CITY OF PLAINVIEW
May 20, 1999
The City Council of the City of Plainview met in a Worksession on Thursday, May 20, 1999, at 11:30
a.m. at the Plainview Convention Center. City Council Members present: Mike Hutcherson, Sam
Parker, Mary Jane Shanes, Rey Rosas, Ross Owen, Irene Favila, and Mayor Lloyd Woods.
Staff. members present: Gary Glass, John Berry, Jim Jeffers, Del Essary, Cindy Gasaway, John
Castro, Chief Mull, and Wally Hatch.
Media present: Richard Orr - Plainview Daily Herald.

2. Review City Council Agenda for May 25, 1999.
Consider final plat on La Mesa Subdivision Unit #8. They have met all the
requirements and made the requested changes. Including changing the unit number,
lot number, and presenting us the plans and specifications for water and street
improvements. This project is recommended for approval by the P&Z. Our
subdivision ordinances requires the developer pay for everything, in this case the
developer is Gabriel Farms.
There have been no comments in reference to the upcoming Plumbing Code
amendment, Ordinance No. 99-3216.
Repaving of parking lots South of City Hall. In this year's budget $108,000 is
appropriated. Parkhill, Smith, & Cooper estimated total cost around $225,000;
Thrasher, lowest bidder, bid $146,461.25. Half of the alley cost will be refunded to
the City by property owners in that area. After this project is complete there will be
no more cost because concrete is maintenance free. When this project is done, the
water line will be replaced but the sewer line will not. The concrete will be disposed
of in the Baker pit and the asphalt to a vacant lot. The City will absorb the cost of
moving the concrete however.
Tuesday the Council Meeting is a Precinct 3 Meeting and will meet at Lakeside
Elementary.
WalMart Distribution Center asked for an extension of the Specific Use Permit for
the property on 54 Street. It is almost the same as what it was before except this
specific use permit will expire within 24 months. One couple expressed concern
about the truck traffic on 5th Street but John Castro's office has been assured the

problem is not with WalMart trucks. The Planning and Zoing Commission
recommended 24 months which will prevent WalMart from having to come back
again in a year. WalMart plans to have another distribution center built in Kansas in
two years, which should relieve the need for additional warehouse space.
Panhandle Regional Electrical Licensing Association. John Castro explained once
the resolution was signed by PRELA some adjustments would be made to the
Electrical Code.
Rick Cox will present the annual report for Vector Control. The City will start
ground spraying this weekend.
Mr. Jeffers told the Council to be prepared for our Westgate residents to speak out
against the proposed park. There are also rumors the City will be receiving a petition
from those who oppose the idea.
There were no City Council Reports.
Mr. Jeffers said the City has been asked to give the Downtown Beautification Committee
more time at looking at the Broadway Beautification project in hopes of cutting costs.
Councilmember Ross Owen requested this not be called beautification since it is a required
project for ADA. We have until September to apply for the grant. The Beautification
Committee will have a recommendation in about 4-6 weeks. If we are awarded the grant we
would find out in late December or January.
An informational presentation in reference to Conflict of Interest was presented by Wally
Hatch. The Local Government Code's Chapter 171 and Chapter 39 of the Penal Code
address several situations. If you violate Chapter 171 of the Local Government Code it is a
class "A" violation. You do not have to have intent of breaking the law; just intent to do
whatever action you did. This not only includes you directly but also includes relatives, so
please keep this in mind. Chapter 39 of the Penal Code has to do with the misuse of official
information. Mr. Jeffers pointed out that he would discourage abstaining from voting if no
conflict of interest exists because later someone could fred fault with that course of action.
He recommends that you should do what you feel comfortable with and if any Councilmember
has a question, always ask. Mr. Hatch also warned, you need to be careful about making
promises in other elected positions because you could vacate your current office in the
process.
Everyone would like to continue trying out the paperless agenda.
Miscellaneous Topics. East 5* sewer project was briefly discussed and Councilmember Irene
Favila asked how we decided who was low income. John' Castro informed her that they
knocked on 80% of the doors and had them fill out a form. Councilmember Mary Jane

Shanes asked when Susan Wilson would further discuss the Practical Parenting Program,
which will be addressed at the next Worksession. The Budget Worksession will be in July.
John Castro stated there is one grant pending and that is for a home rehab. It will not be
reviewed by the RRC though, instead a committee from SPAG will review it.
