ZONING BOARD OF ADJUSTMENT MINUTES
MAY 24, 2018
The Zoning Board of Adjustment held a special public hearing on Monday, May 24, 2018 at 6:00
p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway, Plainview,
Texas, with the following members present:

STAFF MEMBERS PRESENT: Nick Mogg, Code Enforcement, Judy Rasher, Community
Service Secretary.
Mark Hardin opened the meeting at 6:00 pm, established a quorum and conducted the
consideration of the following items in the order presented. Nick Mogg read the staff reports, and
gave the recommendations for each item.
Approval of April 23, 2018 meeting minutes: Nicole Ramirez made a motion to approve
minutes of April 23, 2018 as presented. Evan Weiss seconded the motion. Motion carried
unanimously.
2. ZBA-18-17: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
1 Lot 6 of the Truitts Addition, Plainview, Texas, Hale County, also known as 1003
Wayland.
The applicant is requesting a variance or special exception to construct a metal flat roof
12 ft. by 24 ft. carport (non -prefabricated) in the front -yard setback. Staff observed six
constructed carports within the two block radius. Staff noticed that the neighborhood is
one where car garages are present, with applicant having an attached single car garage.
Staff's opinion that the applicant's request be approved. Evan Weiss made a motion to
approve the variance based on the request and allow the applicant to build a carport in
the front yard setback. Danny Murphree seconded and the motion was carried
unanimously.
3 ZBA-18-18: Consider the reauest of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
2 Lot 11 of the CB Jones Addition. Plainview. Texas. Hale Countv. also known as
1802 Jefferson Street.

The applicant is requesting a variance or special exception in order to construct a metal
flat roof 23ft. by 24ft. carport (non -prefabricated) in the front -yard setback. Staff observed
one constructed carport within a two block radius. Staff noticed that the neighborhood is
one where many of the homes were built with double car garages, with the applicant home
being one. Staff's opinion that the applicant's request be denied. Nicole Ramirez made
a motion to approve the variance based on the request with the stipulation to conform to
the building code. Evan Weiss seconded. Danny Murphree denied the request, with the
motion being 3 in favor and one opposed. The motion to approve the variance failed.
4. ZBA-18-19• Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37 2 2(H) Special Exceptions. The location described as Block
15 Lot 29 Unit 7 of the Thunderbird Addition, Plainview, Texas, Hale County, also
known as 1111 W 32nd Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 20ft. by 24ft. carport (non -prefabricated) in the front -yard setback. Staff observed
at least 8 carports within the front yard of homes within a two block radius, with three being
located on the same block. The applicant's home has a single car garage. Applicant states
that the garage is not wide enough to fit either of their vehicles. Staff recommends approval
as presented. Danny Murphree made a motion to approve the variance based on the
request. Nicole Ramirez seconded and the motion was carried unanimously.
5. ZBA-18-20: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Lots
17-18 of the Jordan-LaFont Addition, Plainview, Texas, Hale County, also known as

six carports within a two block radius, with two being on the same street. The applicant's
home does not have an attached garage. Staff recommends approval as presented. Evan
Weiss made a motion to approve the variance based on the request. Nicole Ramirez
seconded and the motion was carried unanimously.
6. ZBA-18-21: Consider the request of a special exception of the minimum front set
back authorizing the construction of a Carport under the City of Plainview Zoning
Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block
5 Lot 3 Unit 2 of the Thunderbird Addition, Plainview, Texas, Hale County, also
known as 1401 W 26th Street.
The applicant is requesting a variance or special exception in order to construct a metal
flat roof 20ft. by 20ft. carport (non -prefabricated) in the front -yard setback. Staff observed
six carports within a two block radius, with four carports being on the same block. The
applicant's home has an attached garage. Staff is of the opinion that the applicant's
request be approved. Danny Murphree made a motion to approve the variance based on
the request and allow the applicant to build the carport in the front yard setback. Evan
Weiss seconded and the motion was carried unanimously.
