TING City of Plainview March 23, 1999 The Plainview City Council met at 7:30 p.m., Tuesday, March 23, 1999 in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Councilmembers present were: Sam Parker-Precinct 1, Mary Jane Shanes-Precinct 2, Rey Rosas- Precinct 3, Mike Hutcherson-Precinct 4, Ross Owen-Precinct 5, Bobby McGehee-Precinct 6, and Irene Favila-Precinct 7. Staff members present were: Jim Jeffers-City Manager, Dale Simpson-Civil Service Director, Will Mull-Police Chief, Norman Huggins-Director of Finance, Wally Hatch-City Attorney, John Castro- Director of Community Services, John Berry-Assistant Director of Public Works, Gary Glass-Fire Chief, Pat Hernandez-Municipal Judge, and Karen McBeth-city secretary. News media present: Richard Orr-Plainview Daily Herald and Wayland Baptist University television crew. OPEN MEETING Invocation - The Honorable Bobby McGehee Pledge of Allegiance - The Honorable Ross Owen 2. Recognitions - There were none. 3. Consent Calendar - Councilmember Favila made a motion to adopt the Consent Calendar as presented. Councilmember Owen seconded the motion. Mayor Woods and Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee and Favila voted "yes" on the motion. a) b) c) d) Minutes of March 4, 1999 and March 9, 1999 were approved. Departmental Reports were accepted. Expenditures were approved. Excused Absences - None requested. e) Budget amendment. Ordinance No. 99-3209. An ordinance of the City of Plainview amending ordinance No. 98-3196 to appropriate water and sewer funds in the 1998- 1999 Budget for renovations to the Milwee lift station. Approved. 0 Budget amendment. Ordinance No. 99-3210. An ordinance of the City of Plainview amending Ordinance No. 98-3196 to appropriate funds in the 1998-1999 Budget to purchase a dump bed for Parks Department truck. Approved. An ordinance of the City of Plainview amending ordinance no. 98-3196 to appropriate funds in the 1998-1999 Budget for Animal Control building maintenance. Approved. h) Consider award of bid on Chemical Storage building. Bids were received from: Pharr & Co. of $60,836.00; Corporate Builders of $89,950.00; and Plains Builders of $59,877.00. The bid was awarded to Plains Builders at a bid price of $59,877.00. i) Consider approval of the City of Plainview Emergency Management Plan. The plan was approved. J) Consider approval of the Preliminary Plat for LaMesa Subdivision, Unit #7. The preliminary plat was approved. Consider appointment to the Planning & Zoning Commission and Electrical Board. Billy Rollins was appointed to the Planning and Zoning Commission. REGULAR AGENDA ITEM~ Review and consider action on the Specific Use Permit, 2801 Olton Road, Wal-Mart Distribution Center, to operate a motor freight terminal per ordinance No. 98-3173. John Castro, Director of Community Services introduced Mr. Ross of the Wal-Mart Distribution Center. Mr. Ross said Wal-Mart has appreciated the Council allowing them to use the building at 2801 Olton Road as a motor freight terminal, through a Specific Use Permit. He said he was confident Wal-Mart will be requesting the use of this building, under the same set of regulations, for another 12 months. Mayor Woods said he drove by the facility on a daily basis and has never noticed a problem. Councilmember Owen asked if the building was full? Mr. Ross said, yes, 100%. Councilmember Favila asked if young people using the parking lot presented a problem? Mr. Ross said, no, not that he was aware of. Councilmember Owen moved to continue the Specific Use Permit. Councilmember Rosas seconded the motion. Mayor Woods, Councilmembers Parker, Shanes, Rosas, Hutcherson, Owen, McGehee and Favila voted "yes" on the motion. None voted against. 5. Plainview Municipal Court annual report. Municipal Judge Pat Hernandez reported that from January 1, through December of 1998 a total of 7,029 citations issued, with 5,495 being disposed of by payment, defensive driving courses, deferrals and trials. There were 414 warrants served through the police department. There are 1,120 warrants still active at this time. A total of $354,956.52 was collected. There were 31 juvenile magistrate warnings issued. Judge Hernandez taught 36 hours for the Reserve Police Academy. Several changes are in the planning stages, most significantly is the computerization of court records. Other changes will include having monthly bench trials and jury trial to avoid creating a backlog of Minutes of March 23, 1999 Page 2 of 3 cases. During the middle of the year Judge Hemandez began having Teen Court twice a month. In 1998 165 teens took advantage of this program. These teens worked 1,218 hours of community service through organizations in the community and served 336 hours of jury service. On May 6, 1998, Municipal Court sponsored Student Government Day and a total of 124 seniors participated in this event. The students were introduced to the various sections of the police department, fire department, personnel, municipal court, and Main Street and were able to ask questions of each. The court continues to work with other agencies in our alcohol awareness programs, tobacco awareness programs and community service projects. The court staff will continue in their certification process. There are three levels of certification exams that must be passed and is required by the State of Texas. Judge Hernandez will continue with the yearly training hours required by the State for her office. 6. Open Forum. Hear citizens requests and comments per Open Forum Policy. No one spoke. 7. Council commercial for charity. Councilmember Rey Rosas spoke about the Salvation Army. He said the Salvation Army is a non-profit organization that was established in Plainview in 1942. The Salvation Army is located at 210 Ash Street, office hours are from 9:00 to 5:00, Monday through Friday. It operates a Thrif~ Store located at 612 Ash Street. It provides food, rent, utilities, lodging, clothing and other services, all based on an individual client, individual situations, and according to the resources available. The Salvation also has children's programs, adult programs, and church service. During the Christmas season giRs of toys, food baskets and other items are given to those in need. The whole community of Plainview works together gathering canned goods and other food staples. This past Christmas 1,334 people were assisted with Christmas. A total of 18 service clubs helped collect money with the Christmas Kettle program. Mr. Rosas asked those in the community who wished to become involved in a worth while organization to consider working with the Salvation Army. Adjournment. Councilmember Owen moved to adjourn the meeting. Councilmember Rosas seconded the motion. The motion carded unanimously.
