HomeMy WebLinkAbout99 1012 min18 MINUTES CITY COUNCIL MEETING City of Plainview October 12, 1999 The Plainview City Council held a meeting at 7:30 p.m., Tuesday October 12, 1999 in the Council Chambers of Plainview City Hall, 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Lloyd Woods opened the meeting and Mayor Pro-Tem Ross Owen conducted the meeting. Councilmembers present were: Sam Parker-Precinct 1, Mary Jane Shanes-Precinct 2, Rey Rosas-Precinct 3, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5, and Bobby McGehee-Precinct 6. Councilmember Irene Favila was absent. Staff members present: Jim Jeffers-City Manager, John Castro-Director of Community Services, Wally Hatch-City Attorney, John Berry-Director of Public Works, Dale Simpson-Civil Service Director, Gary Glass-Fire Chief, William Mull-Police Chief, Sharon Wyatt-Main Street Coordinator, and Karen McBeth-city secretary. News media present: Richard Orr-Plainview Daily Herald and Wayland Baptist University television crew. Guests present: Mark Wyatt, Kacy Wyatt and Priscilla Sammann. OPEN MEETING Invocation - The Honorable Bobby McGehee Pledge of Allegiance - The Honorable Lloyd C.Woods Recognitions - City Manager Jim Jeffers introduced Sharon Wyatt, the new Main Street Coordinator for the City of Plainview. He also introduced Mark Wyatt, her husband, and Kacy Wyatt, her daughter. Mayor Pro Tem Ross Owen read a Proclamation declaring the week of October 18, 1999 "Business and Professional Womens Week." 3. Consent Calendar - Councilmember Shanes moved to approve the Consent Calendar and Councilmember Hutcherson seconded the motion. Mayor Woods and Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen and McGehee voted "yes" on the motion. None voted against. a) b) c) d) e) Minutes of September 23 and 28, 1999 were approved. Departmental Reports were accepted. Expenditures were approved. Excused Absence was granted Councilmember Rey Rosas for the meeting of September 23, 1.999 and Irene Favila for October 12, 1999. Consider appointments: Norvene Owen was appointed an alternate member of the Planning and Zoning Commission, and Barbara Green was reappointed to the Library Board. Minutes 99 1012 Page I of 3 10 REGULAR AGENDA ITEMS 4. Elections. Ordinance No. 99-3232. An Ordinance changing the designated polling place for Precinct 6. Cumulativeness clause; Conflicts clause; And effective date. SECOND READING. There was no comment on the ordinance. Councilmember McGehee moved that Ordinance No. 99-3232 be approved and Councilmember Rosas seconded the motion. Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion. None voted against. Ordinance No. 99-3233. An Ordinance amending the Code of Ordinances of the City of Plainview, Hale County, Texas, to amend Chapter 12, Food and Food Handlers; Cumulativeness clause; Conflicts clause; Severability clause: And effective date. FIRST READING. Director of Community Services, John Castro, explained the ordinance amends City Code to clarify the language and keep pace with State Code. Councilmember Rosas made the motion to approve Ordinance No. 99-3233 and Councilmember Hutcherson seconded the motion. Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, and McGehee and Mayor Woods voted "yes" on the motion to approve. None voted against. 6. Annual Report - Legal department. Wally Hatch, City Attorney, reported that since last year he has a new legal.assistant and his department has handled 507 municipal court cases. He said the City has three litigation cases on-going, his office filed 50 assessment liens, with 37 more prepared for filing, and has filed five demolition liens. There are two right-of-way projects he is working on. The TCA cable franchise is finished and he is preparing the franchise agreement with Southwestern Bell. 7. Open Forum. Hear citizen's requests and comments per Open Forum Policy. No one spoke. 7a. Councilmember Bobby McGehee spoke on behalf of Breast Cancer Awareness Month. Closed Meeting. Deliberate the appointment, employment, evaluation, reassignment or duties, removal, discipline or dismissal or a public officer or employee, board, commission, or committee member, or to hear complaints or charges. [Tex. Gov't. Code Section 551.074]. City Attorney annual evaluation. At 7:45 p.m. Mayor Woods made the motion to meet in a Closed Meeting and Mike Hutcherson seconded the motion. Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee and Mayor Woods voted "yes" on the motion. None voted "no." The Council moved into a Closed Meeting. The Council reconvened in Open Session at 9:45 p.m. 9. Consider possible action per City Attorney annual evaluation. Councilmember McGehee moved the City Attorney be granted a 2% additional increase in salary, over the 4% COLA Minutes 99 1012 Page 2 of 3 2O raised already scheduled. The motion was seconded by Councilmember Hutcherson and Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee, and Mayor Woods voted "yes" unanimously. 10. Adjournment. Councilmember Mary Jane Shanes moved the meeting adjourn. Councilmember Hutcherson seconded the mOtion and the motion carried unanimously.
