HomeMy WebLinkAboutCouncil Minutes 12-12-2017The City Council met on December 12, 2017 at 6:05 p.m., in the City Council Chambers of the Plainview City Hall at 901 Broadway. The agenda for this meeting was posted in City Hall at 3:00 p.m. on December 7, 2017. Mayor Wendell Dunlap presided. Councilmembers present were: Charles Starnes -District 1, Larry Williams -District 2, Susan Blackerby-District 5, and John Gatica-District 6. Councilmembers Norma Juarez - District 3, Teressa King -District 4, and Oliver Aldape-District 7 were absent. Staff members present were: Jeffrey Snyder -City Manager, Marcus Norris -City Attorney, Sarianne Beversdorf-Director of Finance, lsauro Gutierrez -Information Technology Director, Cris Valverde -Community Development Manager, Paul Kite -Assistant Director of Public Utilities, and Belinda Hinojosa-City Secretary. News Media Present: William Carroll -Plainview Herald Guests Present: Linda Morris, Virginio Ortega, Tonya Keesee, Mike Fox, Mary Beth Fox, Gary C. Lawrence and Sheryl Lawrence WORK SESSION David Baird with Kendig Keast made a presentation on the ongoing Zoning, Subdivision, and Sign Ordinance revisions. The Council and staff reviewed the agenda items for the regular meeting. REGULAR MEETING Councilmember John Gatica delivered the invocation and led in the pledge of allegiance. The Council recognized Tonya Keesee, new Chamber Executive Director. Councilmember Larry Williams moved to approve the consent calendar. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Items approved on the consent calendar included the granting of excused absences to Councilmembers Teressa King, Oliver Aldape and Norma Juarez; approval of the minutes of November 28, 2017; approval of financial reports; and authorize the sale of trust property R27045 located at 900 Fir Street, Plainview, Texas to Gerardo Gonzales in the amount of $620.00 and authorize Mayor to sign the Tax Deed. Jeffrey Snyder, City Manager presented for consideration to approve the Project Design and Project Budget for the Business Park. The Business Park Steering Committee along with staff recommend approval of the Business Park Design. Mayor Pro Tem Starnes moved to approve the Project Design and Project Budget for the Business Park. The motion was duly seconded by Councilmember Blackerby and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3667, an Ordinance Granting to Atmos Energy Corporation, West Texas Division, a Texas and Virginia Corporation, its Successors and Assigns, a Franchise to Furnish, Transport and Supply Gas to the General Public in the City Of Plainview, Hale County, Texas, for the Transporting, Delivery, Sale, and Distribution of Gas in, out of, and through said City Council Minutes December 12, 2017 Page 1 of 2 171 172 Municipality for all Purposes; Providing for the Payment of a Fee or Charge for the use of the Streets, Alleys, and Public Ways; Repealing all Previous Atmos Energy Gas Franchise Ordinances; Providing that it shall be in Lieu of other fees and Charges, Excepting Ad Valorem Taxes; Prescribing the Terms, Conditions, Obligations and Limitations under which such Franchise shall be Exercised; a Most Favored Nations Clause, and a Severability Clause; and Providing an Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Mayor Pro Tem Starnes moved to adopt Ordinance No. 17-3667 on second reading. The motion was duly seconded by Councilmember Williams and carried by unanimous vote. Mayor Dunlap presented for consideration on second reading Ordinance No. 17-3668, an Ordinance of the City Council of the City of Plainview, Texas: Adopting a Design Manual for Installation of Wireless Nodes and Similar Facilities in the Public Right -Of -Way and on City Infrastructure; Providing for Severability; Providing for Repealer; Providing for Continuation of Prior Law; Providing Penalty; Providing for Publication and Effective Date. Since this was the second of two readings, the Council chose to forego staff briefing and asked for public comment. There was no public comment. Councilmember Williams moved to adopt Ordinance No. 17-3668 on second reading. The motion was duly seconded by Councilmember Williams and carried by unanimous vote. Mr. Snyder presented for consideration on first reading Ordinance No. 17-3669, an Ordinance of the City Council for the City of Plainview, Texas Authorizing the Transfer of Certain Real Property in the City of Plainview, Texas to Hale County, Texas, in Accordance With Section 272.001 of the Texas Local Government Code; Authorizing the Mayor to Execute all Documents. Necessary to Transfer Ownership; Repealer; Cumulativeness Clause; Severability Clause; Conflicts Clause; and Effective Date. This Ordinance authorizes the transfer of an undivided one-half interest of a 14.194 acre tract of land purchased for the business park to the County as stated in the Interlocal Agreement. Mayor Dunlap asked for public comment. There was no public comment. Councilmember Blackerby moved to adopt Ordinance No. 17-3669 on first reading. The motion was duly seconded by Councilmember Williams and carried by unanimous vote.
