Convention Center, 2902 West 4th Street, Plainview~ Texas. The agenda for this meeting
was posted in City Hall at 11:00 a.m. on October 1, 2001. Mayor Lloyd C. Woods
presided. Councilmembers present were: Sam Parker-District 1, Mary Jane Shanes-
District 2, Rey Rosas-District 3, Mike Hutcherson-District 4, Ross Owen-District 5, Buddy
McGehee-District 6 and Irene Favila-District 7.
Staff members present were: James P. Jeffers-City Manager, John Berry-Director of
Public Works, Gary Glass-Fire Chief, Larry Gould-Chief Building Inspector, Wally Hatch-
City Attorney, Pat Hernandez-Municipal Court Judge, William Mull-Chief of Police, Dale
Simpson-Director of Civil Service, Matthew Tsakanikas-Main Street Coordinator, Greg
Zielinksi-Code Enforcement Officer, and Belinda Hinojosa-City Secretary.
Guests present were: Jim Ferrell, Brian Thomas, Kevin Carter, Christ LeFevre, and
Debra Rodriguez.

Councilmember Shanes delivered the invOcation.
The Council and Staff then reviewed the agenda for the City Council meeting of October
9, 2001.
Greg Zielinkski presented information on Ordinance No. 01-3307, an Ordinance of the
City of Plainview, Texas amending Chapters 6, 10 and 20 of the Plainview Code of
Ordinances to provide for registration and bonding of contractors and to adopt the
most recent addition of the National Electrical Code, Severability Clause,
Cumulativeness Clause; Conflicts Clause; and Effective Date. He advised the Council
that he had contacted a couple of insurance agents and was advised you could purchase
a surety bond for $50.00 to $85.00. He stated the bonding aspect would give
homeowners assurance; but would only cover code violations. There are three parts to
the ordinance: surety bond; registration of all contractors with a $10.00 fee and update of
the national electrical code.
Mr. Jeffers advised the Council regarding Soto Street formerly named Rock Island that
there were three options: to deny Rock Island request, agree to change Rock Island
street name back, or refer back to committee. Several Councilmembers expressed
interest in referring it back to the committee. Mayor Woods moved that the street name
change be referred back to the committee with the committee studying all options with the
community. Councilmember McGehee seconded. Councilmember Rosas called for the
question. Councilmember Favila seconded the call. The motion calling for the question
carried unanimously. On the motion to refer the street name change back to the
committee with the committee studying all options with the community Mayor Woods,
Councilmembers Hutcherson, Owen, Shanes and McGehee voted in favor.
Councilmembers Parker, Favila and Rosas voted against. The motion carried.
The Council reviewed the Chamber of Commerce hotel/motel budget for 2001-2002.
In it was a 5% decrease of personnel services, which had been discussed previously as
something the Chamber was to work on lowering. The projected budget for the year is
$144,000.00. Budget approval will be on the October 23, 2001 agenda.

Mr. Jeffers reviewed three upcoming constitutional amendments for the November 6,
2001 special election. Proposition 10 was introduced by Senator Robert Duncan. It
would allow a city to decide whether or not inventory in public warehouses would be
exempt from taxation: He recommended the city be opposed to such a measure.
Proposition 11 has been previously reviewed by the Council. It allows schoolteachers, a
retired schoolteacher, or a retired school administrator to receive compensation for
serving on the City Council. Proposition 15 would amend the constitution to create the
Texas Mobility Fund. If passed the highway commission would be able to borrow money.
Councilmember Rosas moved that the City publicly express opposition to Proposition 10
and express support for Propositions 11 and 15. The motion duly seconded by
Councilmember Shanes carried by unanimous vote.
Mr. Jeffers advised the Council that Matthew Tsakanikas had recently completed the City
of Plainview's Citizen's and Visitor's Guide. He said that Mr. Tsakanikas was
responsible for the layOut. The Chamber joined in paying a portion of the printing.
Mr. Jeffers advised the Council that the Texas Legislature had provided the option for five
year vesting. He stated it would be good for the employees, but it was questionable as to
whether it was good or bad for the City. It could be possible that it would allow the City to
recruit employees, especially older employees who did not have too much time to
retirement age. It would probably not help in the retention of employees. The estimated
cost to the City for 2002 would be $4,752.00. Judge Hernandez, who was appointed by
the Governor as a member of the Texas Municipal Retirement System board advised
the Council that she and TMRS felt it was a good thing. Bigger cities all feel it is good
and would allow them to keep up with the pdvate sector. Councilmember Shanes moved
that the City change the vesting period to five years. The motion duly seconded by
Councilmember Rosas carried by unanimous vote.
Discussion on Ordinance 01-3306, an Ordinance Amending the Zoning Map of the City of
Plainview, Texas for designating a portion of the Central Business District as a Design
Historic Overlay, Plainview, Texas, Cumulativeness Clause; Conflict Clause;
Severability Clause; and Effective Date was postponed for a later date.
The closed meeting to deliberate evaluation of a public officer or employee was
postponed until the October 9, 2001 City Council meeting.
Mayor Woods adjourned the meeting at 12:55 p.m.
