HomeMy WebLinkAbout98 1124 min MINUTES CITY COUNCIL lvlEETING City of Plainview November 24, 1998 The Plainview City Council met at 7:30 p.m., Tuesday, November 24, 1998 in the Council Chambers of the Plainview City Hall at 901 Broadway. The Council met in Pre-Session at 7:00 p.m. Mayor Pro-Tem Rey Rosas presided. Councilmembers present were: Sam Parker-Precinct 1, Mary Jane Shanes-Precinct 2, Ross Owen-Precinct 5, Bobby McGehee-Precinct 6, and Irene Favila-Precinct 7. Excused absences were granted to Mayor Lloyd Woods and Cotmcilmember Mike Hutcherson. Staff members present were: Jim Jeffers-City Manager, John Castro-Director of Community Services, John Berry- Assistant Director of Public WOrks, Dale Simpson-Civil Service Director, Cindy Gasaway-Main Street Coordinator, Gary Glass-Fire Chief, William Mull-Police Chief and Karen McBeth, city secretary. News media present: Jeff Stevens-Plainview Daily Herald. OPEN MEETING Invocation - The Honorable Irene Favila Pledge of Allegiance 2. Recognitions - Soila Reyes, of Catholic Family Services was presented a Proclamation for World AIDS Day, December 1, 1998 by Councilmember Irene Favila. 3. Consent Calendar - Councilmember Bobby McGehee moved to adopt the Consent Calendar as presented. Mayor Pro-Tern Rey Rosas seconded the motion. The motion carried with all six Councilmembers present voting for the motion, none voted against. a) b) c) d) Minutes of November 5 and November 10, 1998 were approved. Departmental Reports were accepted. Expenditures were approved. Excused Absences were granted to Mayor Lloyd Woods and Councilmember Mike Hutcherson for this meeting. REGULAR AGENDA ITEMS 4. Plainview/Hale County Airport Annual Report. Mr. Marlin Miller, Co-Manager of the Plainview/Hale County Airport gave a report on this past year which he described as one of the busiest in its history. He said the Plainview/Hale County Airport is entirely self supporting with ground rental charges, gas overrides and commercial fees. At present the airport is looking toward a $850,000 runway extension and seal coat. The airport employees 25 people. It will soon have a new automated weather reporting system that can be accessed 24 hours a day. He told the Council the airport has had a significant economic impact on Plainview and all of the larger corporations that have chosen to locate here have done so because of the airport. He said the Industrial Foundation uses the airport as a drawing tool when recruiting businesses. He reviewed the history of the airport, telling the Council that in 1941, Mr. E.Q. Perry purchased the airport land Page 1 of 3 which was a grass pasture with two Quonset barns, which he subsequently gave to the City and County. The first runway was constructed and it was 400 feet in length. James Miller and Claude Hutcherson built the rest of the buildings which are now present. It was used briefly in the late 40's by Continental Airlines as a scheduled airline terminal, and then Mr. Miller established the first non- scheduled airline in Texas, and it was based at the airport. He said the airport is known nationally and is something Plainview can be proud of. Councilmember Owen asked if there would be any interruption in service when the runway overlay is done? Mr. Miller said no, the runways will be done alternately. Mr. Miller said the new runway will accommodate more weight and larger airplanes will be able to use the airport. Councilmember Owen asked how long the overlay will take? Mr. Miller said 90 days, if the weather is good, but if they have to reconstruct the base of the runway, it will take much longer. 5. Curfew. Report from the Youth Advisory Commission. This item was tabled. Appeal to City Council of the decision of the Planning and Zoning Commission regarding the request of Rio Coucho Mobile ltome Park for altering fencing requirements. John Castro, Director of Community Services, explained the owners of the Rio Concho Mobile Home Park have requested, through the law firm Owen Lyle Voss & Owen, they be given a permanent waiver from the fencing requirements in the Planning and Zoning Ordinance. The current ordinances states a solid fence is to act as a barrier between R-1 residential districts and non-R-1 districts, and it specifically states solid fence. Mr. Castro said the owners are willing to build a fence, just not a solid one. They want to construct a chain-link fence. They site safety as the main reason for this request. The Planning and Zoning Commission denied their request and are now appealing to the City Council for a temporary waiver from the solid fence requirement. Attorney Jarred Melton, representing Sunbelt Premium Properties who own the mobile home park, addressed the Council stating his clients are in complete agreement with constructing a fence, but as the adjacent properties are all agricultural, they want.to construct a chain-link fence. Mr. Melton said the solid fence hides drug trafficking and vandals have set fires which were not visible to those living inside the park. He said these are definite hazards which he believes a chain-link fence would rectify. Mr. Royce Carthel, 3401 Grandview, told the Council that he farms the land adjacent to the mobile home park and he definitely wants to see a fence erected. He said the trash and plastic bags which blow into his crops are quite costly to him and the mobile home park should be a good neighbor and construct a fence. Whether the fence was solid or chain-link was immaterial to him, but a fence was necessary. Mrs. Cindy Garcia, a neighbor to the East of the mobile home park, said she believes a fence to be quite important. She said since the fence between their property has blown down, people have driven across her property and started fires on her property, and she believes they were started by children from the mobile home park. Mr. Melton again told the Council his clients intend to build a fence, their request is that it not be a solid fence. He said he believed a chain-link fence would deter people from driving across the property and curtail childrens activities also. Councilmember Owen asked if there is a stipulation in the ordinance as to the height of the fence? Mr. Jeffers, City Manager, said not now, but it can be stipulated. However, the more expensive the fence, the cost will be passed on Page 2 of 3 to the tenants of the mobile home park. Councilmember Owen made a motion that the owners be required to build a 6 to 8 foot chain-link fence all the way around the park, and that it be constructed within 60 days. Mayor Pro-Tern Reyes seconded the motion. Councilmember McGehee moved to amend the motion to stipulate that a variety of juniper trees and a watering system be planted in conjunction with the chain-link fence, which will give the visual barrier required, and that this be done within the 60 day time frame. Councilmember Favila seconded the motion to amend. Councilmembers Parker, Shanes, Owen, McGehee, Favila and Mayor Pro-Tem Rosas all voted in favor of the amendment~ On the amended motion, Councilmembers Parker, Owen, McGehee, Favila and Mayor Pro-Tem Rosas voted yes. Councilmember Shanes voted no. The motion, as amended, passed. Ordinance No. 98-3199. An Ordinance amending the zoning map of the City of Plainview, Texas to rezone property located at 3401 SW 3rd Street (Fire Station) from an MF-2, Multi- family district to a C-3, Commercial General Business District; Cumulativeness clause; Conflict clause; Severability clause; And Effective date. First reading. Director of Community Services John Castro reviewed the ordinance stating the Planning and Zoning Commission had unanimously recommended its approval. He said they received five written responses to the proposed rezoning, 3 for and 2 against. Councilmember McGehee moved to approve Ordinance No. 98-3199. Councilmember Owen seconded the motion. Councilmembers Parker, Shanes, Owen, McGehee and Favila and Mayor Pro Tem Rosas voted yes to the motion. None voted against. Open Forum. Hear citizens requests and comments per Open Forum Policy. No one spoke on the Open Forum. Closed Session. Deliberate the appointment, employment, evaluation, reassignment or duties, removal, discipline or dismissal of a public officer or employee, board, commission, or committee member, or to hear complaints or charges. (Parks Advisory Commission). [Tex. Gov't. Code Section 551.074]. No Closed session was held. 10. Consider appointment to the Parks Advisory Commission. Councilmember Owen moved to appoint Evalene McDOnald to the Parks Advisory Commission. Councilmember Favila seconded the motion. Councilmembers Parker, Shanes, Owen, McGehee and Favila and Mayor Pro Tem Rosas voted yes to the motion. None voted against. 11. Adjournment. Councilmember Owen moved to adjourn the meeting and Councilmember Shanes seconded the motion, the motion passed unanimously.
