APRIL 23, 2018
The Zoning Board of Adjustment held a special public hearing on Monday, March 26, 2018 at
6:00 p.m.The meeting took place in the Council Chambers of City Hall, 901 Broadway, Plainview,
Texas, with the following members present:

STAFF MEMBERS PRESENT: Nick Mogg, Code Enforcement, Judy Rasher, Community
Service Secretary.
Mark Hardin opened the meeting at 6:05 pm, established a quorum and conducted the
consideration of the following items in the order presented. Nick Mogg read the staff reports, and
gave the recommendations for each item.
1. Approval of March 26, 2018 meeting minutes: Nicole Ramirez made a motion to
approve minutes of Mach 26, 2018 as presented. Danny Murphree seconded the motion.
Motion carried unanimously.
2. ZBA-18-07: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
10 Lot 18 of the Edgemere Addition, Plainview, Texas, Hale County, also known as
2917 W 21st Street.
The applicant is requesting a variance or special exception to construct a metal flat roof
24 ft. by 24 ft. carport (non-prefabricated) in the front-yard setback. Because the home is
built behind the current required set back line, the proposed carport would encroach
approximately 24ft. into the required minimum front-yard setback of 30ft. Staff observed
two constructed carports within the two block radius. Staff noticed that the neighborhood
is one where double car garages are present. Applicant's observed room in the rear yard
of which a structure can be built. Staff's opinion that the applicant's request be denied.
Nicole Ramirez made a motion to approve the variance based on the request and allow
the applicant to build a carport in the front yard setback. Evan Weiss seconded and the
motion was carried unanimously.
3 ZBA-18-08: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
17 Lot 10 of the West Lynn Addition, Plainview, Texas, Hale County, also known as
1907 Kokomo Street.

The applicant is requesting a variance or special exception in order to construct a metal
flat roof 11ft. by 15ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 13ft. into the required minimum front-yard setback
of 25ft. Danny Murphree made a motion to approve the variance based on the request.
Nicole Ramirez seconded and the motion was carried unanimously.
4. ZBA-18-09: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
2 Lot 11 of the Boswell Addition, Plainview, Texas, Hale County, also known as
303 SE 6th Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 24ft. by 24ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 24ft. into the required minimum front-yard setback
of 25ft. Evan Weiss made a motion to approve the variance based on the request. Danny
Murphree seconded and the motion was carried unanimously.
5. ZBA-18-10: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
2 Lot 13 of the Northside Addition, Plainview,Texas, Hale County. also known as
2204 Joliet Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 18ft. by 20ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 20ft. into the required minimum front-yard setback
of 25ft. Danny Murphree made a motion to approve the variance based on the request.
Evan Weiss seconded and the motion was carried unanimously.
6. ZBA-18-11: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
3 W102.5' — 15 & 16 of the Central Park Addition, Plainview,Texas, Hale County,
also known as 213 W 11th Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 18ft. by 21ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 21ft. into the required minimum front-yard setback.
Staff observed room in the side yard on the west side of the home that would allow the
carport to be built behind the required building line. Staff's opinion is that there is another
location on the lot for the placement of the carport. Staff is of the opinion that the
applicant's request be denied. Nicole Ramirez made a motion to approve the variance
based on the request and allow the applicant to build the carport in the front yard setback.
Evan Weiss seconded and the motion was carried unanimously.
7. ZBA-18-12: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
4 Lot 5 Unit 5 of the Thunderbird Addition, Plainview, Texas, Hale County, also
known as 1409 W 25th Street.

The applicant is requesting a variance or special exception in order to construct a metal
flat roof 12ft. by 21ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 21ft. into the required minimum front-yard setback
of 25ft. Nicole Ramirez made a motion to approve the variance based on the request.
Danny Murphree seconded and the motion was carried unanimously.
8. ZBA-18-13: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
5 S7.36'-2 N62.64'-3 Unit 1 of the Brock Addition, Plainview, Texas, Hale County,
also known as 1311 Ennis Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 20ft. by 24ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 17ft. into the required front-yard setback. The
carport would be 34 feet from the back of the curb. The applicant has a two car garage.
Applicant stated that he currently has a car and a motorcycle in the garage and the carport
would be for the two additional vehicles that he owns. It is of the staffs opinion that the
request be denied. Danny Murphree made a motion to deny the variance based on the
request. Mark Hardin seconded and the motion was carried unanimously.
9. ZBA-18-14: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
2 Lot 2 Unit 1 of the Thunderbird Addition, Plainview, Texas,Hale County, also
known as 2507 Lexinton Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 24ft. by 20ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 22ft. into the required minimum front-yard setback
of 25ft. Evan Weiss made a motion to approve the variance based on the request. Nicole
Ramirez seconded and the motion was carried unanimously.
10. ZBA-18-15: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
2 Lot 14 of the Simmons Addition, Plainview, Texas, Hale County, also known as
1310 Dallas Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 18ft. by 20ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 14ft. into the required minimum front-yard setback
of 30ft. Danny Murphree made a motion to approve the variance based on the request.
Evan Weiss seconded and the motion was carried unanimously.
11. ZBA-18-16: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
1 N18'-18 Lot 19 of the Roberson Addition, Plainview, Texas, Hale County, also
known as 1314 Vernon Street.

The applicant is requesting a variance or special exception in order to construct a metal
flat roof 23ft. by 24ft. carport (non-prefabricated) in the front-yard setback. The proposed
carport would encroach approximately 24ft. into the required minimum front-yard setback
of 30ft. Mark Hardin made a motion to approve the special request, but denied the
variance (side setback). Nicole Ramirez seconded and the motion was carried
unanimously.
