CITY COUNCIL WORKSESSION
July 8, 1999
The Plainview City Council met in a Worksession on Thursday, July 8, 1999, at the
Plainview Convention Center. Notice of this meeting was posted in City Hall at
11:30 a.m. on July 4, 1999. Mayor Lloyd C. Woods presided. Councilmembers
present were: Sam Parker-Precinct 1, Ross Owen-Precinct 5, and Bobby
McGehee-Precinct 6. Councilmembers absent were: Mary Jane Shanes-Precinct
2, Rey Roses-Precinct 3, Mike Hutcherson-Precinct 4 and Irene Favila-Precinct 7.
Staff members present: Jim Jeffers-City Manager, Gary Glass-Fire Chief, Dale
Simpson-Civil Service Director, Cindy Gasaway-Main Street Coordinator, Norman
Huggins-Director of Finance, Will Mull-Police Chief, John Berry-Director of Public
Works, Sean Lanier-Asst. Director of Public Works, and Karen McBeth-city
secretary.

North Joliet Speed Limit 35 mph - An Ordinance of the City of Plainview,
Texas amending Section 24-158 of the Code of Ordinances to establish a
maximum rate speed for vehicles traveling Northbound and Southbound on
Joliet Street; Providing for a penalty; Cumulativeness clause; Conflicts
clause; Severability clause; And effective date. First Reading.
Chief of Police Will Mull reviewed an area of North Joliet Street, from 32nd St. to
Industrial Boulevard, which presently has a posted speed limit of 30 miles per hour.
Due to the uninhabited area in which it falls, the open view and flatness of the
roadway, this stretch of paved street could easily accommodate a 35 mile an hour
speed limit without impairing public safety. This speed limit would expedite traffic in
this area.
An Ordinance amending Ordinance 98-3186 to Appropriate Funds
within the Fire Department to finance completion of the S.W. 3rd Fire
Station and to finance needed repairs on equipment for the fiscal
year 1998-1999. First Reading.
Fire Chief Gary Glass reviewed the proposed ordinance and explained the latest
projected costs of the new fire station resulting in the need to appropriate additional
funds to this project. Included are radios & installation costs, furnishings,

landscaping, telephone system wiring, and some other small items. Due to
maintenance problems and needed repairs on a booster truck and equipment,
these costs are included in the budget amendment. The budget increase is
$281,873.44 ($266,373.44 Fire Station, $15,500.00 Equipment repair and
maintenance). Councilmember Sam Parker asked what the $25,000 change order
covered? Mr. Simpson said a change order has not been approved yet. Pending
change orders include bathroom cabinets, color of metal for the roof, and additional
concrete in entry way. Councilmember Parker asked for the name of the engineer
used for this project. Mr. Simpson said he would supply such.
Communication Towers - An Ordinance amending the Zoning
Ordinance of the City of Plainview, Hale County, Texas, Section 8,
Radio, Television, and Microwave Towers; Cumulativeness clause;
Conflicts clause; Severability clause; And effective date. F~rst reading.
Director of Public Works John Berry explained the proposed ordinance would
dictate the setback footage, location, signs, flags, attachments and other issues like
landscaping. Mr. Jeffers said that with so many communication towers being built
in the area the City is looking ahead to have a plan in place prior to need. City
Attorney Wally Hatch said State law pre-empts much of what a municipality may
dictate. Councilmember Parker asked if an environmental assessment for such
towers would be necessary? Mr. Hatch said, no. Councilmember Parker said he
would like to see an environmental clause put in the ordinance.
City Council Reports. Mayor Woods reported on the TML Board Meeting he
recently attended. He said the work TML did on annexation and franchising
with the last legislature was good.
Ordinance No. 99-3220. An Ordinance amending the zoning map of the City of
Plainview, Texas to rezone property located at 405 N. Ennis Street from a
Single Family Residential (R-l) Zone to a Multi-Family (MF-1) District;
Cumulativeness clause; Conflicts clause; Severability clause; And effective
date. Second Reading.
Without a quorum present, action was not taken on this item.
5. Establish 1999-2000 Budget Workshop for July 29, 1999, 9:00 a.m., in the
City Council Chambers at 901 Broadway, No one objected to time schedule.
Review of S.B. 441 - Sales Tax Exemption. Mr. Jeffers said this bill provided
that clothing costing less than $100, purchased on the first Friday in August,
through the first Sunday, in August, at midnight, would be tax free. There is a
provision for cities to opt out of the exemption. No one expressed interest in the
exemption.

Review of S.B. 1851 - Public Information Act. Mr. Jeffers said this legislation
exempted discussions of economic development incentives from public
disclosure, and allows the council to hold Closed Meetings on such
deliberations. Staff briefings have been eliminated.
Review of H,B. 156 - Open Meetings. Mr. Jeffers told the Council this gave
the governing body of a muniCipality an affirmative defense against prosecution
when acting on written adviCe by an attorney.
Mayor Woods adjourned the meeting at 12:45 p.m.
