free workplace by:
(1) Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use ofa controlled substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition.
(2) Establishing an ongoing drug-free awareness program to inform employees about:
(a) The danger of drug abuse in the workplace;
(b) The grantee's policy of maintaining a drug-free workplace;
(c) Any available drug counseling, rehabilitation, and employee assistance programs;
and
(d) The penalties that may be imposed upon employees for drug abuse violations
occurring in the workplace.
(3) Making it a requirement that each employee to be engaged in the performance of the
grant be given a copy of the statement required by paragraph (1);
(4) Notifying the employee in the statement required by paragraph (1) that, as a condition
of employment under the grant, the employee must:
(a)Abide by the terms of the statement; and
(b) Notify the employer in writing of his or her conviction for a violation ofa criminal
drug statute occurring in the workplace no later than five calendar days after such

conviction.
(5) Notifying the NRCS in writing, within ten calendar days after receiving notice under
paragraph (4) (b) from an employee or otherwise receiving actual notice of such
conviction. Employers of convicted employees must provide notice, including position
title, to every grant officer or other designee on whose grant activity the convicted
employee was working, unless the Federal agency has designated a central point for
the receipt of such notices. Notice must include the identification number(s) of each
affected grant.
(6) Taking one of the following actions, within 30 calendar days of receiving notice
under paragraph (4) (b), with respect to any employee who is so convicted:
(a) Taking appropriate personnel action against such an employee, up to and including
termination, consistent with the requirements of the Rehabilitation Act of 1973, as
amended; or
(b) Requiring such employee to participate satisfactorily in a drug abuse assistance or
rehabilitation program approved for such purposes by a Federal, State, or local
health, law enforcement, or other appropriate agency.
(7) Making a good faith effort to continue to maintain a drug-free workplace through
implementation of paragraphs (1), (2), (3), (4), (5), and (6).
B. The sponsors may provide a list of the site(s) for the performance of work done in
connection with a specific project or other agreement.
C. Agencies will keep the original of all disclosure reports in the official files of the agency.
(15) Paragraph No. 25 regarding Certification Regarding Lobbying (7 CFR Part 3018) is
added as follows:
A. The sponsors certify to the best of their knowledge and belief, that:
(1) No Federal appropriated funds have been or will be paid, by or on behalf of the sponsors,
to any person for influencing or attempting to influence an officer or employee of an
agency, Member of Congress, an officer or employee of Congress, or an employee of a
member of Congress in connection with the awarding of any Federal contract, the making
of any Federal grant, the making of any Federal loan, the entering into of any cooperative
agreement, and the extension, continuation, renewal, amendment, or modification of any
Federal contract, grant, loan, or cooperative agreement.
(2) if any funds other than Federal appropriated funds have been paid or will be paid to any
person for influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of Congress, or an employee of a Member
of Congress in connection with this Federal contract, grant, loan, or cooperative
agreement, the undersigned must complete and submit Standard Form LLL, "Disclosure
Form to Report Lobbying," in accordance with its instructions.

(3) The sponsors must require that the language of this certification be included in the award
documents for all subawards at all tiers (including subcontracts, subgrants, and contracts
under grants, loans, and cooperative agreements) and that all subrecipients must certify
and disclose accordingly.
B. This certification is a material representation of fact upon which reliance was placed when
this transaction was made or entered into. Submission of this certification is a prerequisite for
making or entering into this transaction imposed by U.S. Code, Title 31, Section 1352. Any
person who fails to file the required certification shall be subject to a civil penalty of not less
than $10,000 and not more than $100,000 for each such failure.
(16) Paragraph No. 26 concerning Certification Regarding Debarment, Suspension, and
Other Responsibility Matters—Primary Covered Transactions (7 CFR Part 3017) is added
as follows:
A. The sponsors certify to the best of their knowledge and belief, that they and their principals:
(1) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or
voluntarily excluded from covered transactions by any Federal department or agency;
(2) Have not within a 3 -year period preceding this proposal been convicted of or had a civil
judgment rendered against them for commission of fraud or a criminal offense in
connection with obtaining, attempting to obtain, or performing a public (Federal, State, or
local) transaction or contract under a public transaction; violation of Federal or State
antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or
destruction of records, making false statements, or receiving stolen property;
(3) Are not presently indicted for or otherwise criminally or civilly charged by a
governmental entity (Federal, State, or local) with commission of any of the offenses
enumerated in paragraph A(2) of this certification; and
(4) Have not within a 3 -year period preceding this application/proposal had one or more
public transactions (Federal, State, or local) terminated for cause or default.
B. Where the primary sponsors are unable to certify to any of the statements in this certification,
such prospective participant must attach an explanation to this agreement.
(17) Paragraph No. 27 regarding Clean Air and Water Certification is added to read as
follows:
(Applicable if this agreement exceeds $100,000, or a facility to be used has been subject of a
conviction under the Clean Air Act (42 U.S.C. Section 7413(c)) or the Federal Water Pollution
Control Act (33 U.S.C. Section 1319(c)) and is listed by EPA, or is not otherwise exempt.)
A. The project Sponsoring Local Organizations signatory to this agreement certifies as follows:
(1) Any facility to be utilized in the performance of this proposed agreement is ( ), is not
( 7C) listed on the Environmental Protection Agency List of Violating Facilities.
(2) To promptly notify the NRCS-State Administrative Officer prior to the signing of this
agreement by NRCS, of the receipt of any communication from the Director, Office of Federal
Activities, U.S. Environmental Protection Agency, indicating that any facility which is proposed

for use under this agreement is under consideration to be listed on the Environmental Protection
Agency List of Violating Facilities.
(3) To include substantially this certification, including this subparagraph, in every
nonexempt sub -agreement.
B. The project sponsors signatory to this agreement agree as follows:
(1) To comply with all the requirements of section 114 of the Clean Air Act as amended (42
U.S.C. Section 7414) and section 308 of the Federal Water Pollution Control Act (33 U.S.C.
Section 1318), respectively, relating to inspection, monitoring, entry, reports, and information, as
well as other requirements specified in section 114 and section 308 of the Air Act and the Water
Act, issued there under before the signing of this agreement by NRCS.
(2) That no portion of the work required by this agreement will be performed in facilities
listed on the EPA List of Violating Facilities on the date when this agreement was signed by
NRCS unless and until the EPA eliminates the name of such facility or facilities from such
listing.
(3) To use their best efforts to comply with clean air standards and clean water standards at
the facilities in which the agreement is being performed.
(4) To insert the substance of the provisions of this clause in any nonexempt sub -agreement.
C. The terms used in this clause have the following meanings:
(1) The term "Air Act" means the Clean Air Act, as amended (42 U.S.C. Section 7401 et
seq.).
(2) The term "Water Act" means Federal Water Pollution Control Act, as amended (33
U.S.C. Section 1251 et seq.).
(3) The term "clean air standards" means any enforceable rules, regulations, guidelines,
standards, limitations, orders, controls, prohibitions, or other requirements which are contained
in, issued under, or otherwise adopted pursuant to the Air Act or Executive Order 11738, an
applicable implementation plan as described in section 110 of the Air Act (42 U.S.C. Section
7414) or an approved implementation procedure under section 112 of the Air Act (42 U.S.C.
Section 7412).
(4) The term "clean water standards" means any enforceable limitation, control, condition,
prohibition, standards, or other requirement which is promulgated pursuant to the Water Act or
contained in a permit issued to a discharger by the Environmental Protection Agency or by a
State under an approved program, as authorized by section 402 of the Water Act (33 U.S.C.
Section 1342), or by a local government to assure compliance with pretreatment regulations as

Hale County Commissioners Court is responsible for the O&M of the dam. Based on the
latest O&M report by the local sponsors dated October 20, 2016, Site 4 was found to be in
overall fair condition. No imminent dam safety issues were noted. The dam appeared to be
operating as designed. Rodent and animal burrows and cattle trails were noted on the dam and
in the auxiliary spillway. The sponsors will be notified that several fence gates need to be
replaced and that grazing of the dam and auxiliary spillway should be controlled. The overall
operation and maintenance were considered adequate.

B. Purpose and Need for Action
There is a need for continued flood protection in the Lower Running Water Draw Watershed and to meet current safety
standards. The original purpose of the Lower Running Water Draw Watershed Plan was flood protection. The purpose of this
supplemental watershed plan is 10 meet current safety and performance standards for a high hazard dam and to provide
continued flood protection for downstream properties for a I00 -year 24-hour flood event. The dam currently provides flood
protection benefits to about 1,307 acres of agricultural and urban land, 117 properties (48 residences, 59 commercial, and 10
public), one interstate highway, 2 major state highways, 9 city streets, and 4 unpaved roads. However, if the dam were to fail,
there are 66 residences, 58 commercial properties, 12 public properties, and 16 roads located downstream that would be
impacted. The risk of loss of life and property damage due to potential over -topping breach of the dam during an extreme
flood event (probable maximum flood, PMF) is the reason that FRS No. 4 needs to be rehabilitated. See Appendix E.

This alternative removes the existing principal
spillway (PS) inlet and installs a new standard
inlet tower with the crest elevation at the existing
low -stage crest elevation. The new inlet will
connect to the existing conduit Lower the
existing earthen auxiliary spillway (AS) crest
elevation by 2.1 feet and re -grade the inlet and
outlet channels. Install a 340 feet wide roller
compacted concrete (RCC) AS over the existing
embankment with the crest elevation 1 6 feet
lower than the earthen AS. Lower the top of dam
(TOD) crest elevation 0.1 feet, re grade the
upstream slope to original slope dimensions, and
flatten the downstream slope to 3:1 The existing
30 -inch conduit remains in place and Hill empty
into the RCC stilling basin. Total required
acreage for easements for this alternative is 305
acres and covered by the current easements of
the sponsors. The RCC structure and extension
of the downstream toe for flattening the

Hydrologic - FRS No. 4 was originally
designed to retain 1,179 ac -ft of floodwater. It was designed as a significant hazard
dam and is currently performing as intended. However, due to past downstream development it does not currently meet dam
safety criteria for a high hazard dam, as required by the NRCS in order to prevent breaching of the auxiliary spillway and or
embankment. Therefore, FRS No. 4 is categorized as having high potential to fail due to deficient hydrologic capacity.
Stability - FRS No. 4 does not show visible signs of slope failure, including sloughing or other signs of embankment
instability. The embankment slopes are rough with numerous benches as a result of livestock traffic, have minor erosion
along the entire length due to poor vegetation and animal burrows created by prairie dogs , but the embankment is in good
overall condition. Monitoring of the embankment should continue in the future, however the risk of embankment slope
failure is judged to be low.
Seepage - FRS No. 4 shows no visible signs of seepage, including piping and sloughing. The embankment and auxiliary
spillway are in good condition, though the grass cover on each is recovering from drought. Therefore, potential failure due to
seepage is judged to be low but monitoring should continue in the future.
Materia! Deterioration - The riser and principal spillway are in good condition, with a few minor exceptions. (However,
there has not been a video inspection of the conduit. Such inspection is required prior to final design.) Based on current
conditions, potential failure of the existing dam due to material deterioration is estimated to be low. FRS No, 4 should
continue to be monitored, however, especially after significant storm events.
Sedimentation • Total sediment storage for FRS No. 4 was originally planned at 533 ac. -ft. Recent surveys indicate that 84
ac. -ft were deposited during the past 39 years. Recent predictive soil loss equations and reservoir sedimentation evaluations
completed in 2015 indicate that 89.4 ac. -ft. (75.3 ac. -ft. submerged plus 14.1 ac-fi aerated) sediment storage are needed for
the next 50 years and 178.8 ac. -ft. (150.6 ac. -ft. submerged plus 28.2 ac. -ft. aerated) sediment storage are needed for the next
100 years at the present land use and erosion rates. At present land use conditions there is enough capacity for 100 years of
sediment storage. Therefore the potential for FRS No. 4 to fail as a result of a lack of sediment storage is judged to be low.
Seismk - The integrity and stability of an earthen embankment are dependent on the presence of a stable foundation.
Foundation movement through consolidation, compression, or lateral movement can create weak zones or voids within an
embankment, separation of the principal spillway conduit joints, or in extreme cases, complete collapse of the embankment
FRS No. 4 is located in a Zone I on the Algermissen Seismic Risk Map of the United States. There are no indications that
any foundation movement has occurred in the past that would
weaken the integrity of the embankment or any of the

J. Risk and Uncertainty
Environmental (Wetlands and Fish/Wildlife Habitat) - Risk from Alternative I would increase downstream flooding, erosion
and sedimentation during 100 year storm event and convert sediment pool. Risk from Alternative 2 would have greater
increase in downstream release through principal spillway.
Cultural Resources - Additional cultural resources investigations may be necessary should the no action alternative be
selected. At this time areas of potential effect for alternatives other than rehabilitation have not been specifically identified.
Ensuing disturbances associated with rehabilitation measures will be monitored for the presence of undiscovered sites. In the
event of such discovery, appropriate actions will be taken in accordance with the State Level Agreement among NRCS and
the Texas SHPO; the National Programmatic Agreement among NRCS, the National Conference of State Historic

Economics - The risk and uncertainty in the analysis for flood damage reduction could be reduced for the economic analysis,
but that would require more intensive primary and secondary data collection. The reasoning for work is to meet the purpose
and need of the project which is to continue flood protection while meeting the present safety and performance standards.
The identification of the NED alternative is not distorted by the use of these procedures. Thus, it was determined that
increased investment in analysis was not necessary and any reduction in risk and uncertainty would not result in a different
identification of the NED alternative.
Engineering - The areas of risk and uncertainty associated with this project lie in the accuracy of estimating cost estimates
associated with each alternative. Cost estimates were developed from available historic data. Factors discovered during
actual design, notably the bearing capacity of the existing structure and availability of suitable material for construction
could affect these estimates. The potential impacts for each alternative are estimated using techniques that relate potential
damage to lost opportunity. However, these methods are in part based on professional judgment and actual experience could
be different. Within the context of this study effort, all alternatives were considered on a comparable basis. There does not
appear to be any area that by using different procedures or making more intensive studies would have resulted in a different
decision.
Hydrology - The areas of risk and uncertainty associated with this project lie in the accuracy of estimating flood flows and
flood elevations. The uncertainty of flood flows and water surface elevations has the potential for increased damages as new
properties are converted from agricultural to residential and commercial use. It is possible these uncertainties could lead to
increased risk to human life in the event of a dam breach. Hydrologic methods and computer modeling used in this analysis
are consistent with the standards of practice at this time. However, the tributary is not gauged and no verification of storm
flows is possible. The potential impacts for each alternative are estimated using techniques that relate potential damage to
lost opportunity However, these methods are in part based on professional judgment and actual experience could be
different.

Section A. Authority and Program Criteria
1 Future sediment storage exceeds 100 years. Following is supporting data:
The total sediment volume for storage in Lower Running Water Draw FRS No. 4 was originally planned at 533 ac -ft, or 5.33
ac -ft per year (100 -year evaluated life). The submerged sediment storage of 424 ac -ft was planned below the principal
spillway crest at elevation 3411.2 ft. NAVD 88, with 197 ac -ft of that storage being below a port elevation of 3408.0 ft
NAVD 88. The remaining 109 ac -ft of storage would be below auxiliary spillway elevation 3419.8 fi NAVD 88, and
deposited as aerated sediment in the flood pool.
Recent predictive soil Toss equations and reservoir sedimentation evaluations take into account that playas drain a
considerable portion of the 17,965 acre watershed. The playas thus trap much of the upland sediment. These evaluations
were completed in 2015, and indicate that 178.8 ac -ft of sediment storage will be required for the next 100 years with current
land use conditions. This would amount to 150.6 ac -ft of submerged sediment below the principal spillway crest and 28.2 ac -
ft of aerated sediment in the flood pool. Therefore, the total future sedimentation rate is 1.79 ac-ft/yr (178.8 ac -ft divided by
100 years).
Recent surveys indicate that actually 84.0 ac -ft of submerged deposition occurred during the land use of the past 39 years,
since the reservoir construction. This amounts to 2.15 ac-ft/yr of required storage for the past 39 years. The surveyed amount
of sediment storage remaining below the existing principal spillway crest is currently 365.2 ac -ft. The surveyed amount of
sediment storage remaining below the existing principal spillway port is 161.0 ac -ft. This port elevation, 3408.0 NAVD 88,
will be the new elevation for the principal spillway design. The future submerged sedimentation rate is 150.6 ac-ft/I00-yrs or
1.51 ac-ft/yr. Therefore, the 161.0 ac -ft (1.61 ac-ft/yr) of available storage for this principal spillway elevation will
accommodate a 100 -year design life, To estimate future available storage, the soil loss equations were utilized rather than the
bathymetric survey since soil Toss equations give a prediction of future events based on current conditions; the values
obtained by the bathymetric survey are the results of past conditions. The accumulated sediment in the reservoir storage area
will not be disturbed during construction.
2/ Rationale for selected land rights elevation is as follows:
The sponsors will acquire such real property as will be needed in connection with the works of improvement. According to
NRCS policy, for watershed rehabilitation projects the minimum land rights area upstream from the dam must be for all
areas below the elevation of the top of dam, unless the plan allows a lower elevation (not be lower than the elevation of the
100 -year, 24-hour storm or auxiliary spillway elevation, whichever is higher) The sponsors currently hold easements for
Lower Running Water Draw FRS No 4 that meet minimum NRCS requirements (3421.8 feet NAVD88, which is existing
auxiliary spillway crest plus 2.0 feet) The current easements correspond to the elevation of the 1,000 -year 24-hour storm
event. However, these easements are at an elevation below top of dam (TOD), and it would cost approximately S 176,000 to
obtain additional easements to TOD. The S 176,000 is the estimated value for a willing buyer and seller. But, actual costs
could be considerably higher because of the legal process of "taking'' property for public good in Texas. Property rights are
highly valued and aggressively defended in Texas. For this reason and because of past events dealing with FRS No. 4, the
primary landowner would most likely not be willing to cooperate if eminent domain procedures were implemented by the
sponsors Therefore, actual costs would probably be higher and impacts to sponsors landowner's relationships would be
negatively impacted, possibly affecting other sponsors/landowners dealings across the entire watershed.
The sponsors do not have legal authority to restrict upstream development. Even though the sponsors are aware of the
potential flood risks to upstream development below top of dam, they are not securing upstream land rights to the top of dam

elevation for the following reasons: (1) Primarily one landowner - the area in question is primarily owned by one landowner
and has been in the same farm family for generations with no evidence of future generations not farming the area; (2)
Declining population trend - according to US Bureau of Census data, the populations of Hale County and the City of
Plainview peaked in 1980 (37,592 and 22,414 respectively); since 1980 the populations of both have declined to 35,504 and
21,666 respectively (2015 data - 2016 data not available), thus likelihood of future development below top of dam is remote;
(3) Lack of permanent water in sediment pool - although the sediment pool does retain water after a rainfall event, it is
usually dry due to low average annual precipitation (20.4 inches yr); thus, the amenity of waterfront property is not available;
(4) Excessive costs compared to benefits - as described earlier, the incremental costs ($176,000) are very conservative and
could be much higher, resulting in a very low benefit/cost ratio; thus not justifying the economic benefit (limited to
agricultural land); (5) Private property rights and eminent domain issues - as mentioned earlier, securing additional upstream
land rights has the potential to result in legal actions or proceedings due to current private property rights in Texas as well as
questionable reasons supporting a taking of land for the public good; (6) Potential deterioration of sponsors landowner
relationships not only for this project but future dealings in the watershed; and (7) Urgency of completion - the rehabilitation
project needs to proceed to implementation to protect the public and downstream properties at risk. The sponsors
acknowledge the risk and liability for not securing land rights to the top of dam elevation. All of the upstream land use below
top of dam elevation is either cropland or grazing land. thus minimizing adverse environmental impacts.
Section I. Land Use in Drainage Area
As mentioned in Section C , the new PS crest elevation will be 3.2 feet lower than the existing PS crest elevation. Therefore,
the sediment pool surface area will decrease from 92.0 acres to 45.7 acres. The remaining 46.3 acres will be part of the flood
pool (included in Pasture and Rangeland acreage).
Table A. Comparison of Structural Options
Table A. (page 15) has been revised according to N W PH Section 605.35 B(4). The Table A. template on pages 19-20 should
be ignored. Table 3. (pages 17-18) has been added according to NWPM Section 506.15.
A detailed drainage area and hydrology study was performed for this supplemental plan to verify the drainage area. It was
determined a detailed study was needed because the hydraulic design of a high hazard FRS is based on much larger storm
events and that the playa lakes could overflow and influence the hydraulic design of Site 4. The results of the drainage area
analysis determined 5.14 mi2 of uncontrolled drainage (area downstream of all playas) and 22.93 mi2 controlled by playa
lakes.
