R19-451 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, ORDERING A SPECIAL ELECTION BY THE VOTERS IN DISTRICT NO. 7, TO ELECT A PERSON TO FILL THE VACANCY AND UNEXPIRED TERM CREATED BY THE RESIGNATION OF THE COUNCILMEMBER FOR THAT DISTRICT; TO OCCUR ON NOVEMBER 5, 2019 IN ACCORDANCE WITH THE TEXAS ELECTION CODE. WHEREAS, on August 27, 2019 at a regular City Council meeting, Oliver Aldape, Councilmember for District No. 7, tendered his written resignation of his office to the City Council and it was accepted by the City Council; and WHEREAS, Article II, Section 2.06(c) of the Plainview City Charter requires a special election be called within 120 days of the creation of a vacancy to fill the unexpired term of that office; and WHEREAS, there exists a need for a Special Election for voters in District No. 7, to fill the vacancy in the seat for District No. 7, as required by the Charter of the City of Plainview; and WHEREAS, the Election shall be held on the Tuesday, November 5, 2019; and WHEREAS, any political subdivision holding an Election on the November uniform election date must use county election precincts and county polling places where that political subdivision is located; and WHEREAS, Section 85.005 (d) of the Texas Election Code further requires that in an Election ordered by a city, early voting by personal appearance at the main early voting polling place shall be conducted for at least 12 hours: (1) on one weekday, if the early voting period consists of less than six weekdays; or (2) on two weekdays, if the early voting period consists of six or more weekdays; and WHEREAS, all persons qualified to vote in said Election under the Election Laws of the State of Texas shall be allowed to vote therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLAINVIEW, TEXAS, THAT: SECTION 1 A Special Election shall be held in the City of Plainview, Texas on the 5tn day of November, 2019. Said Election is to elect a Councilmember for District 7 to serve until May 2, 2020, the unexpired term of Councilmember Oliver Aldape. Resolution R19-451 Election Page 1 of 2 243 SECTION 2 Applications for a place on the City of Plainview Special Election ballot may be filed beginning August 28, 2019 through September 4, 2019 at 5:00 p.m. The applications should be delivered to the City Secretary at 901 Broadway, Plainview, Texas 79072. SECTION 3 All electors shall vote in the voting district in which said voter resides, and at the polling place provided for voting as designated in Section 4 of this Resolution. SECTION 4 The election shall be held within the municipal limits of the City of Plainview between the hours of 7:00 a.m. and 7:00 p.m. on November 5, 2019. The Election shall occur at the following designated polling place(s), and with the following election officers, who are hereby appointed to hold said Election: 011ie Liner Center 2000 S. Columbia Plainview, Texas 79072 Presiding Judge: Mary Ann Cross Alternate Judge: Irene Hipolito SECTION 5 Early voting by personal appearance will be conducted each weekday at the Hale County Courthouse, 500 Broadway, Plainview, Texas between the hours of 8:00 a.m. and 5:00 p.m. beginning on October 21, 2019 and ending on November 1, 2019. On Thursday, October 24, 2019 and Thursday, October 31, 2019 early voting by personal appearance will be conducted between the hours of 7:00 a.m. and 7:00 p.m. as required by Section 85.005 (d) of the Texas Election Code. SECTION 6 Notice of this Election shall be given in accordance with the provisions of the Texas Election Code and returns of such notice shall be made as provided for in said Code.
