CITY COUNCIL MEETING
City of Plainview
November 10, 1998
The Plainview City Council held a meeting at 7:30 P.M., Tuesday, November 10, 1998, in the Council
Chambers of the Plamview City Hall at 901 Broadway, Plainview, Texas. Mayor Lloyd Woods presided at the meeting.
Present were Council members Sam Parker - Precinct 1, Mary Jane Shanes - Precinct 2, Rey Rosas - Precinct 3, Mike
Hutcherson - Precinct 4, Ross Owen - Precinct 5, Bobby R. McGehee - Precinct 6, and Irene Favila - Precinct 7.
Staff members present were: Jim Jeffers - City Manager, Gary Glass - Chief of Fire Department, John Berry -
Assistant Director of Public Works, Dale Simpson - Civil Service Director, Wally Hatch - City Attorney, John Castro -
Director of Community Development, and Christina Bonner - Deputy City Secretary.
News media present were: Richard Orr - Plainview Daily Herald.

2. Recognitions. - There were none.
3. Consent Calendar - Council member McGehee moved to approve the Consent Calendar as
presented. Council member Rosas seconded the motion. The motion carried unanimously among
the Council members and the Mayor.

Building Code Amendment. Ordinance No. 98-3196. An Ordinance of the City of
Plainview, Texas amending 6-1-16; and 6-26 of the Plainview Code of Ordinances;
Severability clause; Cumulativeness; Conflicts clause; And effective date. Second
reading. Passed and approved.
f)
Minimum Housing Code Amendment. Ordinance No. 98-3197. An Ordinance of
the City of Plainview, Texas amending Chapter 13 of the Plainview Code of
Ordinances; Severability clause; Cumulativeness clause; Conflicts clause; And
effective date. Second reading. Passed and approved.
g)
Nuisance Amendment. Ordinance No. 98-3198. An Ordinance amending the City
of Plainview Code of Ordinances, Chapter 16, Nuisance Code and amending sections
of the Nuisance Code; Cumulativeness clause; Conflicts clause, Severability clause;

And effective date. Second reading. Passed and approved.

Ordinance No. 98-3195. Codification Amendment Adoption. An Ordinance
adopting and enacting amendments to the Code of the City of Plainview; Compiled
and codified by authority of the City Council; Containing amendments to the
permanent, general ordinances of the city; Repealing all ordinances or parts of
ordinances of a permanent, general nature not included in the code in full or by
reference; Providing a penalty for wrongfully changing or tampering with the code;
Providing for certification of copies thereof, And prescribing the time when the
amended code shall become effective. Second reading. Passed and approved.
i)
Consider of award of bids for Police cars. Bids were received from Jack Morris Ford
of Plainview in the amount of $200,811.50 for ten police cars; South West Ford of
Weatherford, Texas bid $100,227.00 for ten police cars. In terms of logistics, Jack
Morris Ford, based on past performance in dealing with the City of Plainview, has and
can provide on site training aides and technical support to City service personnel,
reducing training costs and reducing vehicle down time, representing approximately
$400 per vehicle, the bid was awarded to Jack Morris Ford.
REGULAR AGENDA ITEMS
Zone Case No. 666. Ordinance No. 98-3188. An Ordinance authorizing the issuance of a
Specific Use Permit to operate a flea market in a C-3 (Commercial) Zoning district, generally
known as 608 E. 5th Street; Cumulativeness clause; Conflicts; Conflicts clause; Severability
clause; and effective date. Second reading.
Council member McGehee moved that Ordinance 98-3188 be approved Council member
Rosas seconded. There was no comment from the public or the Council. Council members Parker,
Shanes, Rosas, Hutcherson, Owen, McGee and Favila, and the Mayor voted unanimously to approve
the Ordinance. None voted against it
Zone Case No. 667. Ordinance No. 98-3192. An Ordinance authorizing the issuance of a
Specific Use Permit to operate a custom personal service shop in an (0) Office Zoning
District, generally known as 714 West 7th Street; Cumulativeness clause; Conflicts clause;
Severability clause; And effective date. Second reading.
Council member McGehee moved that Ordinance 98-3192 be approved. Council member
Rosas seconded. There was no comment from the public or the Council. Council members Parker,
Shanes, Rosas, Hutcherson, Owen, McGehee and Favila, and the Mayor voted unanimously i favor
of the motion to approve. None voted against it.
6. Annual Report of the Community Development division.

Director of Community ServiCes John Castro reviewed what the community development staff deals
with on a daily basis. The department handles planning, zoning, code enforcement, mail, switchboard,
collection of fees for permits related to building, electrical, plumbing and testing, the rental of city
buildings and scheduling the city owned vehicles for departmental use.
The Planning and Zoning Commission, and the Board of Adjustments are part of the Community
Services Departmentl Planning and Zoning determines the location and types of businesses which
make up the commercial, business and service industries in Plainview. This year the P&Z has
reviewed 15 cases and made recommendations to the City Council on possible courses of action.
Based on those recommendations the Council has granted 13 specific use permits, approved 2 zone
changes, residential to commercial and commercial to residential. The Board of Adjustments rules
on zoning variances. The board has ruled on 25 cases since the beginning of the year and currently
has 8 cases pending. The more pressing issues for the P&Z and BA is membership. While there are
enough members to function, the need for alternate members is crucial.
Community Development is currently designated as the Grant Administrator and Labor Service
Officer for the Highway 70 sewer installation project.
Mayor Woods thanked Mr. Castro for his report.
Open Forum. Hear citizens requests and comments per Open Forum Policy. There were
requests or comments.
Closed Session. Deliberate the appointment, employment, evaluation, reassignment or
duties, removal, discipline or dismissal of a public officer or employee, board, commission,
or committee member, or to hear complaints or charges. (Board of Adjustment). [Tex.
Gov't. Code Section 551.074]. A Closed Session was not held.
Adjournment. Councilmember Owen moved to adjourn the meeting and Councilmember
Hutcherson seconded the motion, which carried unanimously. Mayor Woods adjourned the
meeting at 7:45 P.M.
