R18-412 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, ORDERING A SPECIAL ELECTION BY THE VOTERS IN DISTRICT NO. 6, TO ELECT A PERSON TO FILL THE VACANCY AND UNEXPIRED TERM CREATED BY THE RESIGNATION OF THE COUNCILMEMBER FOR THAT DISTRICT; TO OCCUR ON SEPTEMBER 22, 2018 IN ACCORDANCE WITH THE TEXAS ELECTION CODE. WHEREAS, there exists a need for a special election for voters in District No. 6, to fill a vacancy in the seat for District No. 6, as required by the Charter of the City of Plainview; and WHEREAS, the election shall be held on the Saturday, September 22, 2018; and WHEREAS, Section 85.005 (d) of the Texas Election Code further requires that in an election ordered by a city, early voting by personal appearance at the main early voting polling place shall be conducted for at least 12 hours: (1) on one weekday, if the early voting period consists of less than six weekdays; or (2) on two weekdays, if the early voting period consists of six or more weekdays; and WHEREAS, all persons qualified to vote in said election under the Election Laws of the State of Texas shall be allowed to vote therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, THAT: SECTION 1 A special election shall be held in the City of Plainview, Texas on the 22nd day of September, 2018. Said election is to elect a Councilmember for District 6 to complete the unexpired term of Councilmember John Gatica. SECTION 2 Applications for a place on the City of Plainview Special Election ballot may be filed beginning June 22, 2018 through July 23, 2018 at 5:00 p.m. The applications should be delivered to the City Secretary at 901 Broadway, Plainview, Texas 79072. SECTION 3 All electors shall vote in the voting district in which said voter resides, and at the polling place provided for voting as designated in Section 4 of this Resolution. Resolution R18-412 Election Page 1 of 3 113 SECTION 4 The election shall be held in the designated district within the City, at the designated polling place within the district as designated below: CITY DISTRICT NO. 6 Voting Place: Senior Citizens Center 1107 Smythe Plainview, Texas SECTION 5 Early voting by personal appearance will be conducted each weekday at 901 Broadway, Plainview, Texas between the hours of 8:00 a.m. and 5:00 p.m. beginning on September 5, 2018 and ending on September 18, 2018. On Wednesday, September 12, 2018 and Tuesday, September 18, 2018 early voting by personal appearance will be conducted between the hours of 7:00 a.m. and 7:00 p.m. as required by Section 85.005 (d) of the Texas Election Code. SECTION 6 Said election shall have as its Early Voting Ballot Board presiding election judge, Remedios Christina Mclntee. On September 22, 2018, the polling place judges will be as follows: District 6 Polling Place Judge — Remedios Christina Mclntee SECTION 7 It is further provided that the hourly rate for presiding election judges shall not exceed $10.00 per hour, and the hourly rate for clerks shall not exceed $8.00 per hour. SECTION 8 A copy of this resolution shall also be served upon the election officials designated to hold the election. Notice of this election shall be given in accordance with the provisions of the Texas Election Code and returns of such notice shall be made as provided for in said Code.
