HomeMy WebLinkAboutCouncil Minutes 11-28-2017168 The City Council met on November 28, 2017 at 6:00 p.m., in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:50 p.m. on November 22, 2017. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, Susan Blackerby-District 5, John Gatica- District 6 and Oliver Aldape-District 7. Staff members present were: Jeffrey Snyder -City Manager, Marcus Norris -City Attorney, Tim Crosswhite-Director of Public Works, Sarianne Beversdorf-Director of Finance, Bill Bridgwater -Police Lieutenant, Isauro Gutierrez -Information Technology Director, Cris Valverde -Community Development Manager, Paul Kite -Assistant Director of Public Utilities, Melinda Brown -Main Street Manager, David Ellis -IT Specialist, and Belinda Hinojosa-City Secretary. News Media Present: William Carroll -Plainview Herald Guests Present: Karla Espinoza WORK SESSION Melinda Brown, Main Street Manager presented the Marketing and Communications Plan. The Council and staff reviewed the agenda items for the regular meeting. REGULAR MEETING Councilmember Susan Blackerby led in the invocation. Councilmember Teressa King moved to approve the consent calendar. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Items approved on the consent calendar included the granting of an excused absence to Councilmember Oliver Aldape; approval of the minutes of November 14, 2017; approval of financial reports; authorize the sale of trust property R24339 located at 1407 Joliet Street, Plainview, Texas to Charles Mooney and Patricia Mooney in the amount of $1,200.00 and authorize Mayor to sign the Tax Deed; authorize the sale of trust property R26575 located at 812 Beech Street, Plainview, Texas to Juana Mendoza in the amount of $500.00 and authorize Mayor to sign the Tax Deed; and authorize the sale of trust property R12059 located at 1201 El Paso Street, Plainview, Texas to Yurima Alvarez - Ramirez in the amount of $2,000.00 and authorize Mayor to sign the Tax Deed. Jeffrey Snyder, City Manager presented for consideration on first reading Ordinance No. 17-3667, an Ordinance Granting to Atmos Energy Corporation, West Texas Division, a Texas and Virginia Corporation, its Successors and Assigns, a Franchise to Furnish, Transport and Supply Gas to the General Public in the City Of Plainview, Hale County, Texas, for the Transporting, Delivery, Sale, and Distribution of Gas in, out of, and through said Municipality for all Purposes; Providing for the Payment of a Fee or Charge for the use of the Streets, Alleys, and Public Ways; Repealing all Previous Atmos Energy Gas Franchise Ordinances; Providing that it shall be in Lieu of other fees and Charges, Excepting Ad Valorem Taxes; Prescribing the Terms, Conditions, Obligations and Limitations under which such Franchise shall be Exercised; a Most Favored Nations City Council Minutes November 28, 2017 Page 1 of 3 Clause, and a Severability Clause; and Providing an Effective Date. This Ordinance renews the existing nonexclusive franchise agreement with Atmos Energy Corporation, West Texas Division to operate their natural gas distribution system within the City of Plainview for a period of 10 years. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 17-3667 on first reading. The motion was duly seconded by Councilmember Gatica and carried by unanimous vote. Cris Valverde, Community Development Manager presented for consideration on first reading Ordinance No. 17-3668, an Ordinance of the City Council of the City of Plainview, Texas: Adopting a Design Manual for Installation of Wireless Nodes and Similar Facilities in the Public Right -Of -Way and on City Infrastructure; Providing for Severability; Providing for Repealer; Providing for Continuation of Prior Law; Providing Penalty; Providing for Publication and Effective Date. This adopts the City of Plainview Design Manual related to the installation of network nodes and node support poles. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 17-3668 on first reading. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote. Tim Crosswhite, Director of Public Works presented for consideration to authorize Mayor to sign Agreement between the City of Plainview, Texas and Brandt Engineers Group, LTD for Professional Services for the Annual Street Seal Coat Program. This is the Professional Services Agreement with Brandt Engineering for our Annual Street Seal Coat Program. Mayor Pro Tem Starnes moved to authorize Mayor to sign Agreement between the City of Plainview, Texas and Brandt Engineers Group, LTD for Professional Services for the Annual Street Seal Coat Program. The motion was duly seconded by Councilmember King and carried by unanimous vote. The Council went into closed session per Section 551.074 to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee, or to hear a complaint or charge against an officer or employee. City Manager Evaluation at 7:41 p.m. Mayor called the meeting back in open session at 8:52 p.m. Wendell Dunlap, Mayor presented for consideration to take necessary action regarding City Manager Evaluation. He stated the Council cannot say enough about what is happening in the City Manager's office. It has been a wonderful year and they are very proud of Jeffrey and everything he does. Mayor Pro Tem Starnes moved to extend the City Manager's contract by one year and to increase his salary by 3.38%. The motion was duly seconded by Councilmember Juarez and carried by unanimous vote.
