RESOLUTION NO. R18-424
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW,
TEXAS, ORDERING A RUNOFF ELECTION BY THE VOTERS IN
DISTRICT NO. 6, TO ELECT A PERSON TO FILL THE VACANCY AND
UNEXPIRED TERM CREATED BY THE RESIGNATION OF THE
COUNCILMEMBER FOR THAT DISTRICT; TO OCCUR ON NOVEMBER
15, 2018 IN ACCORDANCE WITH THE TEXAS ELECTION CODE.
WHEREAS, a special election was held on September 22, 2018, the City Council
having canvassed the returns of the Special Election and having determined that no
candidate for the office of Councilmember District 6 received a majority of the votes cast
for the office and that Evan Weiss received the highest number of votes and Lionel A.
Garcia received the second highest number of votes cast for Councilmember District 6;
and
WHEREAS, in accordance with the statutes of the State of Texas and the Charter
of the City of Plainview, a runoff election shall be held in and for the City of Plainview; and
WHEREAS, the runoff election shall be held on November 15, 2018; and
WHEREAS, said runoff election is to fill the vacancy left in District 6 by the
resignation of John Gatica; and
WHEREAS, Section 85.005 (d) of the Texas Election Code states that in an
election ordered by a city, early voting by personal appearance at the main early voting
polling place shall be conducted for at least 12 hours: (1) on one weekday, if the early
voting period consists of less than six weekdays; or (2) on two weekdays, if the early
voting period consists of six or more weekdays; and
WHEREAS, all persons qualified to vote in said election under the Election Laws
of the State of Texas shall be allowed to vote therein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLAINVIEW, TEXAS, THAT:
SECTION 1
A runoff election shall be held in the City of Plainview, Texas on the 15th day of
November, 2018. Said election is to elect a Councilmember for District 6 to complete the
unexpired term of Councilmember John Gatica.
SECTION 2
All electors shall vote in the voting district in which said voter resides, and at the
polling place provided for voting as designated in Section 3 of this Resolution.

SECTION 4
The runoff election shall be held in the designated district within the City, at the
designated polling place within the district as designated below:

Voting Place: Plainview Adult Activity Center
(Hale County Senior Citizens Center)
1107 Smythe
Plainview, Texas
SECTION 5
Early voting by personal appearance will be conducted each weekday at 901
Broadway, Plainview, Texas between the hours of 8:00 a.m. and 5:00 p.m. beginning on
October 29, 2018 and ending on November 9, 2018. On Thursday, November 1, 2018
and Thursday, November 8, 2018 early voting by personal appearance will be conducted
between the hours of 7:00 a.m. and 7:00 p.m. as required by Section 85.005 (d) of the
Texas Election Code.
SECTION 6
Said election shall have as its Early Voting Ballot Board presiding election judge,
Roxanne Escobar. On November 15, 2018, the polling place judges will be as follows:
District 6 Polling Place Judge — Roxanne Escobar
SECTION 7
It is further provided that the hourly rate for presiding election judges shall not
exceed $10.00 per hour, and the hourly rate for clerks shall not exceed $8.00 per hour.
SECTION 8
A copy of this resolution shall also be served upon the election officials designated
to hold the election.
Notice of this election shall be given in accordance with the provisions of the Texas
Election Code and returns of such notice shall be made as provided for in said Code.
