Mayor Wendell Dunlap presided. Councilmembers present were: Nelda VanHoose- m— District 1, Larry Williams -District 2, Norma Juarez -District 3, Teressa King -District 4, 6" Susan Blackerby-District 5 and Oliver Aldape-District 7. Staff members present were: Jeffrey Snyder -City Manager, Matt Wade -City Attorney, Tim Crosswh ite-Di rector of Public Works, Sarianne Beversdorf-Director of Finance, Ken Coughlin -Chief of Police, Isauro Gutierrez -Director of Information Technology, Jeff Johnston -Community Development Manager, Paul Kite -Assistant Director of Utilities, Melinda Brown -Main Street Manager and Belinda Hinojosa-City Secretary. An Ordinance of the City Council of the City of Plainview, Texas Approving a Negotiated Settlement Between the Steering Committee of Cities Served by Atmos ("Cities") and Atmos Energy Corp., West Texas Division Regarding the Company's 2018 Rate Review Mechanism Filings; Declaring Existing Rates to be Unreasonable; Adopting Tariffs that Reflect Rate Adjustments Consistent with the Negotiated Settlement; Finding the Rates to be Set by the Attached Settlement Tariffs to be Just and Reasonable and in the Public Interest; Approving an Attached Exhibit Establishing a Benchmark for Pensions and Retiree Medical Benefits; Approving an Attached Exhibit Regarding Amortization of Regulatory Liability; Requiring the Company to Reimburse Cities' Reasonable Ratemaking Expenses; determining that this Ordinance was passed in accordance with the Requirements of the Texas Open Meetings Act; Adopting a Savings Clause; Declaring an Effective Date; and Requiring Delivery of this Ordinance to the Company and the Cities' Legal Counsel. An Ordinance of the City of Plainview, Texas, Adopting and Approving the Budget for the Fiscal Year Beginning October 1, 2018 and Terminating September 30, 2019 and Making Such Appropriations for Each Department, Project and Account; Cumulativeness Clause; Conflicts Clause; Severability Clause; and Effective Date. (Ordinance No. 18- 3680 - Second Reading) Presenter: Jeffrey Snyder, City Manager This Ordinances adopts the budget for 2018-2019. An action to ratifv the Property Tax Increase Reflected in the FY 2018-2019 Budget Presenter: Jeffrey Snyder, City Manager This ratifies the property tax increase reflected in the 2018-2019 Budget. Motion: Move to ratify the property tax increase reflected in the budget for Fiscal Year 2018-2019 Budget Motion by Mayor Pro Tem Blackerby, seconded by Councilmember VanHoose Vote: 7 — 0 Motion carried 7. An Ordinance for the City of Plainview, Texas Setting the Tax Rate and Levying Municipal Ad Valorem Taxes for the Year 2018• Directing the Assessment and Collection Thereof; Severability Clause; Cumulativeness Clause; Conflicts Clause; Repealer; and Effective Date. (Ordinance No. 18-3681 — Second Reading) Presenter: Jeffrey Snyder, City Manager This ordinance includes a tax rate of $0.8318 per $100 valuation. Of this amount, $0.6312 per $100 valuation is provided for maintenance and operations and $0.2006 per $100 valuation is for debt service. Motion: Move that the property tax rate be increased by the adoption of a tax rate of eighty-three and eighteen hundredths cents ($.8318), which is effectively a 33.6% increase in the tax rate which represents the sixty-three and twelve hundredths cents ($.6312) approved by the City Council for maintenance and support of the General Fund and twenty and six hundredths cents ($.2006) for interest and sinking fund as approved by the voters. An Ordinance of the City of Plainview Texas Amending Chapter 13, "Utilities" of the Code of Ordinances of the City of Plainview Texas, Cumulativeness Clause; Lo Repealer; Severability Clause; and Effective Date (Ordinance No. 18-3682 — Second Readin City Council Minutes September 25, 2018 Page 3 of 5 CAU Presenter: Jeffrey Snyder, City Manager This Ordinance includes a three percent increase to each step in the Water Conservation Step Rate Structure. Motion: Move to adopt Ordinance No. 18-3682 on second reading Motion by Councilmember King, seconded by Councilmember Aldape Vote: 7 — 0 Motion carried 9. An Ordinance of the City of Plainview Amending Ordinance No. 17-3662 to Appropriate Funds in the General Fund and Various Revenue and Capital Funds Pursuant to Section 5.07 (A) And (D) of the Plainview City Charter Allowing for Supplemental Appropriations in the 2017-2018 Budget; Cumulativeness Clause; Conflicts Clause; Severability Clause; And Effective Date (Ordinance No. 18-3683 — Second Reading) Presenter: Jeffrey Snyder, City Manager This Ordinance amends the Fiscal Year 2017-2018 Budget. An Ordinance Amending The Zoning Map of the City of Plainview, Texas for the Change of Zoning From a Residential Zoning District ("R-1") to a Commercial General Business ("C-2") Zoning District. Said Tract Of Land Is Lot 1, Thruston Subdivision Unit No. 1, City of Plainview, Hale County, Texas; Cumulativeness Class; Conflicts Clause• Severability Class; and Effective Date. (Ordinance No. 18-3684 — First Reading) Presenter: Jeff Johnston, Community Development Manager Public Hearing: No Comment — Closed at 7:25 p.m. This Ordinance approves the request of Kent Webb to rezone the property located at 315 Ennis Street from a R-1 Zoning District to a C-2 Zoning District. Motion: Move to adopt Ordinance No. 18-3684 on first reading Motion by Councilmember Williams, seconded by Councilmember Juarez Vote: 7 — 0 Motion carried 11.
