HomeMy WebLinkAbout08.20.18 ZBA MINUTESZONING BOARD OF ADJUSTMENT MINUTES August 20, 2018 The Zoning Board of Adjustment held a public hearing on Monday, July 30, 2018 at 6:00 p.m. The meeting took place in the Council Chambers of City Hall, 901 Broadway, Plainview, Texas, with the following members present: BOARD MEMBERS PRESENT: Mark Hardin, Danny Murphree, Nicole Ramirez, Evan Weiss, Chris Lefevre. STAFF MEMBERS PRESENT: Nick Mogg, Code Enforcement, Judy Rasher, Community Service Secretary. Mark Hardin opened the meeting at 6:00 pm, established a quorum and conducted the consideration of the following items in the order presented. Nick Mogg read the staff reports, and gave the recommendations for each item. 1. Approval of July 20, 2018 meeting minutes: Chris Lefevre made a motion to approve minutes of July 20, 2018 as presented. Evan Weiss seconded the motion. Motion carried unanimously. 2. ZBA-18-28: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 Lot 7 of the Day Addition, Plainview, Texas, Hale County, also known as 1511 Dallas. Applicant is wanting to construct a 24 X 24 metal flat roof carport in front of his home. The proposed carport would encroach approximately 24 feet into the required minimum front yard setback of 30 feet. Staff observed at least six similar carports within the front - yard of homes within a two -block radius, with three similar carports located within the same block. Staff also noticed that this particular neighborhood is one where garages are present with a majority of the homes in the area; the applicant's home does have an attached garage. Staff inquired to see if the current garage could be utilized for the protection of the applicant's vehicle, the applicant stated that the carport is for protection of the second vehicle. Staff did not observe another area on the lot for placement of the carport. 26 letters were sent out to the neighbors. Received 2 letters in favor. Staff recommends approval as presented. Chris Lefevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Danny Murphree seconded and the motion was carried unanimously. 3. ZBA-18-29: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 Lot 1 of the Carpenter Addition, Plainview, Texas, Hale County, also known as 2109 Houston Street. Zoning Board of Adjustment August 20, 2018 The applicant is wanting to construct a 20 x 20 metal flat roof carport in front of his home. The proposed carport would encroach approximately 20ft. into the required minimum front - yard setback of 25% Staff observed at least six similar constructed carports within the front yard of homes within a 2 block radius, with 3 similar carports located within the same block. This particular neighborhood is one where garages are not present with a majority of the homes in the area, the applicant's home does not have an attached garage. 25 letters were sent to the neighbors. Received 1 letter in favor. Staff's opinion that the applicant's request be approved. Evan Weiss made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Nicole Ramirez seconded and the motion was carried unanimously. 4. ZBA-18-30: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 9 Lot I of the Edgernere Addition, Plainview, Texas, Hale County, also known as 2800 W Mth Street. Applicant is wanting to construct a 24 x 20 metal flat roof carport in front of his home. The proposed carport would encroach approximately 20ft. into the required minimum front - yard setback of 25ft. Staff observed at least five similar carports within the front yard of homes within a 2 block radius, with 3 similar carports located within the same block. This particular neighborhood is one where garages are present with a majority of the homes in the area, the applicant's home does have an attached garage. The applicant stated that the garage is used, but the carport is for the additional vehicles. Staff did not observe room in the rear or side yard for a similar structure to be utilized for the protection of the vehicles. 24 letters were sent to the neighbors. Received 6 letter in favor and 1 opposed. The individual who opposed stated that a carport at this location may block drivers view of the cross street and sidewalk, endangering students walking to and from Edgemere Elementary school. Staff recommends approval as presented. Nicole Ramirez made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Chris Lefevre seconded and the motion was carried unanimously. 5. ZBA-18-31: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 6 Lot 3 of the Hillcrest Addition, Plainview, Texas, Hale CountValso known as 212 SE Alpine Street. The applicants are requesting a variance or special exception in order to construct a flat - roof 18ft. by 20ft. metal frame and roof carport (non -prefabricated) in the front -yard setback. Because the home is currently built into the required set back, the carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. Staff observed at least six similarly located and constructed carports within the front -yard of homes within a two -block radius, with two of the carports being located within the same block. Staff also noticed that this particular neighborhood is one where attached garages Zoning Board of Adjustment August 20, 2018 are not present with a majority of the homes in the area; The applicant's home does not have an attached garage. Staff recommends approval as presented. Homeowner's application shows the carport size to be 12 x 20. The staff reports indicate 18 x 20 carport. Homeowner and contractor were not present. Due to the conflict of the size of the carport, this case has been tabled. No action taken at this time. 6. ZBA-18-32: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 Lot 7 of the Carpenter Addition, Plainview, Texas, Hale County, also known as 2007 Houston Street. Applicant is wanting to construct a 20 x 24 metal carport in front of his home. The proposed carport would encroach approximately 20ft. into the required minimum front - yard setback of 25ft. Staff observed at least six carports within the front -yard of homes within a two -block radius, with two of the carports being located within the same block. Staff also noticed that this particular neighborhood is one where attached garages are not present with a majority of the homes in the area. The applicant's home does not have an attached garage. Staff did no observe room on the property for an alternate location of the carport. 24 letters were sent to the neighbors. Received 3 letter in favor. Staff recommends approval as presented. Danny Murphree made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. Evan Weiss seconded and the motion was carried unanimously. 7. ZBA-18-33: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 18 Lot 4 Unit 4 of the Thunderbird Addition, Plainview, Texas, Hale County, also known as 1319 Navajo Trail. Applicant is wanting to construct a 16 x 24 carport in front of his home. The carport would encroach approximately 24ft. into the required minimum front -yard setback of 25ft. When analyzing the area, staff observed at least six similarly located and constructed carports within the front -yard of homes within a two -block radius, with three of the carports being located within the same block. Staff also noticed that this particular neighborhood is one where attached garages are not present with a majority of the homes in the area; The applicant's home does not have an attached garage. Analyzing the applicants lot staff did not observe room in the rear or side yard for a similar structure to be utilized for the protection of vehicles. 23 letters were sent to the neighbors. Did not receive any letters in favor or oppose. Staff recommends approval as presented. Chris Lefevre made a motion to approve the variance based on the request and allow the applicant to build a carport in the front yard setback. ZBA-18-34: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoninq Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 1 Lot 4 of the Truitts Addition, Plainview, Texas, Hale County, also known as 1007 Wayland. Applicant is wanting to construct a 20 x 20 carport in front of his home. The carport would encroach approximately 20ft. into the required minimum front -yard setback of 25ft. When analyzing the area, staff observed at least six similarly located and constructed carports within the front -yard of homes within a two -block radius, with three of the carports being located within the same block. Staff also noticed that this particular neighborhood is one where attached garages are not present with a majority of the homes in the area; The applicant's home does not have an attached garage. Analyzing the applicants lot staff did not observe room in the rear or side yard for a similar structure to be utilized for the protection of vehicles. 20 letters were sent to the neighbors. Received one letter in favor. Staff recommends approval as presented. Nicole Ramirez seconded and the motion was carried unanimously. 9. ZBA-18-35: Consider the request of a special exception of the minimum front set back authorizing the construction of a Carport under the City of Plainview Zoning Ordinance Section 37.2.2(H) Special Exceptions. The location described as Block 2 Lot 11 of the CB Jones Addition, Plainview, Texas, Hale County, also known as 1802 Jefferson Street. Applicant is requesting a special exception to construct a 23 x 24 carport in front of his home. The proposed carport would encroach approximately 24ft. into the required minimum front -yard setback of 30ft. When analyzing the area, staff observed one similarly located and constructed carports within the front -yard of homes within a two -block radius. Of the existing area, none of them are built within the same block of Jefferson St. Staff also noticed that this particular neighborhood is one where many of the homes were built with double car garages, the applicant's home being one. It does not appear that there is another practical location for the proposed carport on the applicant's lot. It is of staff's opinion that the proposed carport would not match the general streetscape and aesthetics of the neighborhood. Applicant is a disabled veteran with congestive heart failure and kidney failure. He is on dialysis 3 times a week. Applicant states his garage is too small and has difficulties getting in and out of his vehicle. This is the second time that staff has presented this case to the ZBA. The applicant was granted another proposal by the community development manager due to the ZBA only having four members at the previous hearing. It is of staff's opinion that the request be denied. Evan Weiss made a motion to approve the variance and allow the applicant to build a carport in the front yard setback. Chris Lefevre seconded and the motion was carried unanimously.
