HomeMy WebLinkAbout05-3453 ord372 WATER RATE ADJUSTMENT ORDINANCE NO. 05-3453 AN ORDINANCE OF THE CITY OF PLAINVIEW, AMENDING CHAPTER 25 ARTICLE I/ ENTITLED "RATES AND CHARGES" OF THE CODE OF THE CITY OF PLAINVIEW, TEXAS; CUMULATIVENESS CLAUSE; CONFLICTS CLAUSE; SEVERABILITY CLAUSE; AND EFFECTIVE DATE. WHEREAS, the City of Plainview, Texas, provides water to its citizens; and WHEREAS, the City Council is charged with the responsibility of establishing water rates in order to insure that the services provided are maintained at an acceptable level; and WHEREAS, the City Council finds that an increase in the fees charged for such services is necessary to insure the continued viability of said program; NOW, THEREFORE, the City of Plainview hereby ordains that Chapter 25 Article II entitled "Rates and Charges" of the Code of the City of Plainview, Texas is hereby amended and shall henceforth read as follows: Section I. Sec. 25-32. Cash deposit to be made with application; bond in lieu of deposit As security to guarantee the payment for all water and services furnished by the city, a deposit shall be made with the waterworks department at the time of making application for water service. The minimum amount of which shall be as follows: Residential: Single family (per meter) $50.00 Multifamily on one meter First unit $50.00 Each additional unit $20.00 Commercial: Estimated I ~ times monthly bill or minimum of $50.00 Sec. 25-36. Cuttin,q off of service for nonpayment; fee a. It shall be the duty of the director of finance, upon the failure or refusal of any person, firm or corporation to promptly pay within ten (10) days from date of delinquency any charge or charges levied and assessed under the terms of this chapter, to discontinue such water or sewer service and refuse further service to such person, firm or corporation until said charge is paid or satisfactory arrangement for payment is made for one additional month before discontinuing such water or sewer service. In addition, the sum of fifty-dollars ($50.00) is hereby assessed for making a service call for the purpose of cutting off service Ordinance No. 05-3453 Water Rate Adjustment Page I of 3 373 for failure on the part of the consumer to pay water or sewer service or installment charges or for the purpose of collecting a delinquent account or for both if both purposes are accomplished in one service call. Until the account at the premises where service is cut off is paid in full or until the consumer or his agent has made arrangements satisfactory ,with the director of finance to pay such amounts, such service shall remain cut off, Sec. 25-37. Collection fee for bad check Should collection be required for the purposE; of collecting a check given by the customer in payment of a water bill, said check having been presented to the bank and bank having not honored said check, a charge of twenty-five dollars ($25.00) may be assessed. Sec. 25-41. Water rates, billings The City shall charge and collect, and every c, onsumer of water shall pay for the water furnished by the City to the consumer the amounts calculated by application of the rates to metered readings as provided in this chapter. This amendment is effective by ordinance as of October ~, 2003. with the first billiing of October 2005. a) The following are established as the montlhly rates to be charged for water furnished by the City of Plainview for all consumers, unless otherwise noted: The City shall make a minimum monthly ,charge of eight ~'J~"~JJ""J¥'svv..u. ~ nine dollars and twenty-five cents ($9.25), to each consumer inside the City limits using City water. An additional charge of ~!rty-five "'~"'*ovv...v lc",,...35) one dollar and forty cents ($1.40) for each one thousand (1,000) gallons shall be assessed on all water consumed up to and including twenty-five thousand (25,000) gallons. An additional charge of one do!!ar and ~ one dollar and fifty-five cents ($1.55) shall be assessed on each one thousand (1,000) gallons on all water consumed in excess of twenty-five thousand (25,000) gallons. An additional charge of one dollar and fifty cents ($1.50) for each one thousand (1,000) gallons shall be assessed on all water consumed up to and including twenty-five thousand (25,000) gallons. An additional charge of one dollar and ninety cents ($1.90) shall be made on each one thousand (1,000) gallons on all water consumed in excess of twenty-five thousand (25,000) gallons. The net amount due may be paid on or before the past due date printed on the bill. All payments must be in the possession of the utility accounting department by 5:00 p.m. on the past-due date to prevent .a penalty charge being assessed. Penalty on delinquent bills. A one-time penalty of ten (10) percent of the total utility bill shall be assessed on all bills not paid on or before the past-due date printed on the bill. All payments must be in the possession of the utility accounting department by 5:00 p.m. close of business on the past-due date to Ordinance No. 05-3453 Water Rate Adjustment Page 2 of 3 prevent a penalty charge being assessed. The gross due, which includes penalty, shall be the amount due after 5:00 p.m. on the past-due date. Section II Provisions of this ordinance are cumulative and nothing herein shall prevent, alter, or diminish the applicability or enforcement of other ordinances restricting, regulating, or governing the subject matter herein. Section III All ordinances or portions of any ordinance of the City of Plainview, Texas in conflict herewith, are hereby amended to conform with the provisions hereof. Section IV Should any section, subsection, or any portion hereof be deemed invalid for any reason, such holding shall not render or invalidate any other section, subsection, sentence, provision, clause, phrase, or word severable therefrom and the same shall be deemed severable for this purpose. Section V This ordinance shall be effective with the first billing in October, 2005. PASSED AND APPROVED on first reading this the 20th day of September, 2005.
